Ovih dana prekinut je sudski postupak po najčudnovatijoj tužbi za koju ste ikada čuli. Onoj koju je 2012. godine podnijela
Udruga "Radio Sudamja" protiv 16 tuženika koji su u povodu blagdana svetog Dujma u javnosti koristili riječ "Sudamja", pa i protiv Odbojkaškog kluba invalida "Split" koji je u Centru "Juraj Bonači" organizirao turnir u sjedećoj košarci nazvan "Sudamja".
Za slučaj da netko nije dobro razumio, "Radio Sudamja" je tužio sve one koji su bez njegova dopuštenja koristili općepoznati termin koji označava feštu splitskog zaštitnika svetog Dujma i traži da mu isplate ukupno 290 tisuća kuna. I sve to jer je 2008. godine kod Državnog zavoda za intelektualno vlasništvo uspio registrirati naziv "Sudamja" kao verbalni žig.
Tako je tužbu radi povrede žiga podnio protiv tvrtke "ST-Arc", koja je kao koncesionar vodila proslavu Sudamje koju organizira Grad, Radio Splita kao medijskog pokrovitelja događaja, HRT, Slobodnu Dalmaciju, internetski portal Dalmacijanews, pa Hrvatsko narodno kazalište, Turističku zajednicu grada, Hrvatsku glazbenu mladež, KUDŽ "Filip Dević"...
Razlog prekidu postupka na Trgovačkom sudu jest što je nad Udrugom "Radio Sudamja" proveden skraćeni stečajni postupak te je udruga izbrisana iz registra.
No, znači li to da se od sada može pisati, izgovarati, pa ako hoćete i vikati "Sudamja! Sudamja!" bez straha da ćete završiti na sudu?
Stečajna upraviteljica jučer nam nije mogla potvrditi hoće li preuzeti vođenje tog postupka, odnosno hoće li s njime morati nastaviti. S jedne strane, naime, propala udruga nema sredstava za pokrivanje troškova "sudovanja". S druge strane, s obzirom na to da se u parnici od tuženika potražuju novčana sredstva, mogla bi po zakonu biti obveza nastaviti s postupkom.
Udruga ima udio u OŠ 'Bačvice-Firule'
U drugom sudskom postupku, onom stečajnom, sudac je naložio stečajnoj upraviteljici da ispita vrijednost udjela koji Udruga "Radio Sudamja" ima u ustanovi Osnovna škola "Bačvice-Firule", registriranoj na adresi Poljička cesta 2. Naravno, ne radi se o javnoj Osnovnoj školi "Pojišan", koja je u Viškoj ulici.

Ovih dana prekinut je sudski postupak po najčudnovatijoj tužbi za koju ste ikada čuli. Onoj koju je 2012. godine podnijela
Udruga "Radio Sudamja" protiv 16 tuženika koji su u povodu blagdana svetog Dujma u javnosti koristili riječ "Sudamja", pa i protiv Odbojkaškog kluba invalida "Split" koji je u Centru "Juraj Bonači" organizirao turnir u sjedećoj košarci nazvan "Sudamja".
Za slučaj da netko nije dobro razumio, "Radio Sudamja" je tužio sve one koji su bez njegova dopuštenja koristili općepoznati termin koji označava feštu splitskog zaštitnika svetog Dujma i traži da mu isplate ukupno 290 tisuća kuna. I sve to jer je 2008. godine kod Državnog zavoda za intelektualno vlasništvo uspio registrirati naziv "Sudamja" kao verbalni žig.
Tako je tužbu radi povrede žiga podnio protiv tvrtke "ST-Arc", koja je kao koncesionar vodila proslavu Sudamje koju organizira Grad, Radio Splita kao medijskog pokrovitelja događaja, HRT, Slobodnu Dalmaciju, internetski portal Dalmacijanews, pa Hrvatsko narodno kazalište, Turističku zajednicu grada, Hrvatsku glazbenu mladež, KUDŽ "Filip Dević"...
Razlog prekidu postupka na Trgovačkom sudu jest što je nad Udrugom "Radio Sudamja" proveden skraćeni stečajni postupak te je udruga izbrisana iz registra.
No, znači li to da se od sada može pisati, izgovarati, pa ako hoćete i vikati "Sudamja! Sudamja!" bez straha da ćete završiti na sudu?
Stečajna upraviteljica jučer nam nije mogla potvrditi hoće li preuzeti vođenje tog postupka, odnosno hoće li s njime morati nastaviti. S jedne strane, naime, propala udruga nema sredstava za pokrivanje troškova "sudovanja". S druge strane, s obzirom na to da se u parnici od tuženika potražuju novčana sredstva, mogla bi po zakonu biti obveza nastaviti s postupkom.
Udruga ima udio u OŠ 'Bačvice-Firule'
U drugom sudskom postupku, onom stečajnom, sudac je naložio stečajnoj upraviteljici da ispita vrijednost udjela koji Udruga "Radio Sudamja" ima u ustanovi Osnovna škola "Bačvice-Firule", registriranoj na adresi Poljička cesta 2. Naravno, ne radi se o javnoj Osnovnoj školi "Pojišan", koja je u Viškoj ulici.
