Ovih dana Nova.rs prenosi dramu 45-godišnje Ane Marković, koja želi oploditi dva preživjela embrija nakon smrti voljenog supruga, ali joj država to - ne dozvoljava. Štoviše, želi spaliti zametke, izvještava portal Nova.rs.

- Tražim da mi vrate moja dva embrija da mogu ići na umjetnu oplodnju i dobiti još djece - to bi i moj pokojni suprug želio. No, klinika "Medigrup" hoće da ih uništi jer tako nalaže zakon. Država ne pomaže, već se sprema uvoziti strane jajne stanice i spermatozoide, a naše bezočno spaljuju! Ne znam šta više da uradim, kako da vratim ono što mi pripada - za Nova.rs ljutito govori Ana. Sa privatnom klinikom, državom i Ministarstvom zdravlja po tom pitanju ratuje već godinu dana.

Marković veli da je jedino što želi to da njihova kćer dobije brata ili sestru. No Zakon Republike Srbije nije joj naklonjen.

- Klinika po Zakonu mora spaliti moje zametke, ali to još nisu uradili jer sam ih tužila i još smo na sudu. Platili smo čuvanje dvije godine, a to ističe idućeg tjedna. Da je situacija drugačija mogla bih čuvanje produžiti do pet godina - jada se udovica, čiji je suprug u međuvremenu preminuo.

Navodi i podatak da jedan embrij stoji oko deset tisuća eura, pa strahuje da "s njim u klinici imaju druge planove".

- Muž mi je preminuo u siječnju 2021. od posljedica korone, a u tim najtežim danima morala sam se suočavati sa Klinikom i državom. Moj pokojni suprug i ja smo neposredno pred njegovu smrt ostavili zametke na čuvanje u bolnici "Medigrup Jevremova". Željeli smo i pokušavali proširiti našu malu obitelj. Međutim nakon njegove smrti meni su ta dva embrija oduzeta i osporavaju mi pravo na njih, jer su po našem Zakonu neophodni potpisi oba partnera kako bismo dobili svoje zametke - navodi Marković administrativnu dramu koja ju je snašla pored svega ostalog, zbog čega se u očaju obratila i medijima.

 

Zametke je prijavila na ostavinskoj raspravi kao ostavštinu, jer tu vidi zakonsku nišu kako bi ih ipak mogla održati na životu.

- Kad smo kod Zakona i Željkovog (suprugovog) i mog prava, iz odredbe Zakona o nasljeđivanju (čl. 1. st. 1.) jasno proizilazi da se kao predmet nasljeđivanja smatraju ne samo materijalne vrijednosti već i one duhovne, koje je moj pokojni muž izrazio zamrzavanjem naših zametaka u Specijalnoj ginekološkoj bolnici Jevremova dana 22. studenog 2020., da bi ostavio vezu među generacijama rađanjem djece. Njegovom smrću nije se ugasila i njegova želja za potomstvom koju je izrazio time što je uz puno povjerenja ovoj klinici povjerio na čuvanje da bi se oni jednom iskoristili, a ne spalili. Predmetni embriji dakle predstavljaju ostavštinu mog pokojnog supruga - smatra nesretna udovica iz Srbije, pred kojom je mučna pravna borba. U očaju se obratila pismom i predsjedniku države.

- S obzirom da se ovdje ne radi ni o kakvim materijalnim dobrima koje potražujem, već o pravu na život, na potomstvo, na to da moje dijete dobije brata ili sestru, mislim da je potrebno samo malo dobre volje i ljudskosti, umjesto tumačenja zakona - ljudski zbori Ana Marković koja je, usput rečeno, na Upravi za biomedicinu dobila skandalozan savjet.

 

- Od nadležne liječnice nikakvu pomoć nisam dobila. Odgovor na svako moje pitanje je bio da ‘Zakon to nije predvidio‘. Da ironija bude veća, zakon mi dozvoljava da odem u neku od susjednih zemalja i uzmem sjeme od nepoznatog donora, vratim se i rodim dijete u Srbiji, dok mi naš zakon zabranjuje da uzmem gotov embrij pokojnog muža i rodim naše dijete! Nevjerojatno!

 

U povjerenju mi je rekla da je možda rješenje da se odreknem zametaka i da ih poklonim u ‘Banku siročića‘ u EU, da potom nađem način da ih do tamo ispratim pa otkupim i nađem surogat majku da ih rodi. Pa to normalna osoba ne može razumjeti! Neka nepoznata žena u EU može uzeti i roditi moje zametke, ali ja kao majka u svojoj zemlji ne mogu, jer ‘zakon to nije predvidio‘ - šokirano pripovijeda srbijanska državljanka, udovica Ana Marković.

Na pitanja novinara Nova.rs o zakonskim procedurama prilikom vraćanja zametaka parovima, ali i ljudima koji su u međuvremenu ostali bez partnera, Ministarstvo zdravlja još nije odgovorilo.

