Nakon što je prijedlog za izmjenom odluke o povratku osmogodišnjeg Cesarea Avenatija u Italiju odbačen kao nedopušten, ostaje vidjeti hoće li se u drugom postupku na istom sudu ponovno zakazati predaja, tj. "ovrha" dječaka.
Prva predaje se trebala provesti krajem lipnja na splitskim Pujankama, ali je formalno odgođena zbog sudskog propusta jer se nije angažirao prevoditelj za talijanski jezik. Stvarni razlog je bio izbjegavanje problema zbog prosvjeda koji je organiziran na taj dan pred zgradom u kojoj živi Cesare s majkom Ninom Kuluz i njezinom obitelji.
Zbog brojnih ljudi koji su se okupili, splitska policija nije se usudila Alessandra Avenatija, dječakova oca, dovesti do zgrade, nego je bio na obližnjem parkiralištu pod jakim osiguranjem, a kamoli da pokuša provesti pravomoćnu sudsku odluku.
Taj dan nije došlo ni do susreta oca i sina zbog neprijateljske atmosfere prema Talijanu koji je u javnosti proglašen nasilnikom i alkoholičarem. Unatoč činjenici da u Italiji nije nikada ni prijavljen za obiteljsko nasilje te da je splitski sud još 2012. godine dobio i nalaze iz kojih je utvrđeno da nije uživalac droge i alkohola, prevladava javno mnijenje da se radi o osobi kojoj ni po koju cijenu ne treba dati da se približi djetetu.
Dodatno mu otežava to što je strani državljanin, a njegova bivša partnerica, majka dječaka je Hrvatica. Čak ni činjenica da u razdoblju od 2012. do 2016. nije uopće vidio sina koji je za to vrijeme bio u bijegu s majkom u BiH u Vitezu nije probudila puno sućuti kod prosvjednika.
Posljednji put su se otac i sin vidjeli u proljeće ove godine kada je bio jedan od organiziranih susreta kako bi se Cesare zbližio s ocem kojega godinama nije vidio prije odlaska u Italiju. Od rujna 2016. godine Alessandro je periodično dolazio u Split radi susreta sa sinom te je doveo i svoju majku, dječakovu baku.
Kako su susreti prolazili uz međusobno optuživanje roditelja te konstantne pozive policiji, ocu je preporučeno da više ne prelazi put od 1500 kilometara dok ne bude zakazana predaja.
Nakon odgode prve predaje, tj. "ovrhe" dječaka, nova nije zakazana sve do rujna. Neslužbeno saznajemo da se čekalo ročište o prijedlogu za izmjenu odluke koje vodi druga sutkinja. Ročište je održano, prijedlog odbačen, ali stranke imaju i pravo žalbe.
Postoji mogućnost da sutkinja koja je nadležna za ovrhu pričeka i taj rok za slučaj da odbačaj ne postane pravomoćan. Zastarni rok ovrhe je 10 godina, upravo u vrijeme kada će Cesare postati punoljetan.

Nakon što je prijedlog za izmjenom odluke o povratku osmogodišnjeg Cesarea Avenatija u Italiju odbačen kao nedopušten, ostaje vidjeti hoće li se u drugom postupku na istom sudu ponovno zakazati predaja, tj. "ovrha" dječaka.
Prva predaje se trebala provesti krajem lipnja na splitskim Pujankama, ali je formalno odgođena zbog sudskog propusta jer se nije angažirao prevoditelj za talijanski jezik. Stvarni razlog je bio izbjegavanje problema zbog prosvjeda koji je organiziran na taj dan pred zgradom u kojoj živi Cesare s majkom Ninom Kuluz i njezinom obitelji.
Zbog brojnih ljudi koji su se okupili, splitska policija nije se usudila Alessandra Avenatija, dječakova oca, dovesti do zgrade, nego je bio na obližnjem parkiralištu pod jakim osiguranjem, a kamoli da pokuša provesti pravomoćnu sudsku odluku.
Taj dan nije došlo ni do susreta oca i sina zbog neprijateljske atmosfere prema Talijanu koji je u javnosti proglašen nasilnikom i alkoholičarem. Unatoč činjenici da u Italiji nije nikada ni prijavljen za obiteljsko nasilje te da je splitski sud još 2012. godine dobio i nalaze iz kojih je utvrđeno da nije uživalac droge i alkohola, prevladava javno mnijenje da se radi o osobi kojoj ni po koju cijenu ne treba dati da se približi djetetu.
Dodatno mu otežava to što je strani državljanin, a njegova bivša partnerica, majka dječaka je Hrvatica. Čak ni činjenica da u razdoblju od 2012. do 2016. nije uopće vidio sina koji je za to vrijeme bio u bijegu s majkom u BiH u Vitezu nije probudila puno sućuti kod prosvjednika.
Posljednji put su se otac i sin vidjeli u proljeće ove godine kada je bio jedan od organiziranih susreta kako bi se Cesare zbližio s ocem kojega godinama nije vidio prije odlaska u Italiju. Od rujna 2016. godine Alessandro je periodično dolazio u Split radi susreta sa sinom te je doveo i svoju majku, dječakovu baku.
Kako su susreti prolazili uz međusobno optuživanje roditelja te konstantne pozive policiji, ocu je preporučeno da više ne prelazi put od 1500 kilometara dok ne bude zakazana predaja.
Nakon odgode prve predaje, tj. "ovrhe" dječaka, nova nije zakazana sve do rujna. Neslužbeno saznajemo da se čekalo ročište o prijedlogu za izmjenu odluke koje vodi druga sutkinja. Ročište je održano, prijedlog odbačen, ali stranke imaju i pravo žalbe.
Postoji mogućnost da sutkinja koja je nadležna za ovrhu pričeka i taj rok za slučaj da odbačaj ne postane pravomoćan. Zastarni rok ovrhe je 10 godina, upravo u vrijeme kada će Cesare postati punoljetan.
