Slučaj falsificiranja potpisa na dokumentu kojim Josip Radeljak od polubrata Željana Radmana želi preuzeti kultni splitski kafić Semafor otišao je u zastaru, piše 24 sata.

Radeljak je, naime, na Trgovačkom sudu u Splitu pokušavao “dokazati” da je Radman njemu prepisao Semafor još 1996. i da mu ga mora predati 2006., nakon deset godina korištenja. Taj spor je na Trgovačkom sudu pravomoćno izgubio, ali nije platio sudske troškove.

Draganu Mijoču, odvjetniku Željana Radmana, dužan je oko pola milijuna kuna, u što su uključene i kamate. Optužni akt zbog kaznenog djela krivotvorenja isprave još 2011. pred Općinskim sudom u Splitu podignulo je Općinsko državno odvjetništvo, no sve je otišlo u zastaru.

- Dva puta je nepravomoćno kažnjen zbog falsificiranja potpisa, a onda bi Županijski sud u Zagrebu slučaj vraćao na početak. Za mene to samo znači da nije oslobođen. Nije mene briga hoće li on biti kažnjen, ali cijeli taj dugogodišnji proces je smiješan -  kazao je Željan Radman za 24 sata.

Kako donosi ovaj portal, prema podacima Općinskog suda u Splitu, Josip Radeljak zbog krivotvorenja isprave prvi put nepravomoćno je osuđen 27. svibnja 2015., i to na kaznu zatvora u trajanju od sedam mjeseci, koja mu je zamijenjena radom za opće dobro. Međutim, ta je presuda ukinuta rješenjem Županijskog suda u Zagrebu u veljači 2016. te je ponovno vraćena u prvostupanjsko postupanje.

U ponovljenom suđenju, presudom od 12. veljače 2018. okrivljenik je ponovno proglašen krivim za isto kazneno djelo te mu je izrečena sankcija kao i ranijom presudom. No i ova presuda je ukinuta rješenjem Županijskog suda u Zagrebu, i to u srpnju 2019. te je predmet opet vraćen na početak. Sud u Zagrebu i prvi i drugi put vraćao je proces na doradu jer im je nedostajalo dodatno objašnjenje u postupku ili prilikom ispitivanja svjedoka. Tako cijeli slučaj oko falsificiranja nije “doživio” pravomoćnost presude jer je rješenjem Općinskog suda u Splitu od 8. lipnja 2020. kazneni postupak protiv Radeljaka obustavljen zbog nastupa zastare.

Odluka je postala pravomoćna 30. lipnja 2020. godine. No iako je slučaj pao u zastaru prije gotovo godinu dana, Radmanu je tema oko Semafora i dalje aktualna, jer Radeljak nije podmirio sudske troškove na Trgovačkom sudu.

- On je sirotinja i sud se nema kako naplatiti. Sve je prebacio na sina. Zato će se Vlatka Pokos i uspjeti naplatiti jer je nju tužio Leo Radeljak. Ne znam što više od njega mogu očekivati. Možda me opet tuži jer me patološki mrzi i meni je to stvarno dozlogrdilo - kazao je Radman za 24 sata, a njegov odvjetnik Dragan Mijoč potvrdio kako je proces na Trgovačkom sudu, kojim je Radeljak pokušavao preuzeti Semafor, a u kojem je on zastupao Radmana, trajao dugo, a njegovi troškovi ostali su nepodmireni.

- Riječ je o velikoj vrijednosti spora predmeta koju je Radeljak sam postavio. Spor smo dobili, ali Radeljak je, po svemu sudeći, socijalni slučaj. Troškovi su 2015. bili 362,850 kuna, a u proteklih šest godina, sa zateznim kamatama, popeli su se na pola milijuna kuna. Prijedlog za ovrhu podnijeli smo 2019., no do danas moji troškovi nisu podmireni - rekao je Mioč novinarki 24 sata, a Radman potvrdio kako je cijeli proces na Trgovačkom sudu doveden do apsurda jer su dokazni materijali bili na njihovoj strani.

- Ma to su nevjerojatne stvari. Primjerice, u dokumentu kojim mu ja 1996. tobože prepuštam Semafor stoji da ga imam pravo koristiti deset godina. A onda on 2004., dakle dvije godine prije isteka tog tobožnjeg dogovora, gostuje na radiju i priča kako mu se ne dolazi u Split jer mu je ukraden Semafor. A kako on zna da mu je ukraden Semafor ako sam mu ga trebao predati tek za dvije godine? Postoji snimka toga gostovanja, a i voditelj je svjedočio da mu je Radeljak bio gost - otkrio je Radman jedan detalj iz tog procesa.

