Splitska bolnica mora isplatiti 625.000 kuna plus kamate trima liječnicama koje je zakinula za dodatke na plaću tijekom šest godina. Radi se o ukupnom iznosu po tri presude Općinskog suda u Splitu, a osim naknade neisplaćenog dijela osobnih dohodaka KBC Split mora platiti i 39.500 kuna troškova postupaka.

Najveći iznos neisplaćenih dodataka od 286.182 kuna mora se nadoknaditi liječnici s Klinike za psihijatriju sa znanstvenim stupnjem magistra, koja je u spornom periodu bila i na jednoj od rukovodećih dužnosti. Osim što su liječnicu  zakinuli za dodatke koji joj pripadaju, prilikom odlaska na godišnji odmor i bolovanje su joj isplaćivali naknadu na temelju takvog kljastog obračuna. Bolnica uz to mora po presudi platiti 14.000 kuna sudskog troška u navedenom postupku.

20 godina staža

Druga liječnica radi na Klinici za dječje bolesti, doktorica je znanosti te joj se mora nadoknaditi 172.313 kuna za koje je uskraćena neisplatom dodataka. Kroz razdoblje od 01. siječnja 2014. godine do kraja 2020. godine je njen rad bio organiziran kroz redovan rad, kao i kroz osmosatna, 16-satna te 24-satna dežurstva, radnim danima, subotom i nedjeljom, praznicima te noću.

Zbog organizacije rada, doktorica je u svakom mjesecu u spornom razdoblju ostvarila veliki broj prekovremenih sati na koje joj nisu obračunati dodaci. Također su joj umanjene naknade za godišnji odmor u tom razdoblju. Osim isplate dodataka, bolnica treba nadoknaditi i 11.500 kuna sudskog troška.

Iznos od 166.353 kune KBC Split će morati isplatiti liječnici specijalistici koja je također kao i njene kolegice učestalo radila prekovremeno. Na istom radnom mjestu doktorica je radila i u redovnom i u prekovremenom radu.

Poslodavac joj je dodatak za iznimnu odgovornost za život i zdravlje ljudi isplaćivao samo za redovne sate, dok joj ga nije isplaćivao za prekovremene sate, iako je svaki sat radila na poslovima doktora medicine. Isto tako joj nije isplaćivan dodatak za staž za cijelo vrijeme rada, iako je i u redovnim i prekovremenim satima imala više od 20 godina radnog staža u zdravstvenim ustanovama.

Jednak način obračuna primijenjen je i za ostale dodatke te za naknadu za godišnji odmor. Sud je to presudom ocijenio nepravilnim te je naložio nadoknadu neisplaćenih dijelova plaće. I u tom postupku bolnica mora platiti 14.000 kuna troškova.

KBC Split je u odgovorima na tužbu navela kako ne osporava osnovu tužbe, ali osporava iznose naknada. U sva tri postupka napravljeni su nalazi i vještačenja financijsko knjigovodstvene struke kojima je utvrđeno za koliko su umanjene plaće svima trima liječnicima.

Temeljem mišljenja vještakinje sud je ocijenio kako liječnice imaju pravo na navedene dodatke na plaću i to kumulativno, za posebne uvjete rada, za iznimnu odgovornost za život i zdravlje ljudi, za radni staž u zdravstvu, te za znanstveni stupanj, za sve odrađene sate, uključujući i prekovremene sate. Nabrojeni dodaci su propisani Kolektivnim ugovorom, a visina neisplaćenih iznosa određena je vještačenjem, sukladno plaćama i pripadajućim dodacima.

Sporni prekovremeni sati

Odluke su nepravomoćne te bolnica ima pravo žalbe, ali nije za očekivati da će oboriti presude pošto je krajem 2019. godine Vrhovni sud objavio odluku prema kojoj su  poslodavci obvezni zdravstvenim radnicima isplaćivati propisane dodatke. Za djelatnost zdravstva propisano uvećanje plaće na osnovi otežanih uvjeta rada za sve poslove koji u sustavu postoje i to u iznosu od 7 do 25 posto.

Sporno je bilo što su se navedeni dodaci, nakon uvođenja centralnog obračuna plaća u prosincu 2013. godine, obračunavali samo na redovne sate, ali ne i na prekovremene. Stav ministarstva te time i bolnica je bio kako se prekovremeni sati plaćaju 50 posto više te se na njih ne treba isplaćivati i dodatke.

Nakon toga je uslijedilo masovno podnošenje tužbi od strane liječnika i ostalih medicinskih djelatnika protiv hrvatskih bolnica. Kako bi se ujednačila sudska praksa Vrhovni sud je u konačnici na sjednici Građanskog odjela donio odluku prema kojoj su se trebali ravnati suci u navedenim parnicama.

Već tada je na općinskom sudovima bilo u radu oko 4000 tužbi zdravstvenih radnika u kojima se procijenilo da je ukupan iznos potraživanja 2 milijarde kuna.

I splitske liječnice tužile su bolnicu tražeći isplatu iznosa koji im pripadaju po osnovi nekoliko dodataka na plaću: za otežane uvjete rada, za odgovornost za život i zdravlje ljudi, za radni staž u zdravstvu, zatim s osnove znanstvenog stupnja i po osnovi naknade plaće za vrijeme korištenja godišnjeg odmora i bolovanja.

