Nakon što je dio bivših i sadašnjih radnika "Konstruktor-inženjeringa" za naš list kazao da Fina odbija njihove naloge za izravnu naplatu zaostalih plaća jer su platne liste koje im poslodavac izdaje nepotpune, Općinsko državno odvjetništvo pokrenulo je izvide.

– Provodimo izvide radi utvrđivanja postojanja osnova sumnje u počinjenje kaznenog djela neisplate plaća – potvrdila nam je Rene Laura, glasnogovornica Županijskog državnog odvjetništva.

U Kaznenom zakoniku navodi se da će se onaj tko ne isplati jednu ili više plaća jednom ili više radnika kazniti zatvorom. Kaznenog djela nema kad je neisplata uzrokovana nedostatkom novca na računu poslodavca koji nije nastao s ciljem izbjegavanja isplate radnika.

No, 1. veljače ove godine Sveučilište je građevinskoj tvrtki uplatilo značajan iznos kao ostatak duga za izgradnju zgrade triju fakulteta u Kampusu. O kojem se iznosu radi, visokoškolska ustanova skriva jer, kako su objasnili, prema sklopljenoj nagodbi to može otkriti samo "Konstruktorov" čelnik. No, moguće je da se radi o 80 milijuna kuna, jer se taj iznos navodno spominjao na jednoj od lanjskih sjednica sveučilišnog Senata.

Također, iako je od 2012. donedavno trajalo sklapanje predstečajne nagodbe "Konstruktor-inženjeringa" s vjerovnicima, taj postupak nije obuhvatio radnička potraživanja, koja uvijek imaju prvenstvo u naplati.

Tako je i tijekom cijelog tog razdoblja tvrtka svojim zaposlenicima bila obvezna redovito isplaćivati "bušte", ali se, upravo suprotno, prošle godine više puta nalazila na crnim listama Ministarstva financija upravo zbog neisplate plaća dijelu radnika.

– Nakon što je Fina odbila provesti naplatu navodeći da liste nisu potpune, zamolio sam inspektore rada da mi pogledaju koje su platne liste valjane, a koje nisu. Uputili su me da nakon toga tvrtki moram napisati da mi u roku od osam dana izdaju ispravne obračune dospjelih, a neisplaćenih plaća, i ako u tom roku to ne dobijem, da ih prijavim jer su po zakonu dužni dati uredne platne liste, budući da u suprotnom čine kazneno djelo. Kazali su mi i da su ih nakon izlaska teksta u vašem listu zvali brojni građevinari s istim problemom spornih lista – rekao nam je bivši radnik "Konstruktora".

Nakon što je dio bivših i sadašnjih radnika "Konstruktor-inženjeringa" za naš list kazao da Fina odbija njihove naloge za izravnu naplatu zaostalih plaća jer su platne liste koje im poslodavac izdaje nepotpune, Općinsko državno odvjetništvo pokrenulo je izvide.

– Provodimo izvide radi utvrđivanja postojanja osnova sumnje u počinjenje kaznenog djela neisplate plaća – potvrdila nam je Rene Laura, glasnogovornica Županijskog državnog odvjetništva.

U Kaznenom zakoniku navodi se da će se onaj tko ne isplati jednu ili više plaća jednom ili više radnika kazniti zatvorom. Kaznenog djela nema kad je neisplata uzrokovana nedostatkom novca na računu poslodavca koji nije nastao s ciljem izbjegavanja isplate radnika.

No, 1. veljače ove godine Sveučilište je građevinskoj tvrtki uplatilo značajan iznos kao ostatak duga za izgradnju zgrade triju fakulteta u Kampusu. O kojem se iznosu radi, visokoškolska ustanova skriva jer, kako su objasnili, prema sklopljenoj nagodbi to može otkriti samo "Konstruktorov" čelnik. No, moguće je da se radi o 80 milijuna kuna, jer se taj iznos navodno spominjao na jednoj od lanjskih sjednica sveučilišnog Senata.

Također, iako je od 2012. donedavno trajalo sklapanje predstečajne nagodbe "Konstruktor-inženjeringa" s vjerovnicima, taj postupak nije obuhvatio radnička potraživanja, koja uvijek imaju prvenstvo u naplati.

Tako je i tijekom cijelog tog razdoblja tvrtka svojim zaposlenicima bila obvezna redovito isplaćivati "bušte", ali se, upravo suprotno, prošle godine više puta nalazila na crnim listama Ministarstva financija upravo zbog neisplate plaća dijelu radnika.

– Nakon što je Fina odbila provesti naplatu navodeći da liste nisu potpune, zamolio sam inspektore rada da mi pogledaju koje su platne liste valjane, a koje nisu. Uputili su me da nakon toga tvrtki moram napisati da mi u roku od osam dana izdaju ispravne obračune dospjelih, a neisplaćenih plaća, i ako u tom roku to ne dobijem, da ih prijavim jer su po zakonu dužni dati uredne platne liste, budući da u suprotnom čine kazneno djelo. Kazali su mi i da su ih nakon izlaska teksta u vašem listu zvali brojni građevinari s istim problemom spornih lista – rekao nam je bivši radnik "Konstruktora".
