Potvrđena je optužnica Općinskog državnog odvjetništva zbog pogodovanja vjerovnicima protiv Frane Mitrovića (75) iz Splita i Športskog društva Jadran prema kojoj su cesijama i kompenzacijama s blokiranog računa izvršili plaćanje obveza u iznosu preko milijun kuna.

Terete se kako su tako onemogućili bivšeg vaterpolistu Marija Budimira, koji im je i blokirao račun na temelju pravomoćne ovršne presude, da naplati svoja potraživanja jer je imao prednost pred ostalim vjerovnicima.

Optužni akt navodi kako je Frane Mitrović kao predsjednik udruge ŠD Jadran od polovice svibnja 2010. godine do prosinca 2014. godine, protivno zabranama iz Zakona o platnom prometu i Zakona o provedbi ovrhe na novčanim sredstvima, iako svjestan da je račun udruge blokiran, izvršio 15 obračunskih plaćanja obveza cesijama i kompenzacijama.

Te obveze su nastale nakon prosinca 2006. godine, stoji u optužnici, kada je kao neplaćena obveza u redoslijedu naplate upisano potraživanje Marija Budimira koje je time trebalo imati prednost prilikom namirenja. Tako je izvršeno obračunsko plaćanje iznosa u rasponu od tisuću do više od 450.000 kuna.

Najviši iznosi išli su Gradu Splitu Ugovorom o višestrukoj kompenzaciji na iznos od 270.224 kuna i trgovačkom društvu Abitura d.o.o. iz Splita sporazumom o kompenziranju dugovanja i potraživanja na iznos od 457.328 kuna. Tužiteljstvo za optuženog Mitrovića traži uvjetnu kaznu zatvora od tri mjeseca uz rok kušnje od godinu dana, a za ŠD Jadran traži novčanu kaznu od 15.000 kuna.

Frana Mitrović potvrdio nam je pravomoćnost optužnice te kaže kako nije počinio kazneno djelo koje mu se stavlja na teret.

- Mi smo kao športsko društvo imali blokadu od našeg igrača, pokušavali smo naći zajednički jezik I nalazili mogućnosti i kombinacije. Kad je došlo pri kraju, kada smo našli zajednički jezik, njegovi odvjetnici ipak nisu pristali. Onda je išla kombinacija da mu damo sedam i pol godina da bude pomoćni trener i da ćemo tako regulirati obveze te ni to nisu prihvatili, već smo i dalje bili blokirani. U toj situaciji se za održavanje pogona moralo ići na plaćanje vode, električne energije i ostalog nužno potrebnog. Nismo mogli poslovati, išli smo u predstečajni postupak i sve je riješeno i regulirano pa je tako i sa svojim tražbinama isplaćen i Mario Budimir. Nisam više predsjednik ŠD-a, sad sam samo član. Za sve isplate to postoje pisani zapisnici Uprave ŠD Jadran koji se nalaze u arhivi i sud je s tim upoznat - kazao nam je.

Mario Budimir je pravomoćnom i ovršnom presudom još od listopada 2003. godine imao pravo naplatiti potraživanja od ŠD Jadran čiji račun je blokirao u prosincu te godine. Državno odvjetništvo smatra kako je svako obračunsko plaćanje u uvjetima blokade računa kojim se ne teži za ispunjenjem obveza prema Mariju Budimiru predstavlja kazneno djelo pogodovanje vjerovnika.

Pritom je tužiteljstvo iz inkriminacije izbacilo obračunska plaćanja koja se odnose na “operativne troškove” i porez i doprinos. U optužnici su ostavili cesije i kompenzacije za koje se sa sigurnošću može zaključiti da se su nužne za redovito poslovanje.

Tijekom postupka ŠD Jadran je predstavljao Srđan Kovačić, sadašnji predsjednik. On je također izjavio kako su sva navedena obračunska plaćanja bila nužna za redovno poslovanje te da je u konačnici bivši vaterpolist namiren.