Slučaj falsificiranja potpisa na dokumentu kojim Josip Radeljak od polubrata Željana Radmana želi preuzeti kultni splitski kafić Semafor otišao je u zastaru, piše 24 sata.

Radeljak je, naime, na Trgovačkom sudu u Splitu pokušavao “dokazati” da je Radman njemu prepisao Semafor još 1996. i da mu ga mora predati 2006., nakon deset godina korištenja. Taj spor je na Trgovačkom sudu pravomoćno izgubio, ali nije platio sudske troškove.

Draganu Mijoču, odvjetniku Željana Radmana, dužan je oko pola milijuna kuna, u što su uključene i kamate. Optužni akt zbog kaznenog djela krivotvorenja isprave još 2011. pred Općinskim sudom u Splitu podignulo je Općinsko državno odvjetništvo, no sve je otišlo u zastaru.

- Dva puta je nepravomoćno kažnjen zbog falsificiranja potpisa, a onda bi Županijski sud u Zagrebu slučaj vraćao na početak. Za mene to samo znači da nije oslobođen. Nije mene briga hoće li on biti kažnjen, ali cijeli taj dugogodišnji proces je smiješan -  kazao je Željan Radman za 24 sata.

Kako donosi ovaj portal, prema podacima Općinskog suda u Splitu, Josip Radeljak zbog krivotvorenja isprave prvi put nepravomoćno je osuđen 27. svibnja 2015., i to na kaznu zatvora u trajanju od sedam mjeseci, koja mu je zamijenjena radom za opće dobro. Međutim, ta je presuda ukinuta rješenjem Županijskog suda u Zagrebu u veljači 2016. te je ponovno vraćena u prvostupanjsko postupanje.

U ponovljenom suđenju, presudom od 12. veljače 2018. okrivljenik je ponovno proglašen krivim za isto kazneno djelo te mu je izrečena sankcija kao i ranijom presudom. No i ova presuda je ukinuta rješenjem Županijskog suda u Zagrebu, i to u srpnju 2019. te je predmet opet vraćen na početak. Sud u Zagrebu i prvi i drugi put vraćao je proces na doradu jer im je nedostajalo dodatno objašnjenje u postupku ili prilikom ispitivanja svjedoka. Tako cijeli slučaj oko falsificiranja nije “doživio” pravomoćnost presude jer je rješenjem Općinskog suda u Splitu od 8. lipnja 2020. kazneni postupak protiv Radeljaka obustavljen zbog nastupa zastare.

Odluka je postala pravomoćna 30. lipnja 2020. godine. No iako je slučaj pao u zastaru prije gotovo godinu dana, Radmanu je tema oko Semafora i dalje aktualna, jer Radeljak nije podmirio sudske troškove na Trgovačkom sudu.

- On je sirotinja i sud se nema kako naplatiti. Sve je prebacio na sina. Zato će se Vlatka Pokos i uspjeti naplatiti jer je nju tužio Leo Radeljak. Ne znam što više od njega mogu očekivati. Možda me opet tuži jer me patološki mrzi i meni je to stvarno dozlogrdilo - kazao je Radman za 24 sata, a njegov odvjetnik Dragan Mijoč potvrdio kako je proces na Trgovačkom sudu, kojim je Radeljak pokušavao preuzeti Semafor, a u kojem je on zastupao Radmana, trajao dugo, a njegovi troškovi ostali su nepodmireni.

- Riječ je o velikoj vrijednosti spora predmeta koju je Radeljak sam postavio. Spor smo dobili, ali Radeljak je, po svemu sudeći, socijalni slučaj. Troškovi su 2015. bili 362,850 kuna, a u proteklih šest godina, sa zateznim kamatama, popeli su se na pola milijuna kuna. Prijedlog za ovrhu podnijeli smo 2019., no do danas moji troškovi nisu podmireni - rekao je Mioč novinarki 24 sata, a Radman potvrdio kako je cijeli proces na Trgovačkom sudu doveden do apsurda jer su dokazni materijali bili na njihovoj strani.

- Ma to su nevjerojatne stvari. Primjerice, u dokumentu kojim mu ja 1996. tobože prepuštam Semafor stoji da ga imam pravo koristiti deset godina. A onda on 2004., dakle dvije godine prije isteka tog tobožnjeg dogovora, gostuje na radiju i priča kako mu se ne dolazi u Split jer mu je ukraden Semafor. A kako on zna da mu je ukraden Semafor ako sam mu ga trebao predati tek za dvije godine? Postoji snimka toga gostovanja, a i voditelj je svjedočio da mu je Radeljak bio gost - otkrio je Radman jedan detalj iz tog procesa.
