Rijetko kada, gotovo nikada, gradonačelnici poništavaju odluke Gradskog vijeća. Splitski gradonačelnik Ivica Puljak napravio je upravo to. Donio je odluku o obustavi Zaključka o poštivanju Zakona o sprječavanju sukoba interesa, koji su vijećnici, na prijedlog SDP-ovog Davora Matijevića, izglasali u prvom dijelu, onom borbenom, zadnje sjednice.

Na prvu izgleda kao da Puljak želi širom otvoriti vrata sukobu interesa, ali zdrav razum govori da nitko to ne bi to radio ovako transparentno. O čemu se onda radi? SDP-ovci su imali namjeru postupak biranja direktora gradskih firmi prepustiti vijećnicima, pa je tako u njihovom prijedlogu (koji je, nota bene, prošao) stajalo da bi gradonačelnik Grada Splita u postupku izbora i imenovanja direktora sve informacije o prijavljenim kandidatima trebao dostaviti vijećnicima.

Također, većina vijećnika (HDZ, HGS i SDP) je izglasala i da se isključivo na prijedlog Gradskog vijeća izvrši izbor i imenovanje direktora trgovačkih društava u vlasništvu Grada. I sad je gradonačelnik takvu odluku jednostavno obustavio. Nema je više. Upitali smo ga zbog čega je to napravio. Odgovorila nam je Marina Protić, pročelnica Ureda grada.

Tvrdi da je donošenjem Zaključka o poštivanju Zakona o sprječavanju sukoba interesa Gradsko vijeće prekršilo odredbe dvaju drugih zakona. I to, navodi dalje, Zakona o lokalnoj i područnoj (regionalnoj) samoupravi kao (ZLPS)i Zakona o trgovačkim društvima. Zbog toga je gradonačelnik Puljak obustavio sporni Zaključak i to sve dok Ministarstvo pravosuđa i uprave, kao nadležno tijelo, ne donese odluku.

Naime, objašnjava nadalje Marina Protić, Zakonom o lokalnoj i područnoj (regionalnoj) samoupravi propisano je da izvršno tijelo "imenuje i razrješuje predstavnike jedinice lokalne, odnosno područne (regionalne) samouprave u tijelima javnih ustanova, trgovačkih društava i drugih pravnih osoba, osim ako posebnim zakonom nije drugačije određeno“.

Nadalje, Zakonom o trgovačkim društvima propisano je da "Skupština odlučuje o pitanjima određenim društvenim ugovorom, a osobito o imenovanju i opozivu članova uprave, te o izboru i opozivu članova nadzornog odbora ako ga društvo ima“.

Propisi kažu i da je gradonačelnik kao zakonski zastupnik Grada, temeljem ZLPS-a, ujedno je i zastupnik Grada u Skupštini trgovačkog društva kojeg je Grad osnivač, ako nije odredio drugu osobu. Dakle, tumače iz Ureda Grada, gradonačelnik je Skupština, odnosno on postaje član Skupštine na osnovi zakona utvrđivanjem konačnih rezultata izbora.

To nije sve: Statut Grada Splita propisuje da gradonačelnik "predlaže imenovanja i razrješenja sukladno Zakonu i aktima Gradskoga vijeća te imenuje i razrješuje predstavnike Grada Splita u tijelima javnih ustanova, trgovačkih društava i drugih pravnih osoba osnovanih za obavljanje gospodarskih, društvenih, komunalnih i drugih djelatnosti od interesa za Grad Split, osim ako posebnim zakonom nije drugačije određeno“.

U slučajevima u kojima dolazi do kolizije odredbe određenih članaka Zakona o sprječavanju sukoba interesa i Zakona o lokalnoj i područnoj (regionalnoj) samoupravi primjenjuje se, ističe pročelnica Protić, odredba onoga zakona koji je kasnije stupio na snagu, odnosno odredba članka 48. ZLPS-a, na temelju koje gradonačelnik imenuje i razrješava predstavnike u tijelima trgovačkih društava kojima je Grad (su)vlasnik.

Teško se snaći u šumi ovih zakonskih propisa i tumačenja, ali jedno je ipak jasno: Ivica Puljak je opet pokazao zube svojim bivšim koalicijskim partnerima iz SDP-a.

