Jok, koliko vas je puta iživcirao onaj ili, rjeđe, ona u automobilu iza vas koji je 'legao' na trubu jer misli da niste dovoljno brzo krenuli na semaforu, ili vozite sporo za njegov pojam, premda se držite dozvoljenih 60 kilometara na sat na gradskoj cesti.
Začudili biste se da zakon nalaže kako u nekim trenucima baš morate koristiti zvučno upozorenje iz svog automobila, jer biste na taj način mogli spriječiti nesreću. Da, zatrubite kad je to potrebno da se svi vratite sretno svojim kućama.
Revija HAK donosi jednu sudsku priču koja potvrđuje sve rečeno iz uvoda.
Poruka je da je vozač dužan upotrijebiti zvučni znak upozorenja kad god to zahtijevaju razlozi sigurnosti prometa, a osobito ako se pokraj kolnika nalaze djeca koja ne obraćaju pažnju na kretanje vozila! Dužan!
Nije stvar u kazni, stvar je u tragičnim posljedicama do kojih može doći zbog tog propusta. Nije lako živjeti sa spoznajom da ste naletom vozila na neko dijete, lišili ga bezbrižnog djetinjstva, učinili invalidom ili mu zauvijek prekinuli snatrenje uzrokujući smrt na prometnici, navode u HAK-u.
Kako je i minimalna brzina dovoljna za tragičan kraj svjedoči predmet Vrhovnog suda Rev x 918/10-2. U njemu se odlučivalo o naknadi štete zbog smrti 11-godišnjeg dječaka koji se loptom igrao sa svojim prijateljem na prostoru neposredno uz kolnik kojim se odvijao mjesni promet.
Lopta mu je ispala iz ruke, zakoračio je na kolnik zanemarujući vozilo koje je u tom trenu bilo udaljeno od njega svega 5 metara, zbog čega ga je vozilo i zahvatilo.

Ponašanje dječaka bilo je krajnje neoprezno i s pozicije vozača nastanak nesreće bio je neizbježan. Vozač bez vozačkog ispita kretao se vozilom brzinom od 40 km/h, iako je dozvoljena brzina bila 50 km/h. Uočivši djecu uz kolnik smanjio je brzinu kretanja vozila na svega 20 km/h! Dječak je smrtno stradao pri brzini od doista minornih 20 km/h!
Minimalne brzine mogu usmrtiti, očito je! Imajte to na umu, minimalna brzina – tragična posljedica, unatoč i usprkos minimalnosti!
Sud je ipak utvrdio da je u postupanju vozača štetnog vozila bilo određenih propusta, kojih da nije bilo, moguća nesreća bila bi izbjegnuta. Kritične zgode vozač je smanjio brzinu na svega 20 km/h, ali je propustio upotrijebiti zvučni signal kako bi djecu upozorio na nailazeće vozilo, odnosno nedovoljno je obratio pažnju na njihovo ponašanje.
Zakon neosporno propisuje da je vozač dužan obratiti pažnju na pješake koji se nalaze na kolniku ili istupaju na kolnik s tim da je dužan upotrijebiti zvučni znak upozorenja kad god to zahtijevaju razlozi sigurnosti prometa, a osobito ako se pokraj kolnika nalaze djeca koja ne obraćaju pažnju na kretanje vozila.

Vrhovni sud u ovom predmetu, u konačnici utvrđuje kako je omjer suodgovornosti 70 posto na strani maloljetnog dječaka te 30 posto vozača, usprkos činjenici što se kretao zaista malom brzinom i što je kazneni postupak protiv vozača obustavljen.
Ovaj doista tragični slučaj uči nas kako se ne trebamo libiti upotrebe zvučnog signala, koji nekad doslovno život može značiti kao i da posve minimalne brzine kretanja vozila mogu posijati smrt, zaključuju u Reviji HAK-a.

Jok, koliko vas je puta iživcirao onaj ili, rjeđe, ona u automobilu iza vas koji je 'legao' na trubu jer misli da niste dovoljno brzo krenuli na semaforu, ili vozite sporo za njegov pojam, premda se držite dozvoljenih 60 kilometara na sat na gradskoj cesti.
Začudili biste se da zakon nalaže kako u nekim trenucima baš morate koristiti zvučno upozorenje iz svog automobila, jer biste na taj način mogli spriječiti nesreću. Da, zatrubite kad je to potrebno da se svi vratite sretno svojim kućama.
Revija HAK donosi jednu sudsku priču koja potvrđuje sve rečeno iz uvoda.
Poruka je da je vozač dužan upotrijebiti zvučni znak upozorenja kad god to zahtijevaju razlozi sigurnosti prometa, a osobito ako se pokraj kolnika nalaze djeca koja ne obraćaju pažnju na kretanje vozila! Dužan!
Nije stvar u kazni, stvar je u tragičnim posljedicama do kojih može doći zbog tog propusta. Nije lako živjeti sa spoznajom da ste naletom vozila na neko dijete, lišili ga bezbrižnog djetinjstva, učinili invalidom ili mu zauvijek prekinuli snatrenje uzrokujući smrt na prometnici, navode u HAK-u.
Kako je i minimalna brzina dovoljna za tragičan kraj svjedoči predmet Vrhovnog suda Rev x 918/10-2. U njemu se odlučivalo o naknadi štete zbog smrti 11-godišnjeg dječaka koji se loptom igrao sa svojim prijateljem na prostoru neposredno uz kolnik kojim se odvijao mjesni promet.
Lopta mu je ispala iz ruke, zakoračio je na kolnik zanemarujući vozilo koje je u tom trenu bilo udaljeno od njega svega 5 metara, zbog čega ga je vozilo i zahvatilo.

Ponašanje dječaka bilo je krajnje neoprezno i s pozicije vozača nastanak nesreće bio je neizbježan. Vozač bez vozačkog ispita kretao se vozilom brzinom od 40 km/h, iako je dozvoljena brzina bila 50 km/h. Uočivši djecu uz kolnik smanjio je brzinu kretanja vozila na svega 20 km/h! Dječak je smrtno stradao pri brzini od doista minornih 20 km/h!
Minimalne brzine mogu usmrtiti, očito je! Imajte to na umu, minimalna brzina – tragična posljedica, unatoč i usprkos minimalnosti!
Sud je ipak utvrdio da je u postupanju vozača štetnog vozila bilo određenih propusta, kojih da nije bilo, moguća nesreća bila bi izbjegnuta. Kritične zgode vozač je smanjio brzinu na svega 20 km/h, ali je propustio upotrijebiti zvučni signal kako bi djecu upozorio na nailazeće vozilo, odnosno nedovoljno je obratio pažnju na njihovo ponašanje.
Zakon neosporno propisuje da je vozač dužan obratiti pažnju na pješake koji se nalaze na kolniku ili istupaju na kolnik s tim da je dužan upotrijebiti zvučni znak upozorenja kad god to zahtijevaju razlozi sigurnosti prometa, a osobito ako se pokraj kolnika nalaze djeca koja ne obraćaju pažnju na kretanje vozila.

Vrhovni sud u ovom predmetu, u konačnici utvrđuje kako je omjer suodgovornosti 70 posto na strani maloljetnog dječaka te 30 posto vozača, usprkos činjenici što se kretao zaista malom brzinom i što je kazneni postupak protiv vozača obustavljen.
Ovaj doista tragični slučaj uči nas kako se ne trebamo libiti upotrebe zvučnog signala, koji nekad doslovno život može značiti kao i da posve minimalne brzine kretanja vozila mogu posijati smrt, zaključuju u Reviji HAK-a.