Potvrđena je optužnica Općinskog državnog odvjetništva zbog pogodovanja vjerovnicima protiv Frane Mitrovića (75) iz Splita i Športskog društva Jadran prema kojoj su cesijama i kompenzacijama s blokiranog računa izvršili plaćanje obveza u iznosu preko milijun kuna.

Terete se kako su tako onemogućili bivšeg vaterpolistu Marija Budimira, koji im je i blokirao račun na temelju pravomoćne ovršne presude, da naplati svoja potraživanja jer je imao prednost pred ostalim vjerovnicima.

Optužni akt navodi kako je Frane Mitrović kao predsjednik udruge ŠD Jadran od polovice svibnja 2010. godine do prosinca 2014. godine, protivno zabranama iz Zakona o platnom prometu i Zakona o provedbi ovrhe na novčanim sredstvima, iako svjestan da je račun udruge blokiran, izvršio 15 obračunskih plaćanja obveza cesijama i kompenzacijama.

Te obveze su nastale nakon prosinca 2006. godine, stoji u optužnici, kada je kao neplaćena obveza u redoslijedu naplate upisano potraživanje Marija Budimira koje je time trebalo imati prednost prilikom namirenja. Tako je izvršeno obračunsko plaćanje iznosa u rasponu od tisuću do više od 450.000 kuna.

Najviši iznosi išli su Gradu Splitu Ugovorom o višestrukoj kompenzaciji na iznos od 270.224 kuna i trgovačkom društvu Abitura d.o.o. iz Splita sporazumom o kompenziranju dugovanja i potraživanja na iznos od 457.328 kuna. Tužiteljstvo za optuženog Mitrovića traži uvjetnu kaznu zatvora od tri mjeseca uz rok kušnje od godinu dana, a za ŠD Jadran traži novčanu kaznu od 15.000 kuna.

Frana Mitrović potvrdio nam je pravomoćnost optužnice te kaže kako nije počinio kazneno djelo koje mu se stavlja na teret.

- Mi smo kao športsko društvo imali blokadu od našeg igrača, pokušavali smo naći zajednički jezik I nalazili mogućnosti i kombinacije. Kad je došlo pri kraju, kada smo našli zajednički jezik, njegovi odvjetnici ipak nisu pristali. Onda je išla kombinacija da mu damo sedam i pol godina da bude pomoćni trener i da ćemo tako regulirati obveze te ni to nisu prihvatili, već smo i dalje bili blokirani. U toj situaciji se za održavanje pogona moralo ići na plaćanje vode, električne energije i ostalog nužno potrebnog. Nismo mogli poslovati, išli smo u predstečajni postupak i sve je riješeno i regulirano pa je tako i sa svojim tražbinama isplaćen i Mario Budimir. Nisam više predsjednik ŠD-a, sad sam samo član. Za sve isplate to postoje pisani zapisnici Uprave ŠD Jadran koji se nalaze u arhivi i sud je s tim upoznat - kazao nam je.

Mario Budimir je pravomoćnom i ovršnom presudom još od listopada 2003. godine imao pravo naplatiti potraživanja od ŠD Jadran čiji račun je blokirao u prosincu te godine. Državno odvjetništvo smatra kako je svako obračunsko plaćanje u uvjetima blokade računa kojim se ne teži za ispunjenjem obveza prema Mariju Budimiru predstavlja kazneno djelo pogodovanje vjerovnika.

Pritom je tužiteljstvo iz inkriminacije izbacilo obračunska plaćanja koja se odnose na “operativne troškove” i porez i doprinos. U optužnici su ostavili cesije i kompenzacije za koje se sa sigurnošću može zaključiti da se su nužne za redovito poslovanje.

Tijekom postupka ŠD Jadran je predstavljao Srđan Kovačić, sadašnji predsjednik. On je također izjavio kako su sva navedena obračunska plaćanja bila nužna za redovno poslovanje te da je u konačnici bivši vaterpolist namiren.