Splitska bolnica mora isplatiti 625.000 kuna plus kamate trima liječnicama koje je zakinula za dodatke na plaću tijekom šest godina. Radi se o ukupnom iznosu po tri presude Općinskog suda u Splitu, a osim naknade neisplaćenog dijela osobnih dohodaka KBC Split mora platiti i 39.500 kuna troškova postupaka.

Najveći iznos neisplaćenih dodataka od 286.182 kuna mora se nadoknaditi liječnici s Klinike za psihijatriju sa znanstvenim stupnjem magistra, koja je u spornom periodu bila i na jednoj od rukovodećih dužnosti. Osim što su liječnicu  zakinuli za dodatke koji joj pripadaju, prilikom odlaska na godišnji odmor i bolovanje su joj isplaćivali naknadu na temelju takvog kljastog obračuna. Bolnica uz to mora po presudi platiti 14.000 kuna sudskog troška u navedenom postupku.

20 godina staža

Druga liječnica radi na Klinici za dječje bolesti, doktorica je znanosti te joj se mora nadoknaditi 172.313 kuna za koje je uskraćena neisplatom dodataka. Kroz razdoblje od 01. siječnja 2014. godine do kraja 2020. godine je njen rad bio organiziran kroz redovan rad, kao i kroz osmosatna, 16-satna te 24-satna dežurstva, radnim danima, subotom i nedjeljom, praznicima te noću.

Zbog organizacije rada, doktorica je u svakom mjesecu u spornom razdoblju ostvarila veliki broj prekovremenih sati na koje joj nisu obračunati dodaci. Također su joj umanjene naknade za godišnji odmor u tom razdoblju. Osim isplate dodataka, bolnica treba nadoknaditi i 11.500 kuna sudskog troška.

Iznos od 166.353 kune KBC Split će morati isplatiti liječnici specijalistici koja je također kao i njene kolegice učestalo radila prekovremeno. Na istom radnom mjestu doktorica je radila i u redovnom i u prekovremenom radu.

Poslodavac joj je dodatak za iznimnu odgovornost za život i zdravlje ljudi isplaćivao samo za redovne sate, dok joj ga nije isplaćivao za prekovremene sate, iako je svaki sat radila na poslovima doktora medicine. Isto tako joj nije isplaćivan dodatak za staž za cijelo vrijeme rada, iako je i u redovnim i prekovremenim satima imala više od 20 godina radnog staža u zdravstvenim ustanovama.

Jednak način obračuna primijenjen je i za ostale dodatke te za naknadu za godišnji odmor. Sud je to presudom ocijenio nepravilnim te je naložio nadoknadu neisplaćenih dijelova plaće. I u tom postupku bolnica mora platiti 14.000 kuna troškova.

KBC Split je u odgovorima na tužbu navela kako ne osporava osnovu tužbe, ali osporava iznose naknada. U sva tri postupka napravljeni su nalazi i vještačenja financijsko knjigovodstvene struke kojima je utvrđeno za koliko su umanjene plaće svima trima liječnicima.

Temeljem mišljenja vještakinje sud je ocijenio kako liječnice imaju pravo na navedene dodatke na plaću i to kumulativno, za posebne uvjete rada, za iznimnu odgovornost za život i zdravlje ljudi, za radni staž u zdravstvu, te za znanstveni stupanj, za sve odrađene sate, uključujući i prekovremene sate. Nabrojeni dodaci su propisani Kolektivnim ugovorom, a visina neisplaćenih iznosa određena je vještačenjem, sukladno plaćama i pripadajućim dodacima.

Sporni prekovremeni sati

Odluke su nepravomoćne te bolnica ima pravo žalbe, ali nije za očekivati da će oboriti presude pošto je krajem 2019. godine Vrhovni sud objavio odluku prema kojoj su  poslodavci obvezni zdravstvenim radnicima isplaćivati propisane dodatke. Za djelatnost zdravstva propisano uvećanje plaće na osnovi otežanih uvjeta rada za sve poslove koji u sustavu postoje i to u iznosu od 7 do 25 posto.

Sporno je bilo što su se navedeni dodaci, nakon uvođenja centralnog obračuna plaća u prosincu 2013. godine, obračunavali samo na redovne sate, ali ne i na prekovremene. Stav ministarstva te time i bolnica je bio kako se prekovremeni sati plaćaju 50 posto više te se na njih ne treba isplaćivati i dodatke.

Nakon toga je uslijedilo masovno podnošenje tužbi od strane liječnika i ostalih medicinskih djelatnika protiv hrvatskih bolnica. Kako bi se ujednačila sudska praksa Vrhovni sud je u konačnici na sjednici Građanskog odjela donio odluku prema kojoj su se trebali ravnati suci u navedenim parnicama.

Već tada je na općinskom sudovima bilo u radu oko 4000 tužbi zdravstvenih radnika u kojima se procijenilo da je ukupan iznos potraživanja 2 milijarde kuna.

I splitske liječnice tužile su bolnicu tražeći isplatu iznosa koji im pripadaju po osnovi nekoliko dodataka na plaću: za otežane uvjete rada, za odgovornost za život i zdravlje ljudi, za radni staž u zdravstvu, zatim s osnove znanstvenog stupnja i po osnovi naknade plaće za vrijeme korištenja godišnjeg odmora i bolovanja.