Ovih dana Nova.rs prenosi dramu 45-godišnje Ane Marković, koja želi oploditi dva preživjela embrija nakon smrti voljenog supruga, ali joj država to - ne dozvoljava. Štoviše, želi spaliti zametke, izvještava portal Nova.rs.

- Tražim da mi vrate moja dva embrija da mogu ići na umjetnu oplodnju i dobiti još djece - to bi i moj pokojni suprug želio. No, klinika "Medigrup" hoće da ih uništi jer tako nalaže zakon. Država ne pomaže, već se sprema uvoziti strane jajne stanice i spermatozoide, a naše bezočno spaljuju! Ne znam šta više da uradim, kako da vratim ono što mi pripada - za Nova.rs ljutito govori Ana. Sa privatnom klinikom, državom i Ministarstvom zdravlja po tom pitanju ratuje već godinu dana.

Marković veli da je jedino što želi to da njihova kćer dobije brata ili sestru. No Zakon Republike Srbije nije joj naklonjen.

- Klinika po Zakonu mora spaliti moje zametke, ali to još nisu uradili jer sam ih tužila i još smo na sudu. Platili smo čuvanje dvije godine, a to ističe idućeg tjedna. Da je situacija drugačija mogla bih čuvanje produžiti do pet godina - jada se udovica, čiji je suprug u međuvremenu preminuo.

Navodi i podatak da jedan embrij stoji oko deset tisuća eura, pa strahuje da "s njim u klinici imaju druge planove".

- Muž mi je preminuo u siječnju 2021. od posljedica korone, a u tim najtežim danima morala sam se suočavati sa Klinikom i državom. Moj pokojni suprug i ja smo neposredno pred njegovu smrt ostavili zametke na čuvanje u bolnici "Medigrup Jevremova". Željeli smo i pokušavali proširiti našu malu obitelj. Međutim nakon njegove smrti meni su ta dva embrija oduzeta i osporavaju mi pravo na njih, jer su po našem Zakonu neophodni potpisi oba partnera kako bismo dobili svoje zametke - navodi Marković administrativnu dramu koja ju je snašla pored svega ostalog, zbog čega se u očaju obratila i medijima.

 

Zametke je prijavila na ostavinskoj raspravi kao ostavštinu, jer tu vidi zakonsku nišu kako bi ih ipak mogla održati na životu.

- Kad smo kod Zakona i Željkovog (suprugovog) i mog prava, iz odredbe Zakona o nasljeđivanju (čl. 1. st. 1.) jasno proizilazi da se kao predmet nasljeđivanja smatraju ne samo materijalne vrijednosti već i one duhovne, koje je moj pokojni muž izrazio zamrzavanjem naših zametaka u Specijalnoj ginekološkoj bolnici Jevremova dana 22. studenog 2020., da bi ostavio vezu među generacijama rađanjem djece. Njegovom smrću nije se ugasila i njegova želja za potomstvom koju je izrazio time što je uz puno povjerenja ovoj klinici povjerio na čuvanje da bi se oni jednom iskoristili, a ne spalili. Predmetni embriji dakle predstavljaju ostavštinu mog pokojnog supruga - smatra nesretna udovica iz Srbije, pred kojom je mučna pravna borba. U očaju se obratila pismom i predsjedniku države.

- S obzirom da se ovdje ne radi ni o kakvim materijalnim dobrima koje potražujem, već o pravu na život, na potomstvo, na to da moje dijete dobije brata ili sestru, mislim da je potrebno samo malo dobre volje i ljudskosti, umjesto tumačenja zakona - ljudski zbori Ana Marković koja je, usput rečeno, na Upravi za biomedicinu dobila skandalozan savjet.

 

- Od nadležne liječnice nikakvu pomoć nisam dobila. Odgovor na svako moje pitanje je bio da ‘Zakon to nije predvidio‘. Da ironija bude veća, zakon mi dozvoljava da odem u neku od susjednih zemalja i uzmem sjeme od nepoznatog donora, vratim se i rodim dijete u Srbiji, dok mi naš zakon zabranjuje da uzmem gotov embrij pokojnog muža i rodim naše dijete! Nevjerojatno!

 

U povjerenju mi je rekla da je možda rješenje da se odreknem zametaka i da ih poklonim u ‘Banku siročića‘ u EU, da potom nađem način da ih do tamo ispratim pa otkupim i nađem surogat majku da ih rodi. Pa to normalna osoba ne može razumjeti! Neka nepoznata žena u EU može uzeti i roditi moje zametke, ali ja kao majka u svojoj zemlji ne mogu, jer ‘zakon to nije predvidio‘ - šokirano pripovijeda srbijanska državljanka, udovica Ana Marković.

Na pitanja novinara Nova.rs o zakonskim procedurama prilikom vraćanja zametaka parovima, ali i ljudima koji su u međuvremenu ostali bez partnera, Ministarstvo zdravlja još nije odgovorilo.