Rijetko kada, gotovo nikada, gradonačelnici poništavaju odluke Gradskog vijeća. Splitski gradonačelnik Ivica Puljak napravio je upravo to. Donio je odluku o obustavi Zaključka o poštivanju Zakona o sprječavanju sukoba interesa, koji su vijećnici, na prijedlog SDP-ovog Davora Matijevića, izglasali u prvom dijelu, onom borbenom, zadnje sjednice.

Na prvu izgleda kao da Puljak želi širom otvoriti vrata sukobu interesa, ali zdrav razum govori da nitko to ne bi to radio ovako transparentno. O čemu se onda radi? SDP-ovci su imali namjeru postupak biranja direktora gradskih firmi prepustiti vijećnicima, pa je tako u njihovom prijedlogu (koji je, nota bene, prošao) stajalo da bi gradonačelnik Grada Splita u postupku izbora i imenovanja direktora sve informacije o prijavljenim kandidatima trebao dostaviti vijećnicima.

Također, većina vijećnika (HDZ, HGS i SDP) je izglasala i da se isključivo na prijedlog Gradskog vijeća izvrši izbor i imenovanje direktora trgovačkih društava u vlasništvu Grada. I sad je gradonačelnik takvu odluku jednostavno obustavio. Nema je više. Upitali smo ga zbog čega je to napravio. Odgovorila nam je Marina Protić, pročelnica Ureda grada.

Tvrdi da je donošenjem Zaključka o poštivanju Zakona o sprječavanju sukoba interesa Gradsko vijeće prekršilo odredbe dvaju drugih zakona. I to, navodi dalje, Zakona o lokalnoj i područnoj (regionalnoj) samoupravi kao (ZLPS)i Zakona o trgovačkim društvima. Zbog toga je gradonačelnik Puljak obustavio sporni Zaključak i to sve dok Ministarstvo pravosuđa i uprave, kao nadležno tijelo, ne donese odluku.

Naime, objašnjava nadalje Marina Protić, Zakonom o lokalnoj i područnoj (regionalnoj) samoupravi propisano je da izvršno tijelo "imenuje i razrješuje predstavnike jedinice lokalne, odnosno područne (regionalne) samouprave u tijelima javnih ustanova, trgovačkih društava i drugih pravnih osoba, osim ako posebnim zakonom nije drugačije određeno“.

Nadalje, Zakonom o trgovačkim društvima propisano je da "Skupština odlučuje o pitanjima određenim društvenim ugovorom, a osobito o imenovanju i opozivu članova uprave, te o izboru i opozivu članova nadzornog odbora ako ga društvo ima“.

Propisi kažu i da je gradonačelnik kao zakonski zastupnik Grada, temeljem ZLPS-a, ujedno je i zastupnik Grada u Skupštini trgovačkog društva kojeg je Grad osnivač, ako nije odredio drugu osobu. Dakle, tumače iz Ureda Grada, gradonačelnik je Skupština, odnosno on postaje član Skupštine na osnovi zakona utvrđivanjem konačnih rezultata izbora.

To nije sve: Statut Grada Splita propisuje da gradonačelnik "predlaže imenovanja i razrješenja sukladno Zakonu i aktima Gradskoga vijeća te imenuje i razrješuje predstavnike Grada Splita u tijelima javnih ustanova, trgovačkih društava i drugih pravnih osoba osnovanih za obavljanje gospodarskih, društvenih, komunalnih i drugih djelatnosti od interesa za Grad Split, osim ako posebnim zakonom nije drugačije određeno“.

U slučajevima u kojima dolazi do kolizije odredbe određenih članaka Zakona o sprječavanju sukoba interesa i Zakona o lokalnoj i područnoj (regionalnoj) samoupravi primjenjuje se, ističe pročelnica Protić, odredba onoga zakona koji je kasnije stupio na snagu, odnosno odredba članka 48. ZLPS-a, na temelju koje gradonačelnik imenuje i razrješava predstavnike u tijelima trgovačkih društava kojima je Grad (su)vlasnik.

Teško se snaći u šumi ovih zakonskih propisa i tumačenja, ali jedno je ipak jasno: Ivica Puljak je opet pokazao zube svojim bivšim koalicijskim partnerima iz SDP-a.

Rijetko kada, gotovo nikada, gradonačelnici poništavaju odluke Gradskog vijeća. Splitski gradonačelnik Ivica Puljak napravio je upravo to. Donio je odluku o obustavi Zaključka o poštivanju Zakona o sprječavanju sukoba interesa, koji su vijećnici, na prijedlog SDP-ovog Davora Matijevića, izglasali u prvom dijelu, onom borbenom, zadnje sjednice.
