Nedavna informacija objavljena na stranicama "crne kronike" o nepravomoćnoj presudi kojom je jedan Šibenčanin osuđen na uvjetnu zatvorsku kaznu zbog oštećenja lifta u dvije višestambene zgrade tek je jedan od primjera situacija s kojima se suočavaju suvlasnici stambenih objekta.
Šibenčaninu je Sud naložio i da s tri tisuće kuna mora obeštetiti suvlasnike zgrada, makar je on tvrdio da su se natpisi što ih je načinio mogli obrisati krpom. Po svemu sudeći nisu, budući da za pisanje nije koristio olovku ili flomaster nego - upaljač.
Optuženik je djela priznao, što i ne čudi zna li se da su u jednoj od zgrada njegovo "pisanje" snimile nadzorne kamere.
U komentarima što su uslijedili nakon objave presude u medijima, moglo se čuti i pitanje "zar se za to ide u zatvor?"
"Ide", glasio bi kratak odgovor neupućenima.
Naravno, kad se djelo dokaže, što znači da se od otkrivanja nastale štete na bilo kojem dijelu zgrade do pravomoćne presude provodi propisana procedura.
Videonadzor je bitan
- U slučaju oštećenja zajedničke imovine, u pravilu se preko predstavnika i upravitelja zgrade podnosi kaznena prijava protiv počinitelja zbog oštećenja ili uništenja tuđe stvari, što predstavlja kazneno djelo – obrazložio nam je Toni Šoljan, direktor sektora upravljanja zgradama u "Tehnoplastu", uz "Stano-upravu" vodećeg upravitelja zgrada na splitskom području.
- Osim toga, suvlasnici imaju i mogućnost pokretanja postupka za naknadu štete ako je počinitelj poznat.
Sve je više videonadzora u zgradama, pa je time olakšano pronalaženje počinitelja, pa i naplata počinjene štete. Ako se ne može utvrditi počinitelj, onda taj trošak snose suvlasnici iz sredstava pričuve – kazuje Šoljan.

Naš sugovornik navodi i situaciju kad je jedan suvlasnik u zgradi razbio ulazna vrata i staklo, udaljio se, ali su ga kamere snimile pa je dogovorno pristao platiti štetu.
Razbijena garažna vrata
Osim toga, bilo je primjera kada suvlasnik vozilom razbije rampu ili garažna vrata, s tim da je tu situacija nešto drukčija jer osiguranje od automobilske odgovornosti vlasnika vozila pokriva takve štete, pa se u takvim slučajevima uglavnom šteta naplati od osiguranja štetnika.
- Imali smo i situacije bijega s mjesta takve nezgode, ali je zahvaljujući videosnimkama poslana prijava MUP-u te je počinitelj pronađen po registarskoj oznaci vozila pa je u konačnici šteta i naplaćena, a počinitelj je dobio i kaznu zbog napuštanja mjesta nastanka štete.
Iz splitske "Stano-uprave", najvećeg upravitelja zgrada u Dalmaciji, navode da slučajevi vandalizma unutar lifta, poput primjera iz uvoda teksta, nisu česti, barem ne u zgradama pod njihovim upravljanjem, nego, dapače, vrlo rijetki.
Proširenje rizika u polici
Što se pokretanja postupka tiče kad se (ne)djelo otkrije, naglašavaju da “Sukladno pozitivnim propisima, protiv počinitelja, ukoliko je isti poznat, prijavu policiji podnosi osoba koja je očevidac protupravnog djela".
S obzirom na to da u slučajevima kad počinitelj nije otkriven suvlasnici snose trošak sanacije, iz "Tehnoplasta" i "Stano-uprave" podsjećaju na rješenje kojim bi se mogao barem smanjiti.
- Da bi ubuduće izbjegli troškove u ovakvim slučajevima, mogu zatražiti preko svog upravitelja proširenje rizika u polici osiguranja, za što bi im bila određena uvećana premija.

Što kaže Kazneni zakon
(Članak 235.)
(1) Tko ošteti, uništi, izobliči ili učini neuporabljivom tuđu stvar, kaznit će se kaznom zatvora do dvije godine.
(2) Kaznom iz stavka 1. ovoga članka kaznit će se onaj tko crtežima ili natpisima neovlašteno mijenja izgled zidova, motornih vozila ili drugih površina.
(3) Ako je počinitelj kazneno djelo iz stavka 1. ili 2. ovoga članka počinio iz niskih pobuda ili je njime prouzročio znatnu štetu, kaznit će se kaznom zatvora od šest mjeseci do pet godina.

Nedavna informacija objavljena na stranicama "crne kronike" o nepravomoćnoj presudi kojom je jedan Šibenčanin osuđen na uvjetnu zatvorsku kaznu zbog oštećenja lifta u dvije višestambene zgrade tek je jedan od primjera situacija s kojima se suočavaju suvlasnici stambenih objekta.
Šibenčaninu je Sud naložio i da s tri tisuće kuna mora obeštetiti suvlasnike zgrada, makar je on tvrdio da su se natpisi što ih je načinio mogli obrisati krpom. Po svemu sudeći nisu, budući da za pisanje nije koristio olovku ili flomaster nego - upaljač.
Optuženik je djela priznao, što i ne čudi zna li se da su u jednoj od zgrada njegovo "pisanje" snimile nadzorne kamere.
U komentarima što su uslijedili nakon objave presude u medijima, moglo se čuti i pitanje "zar se za to ide u zatvor?"
"Ide", glasio bi kratak odgovor neupućenima.
Naravno, kad se djelo dokaže, što znači da se od otkrivanja nastale štete na bilo kojem dijelu zgrade do pravomoćne presude provodi propisana procedura.
Videonadzor je bitan
- U slučaju oštećenja zajedničke imovine, u pravilu se preko predstavnika i upravitelja zgrade podnosi kaznena prijava protiv počinitelja zbog oštećenja ili uništenja tuđe stvari, što predstavlja kazneno djelo – obrazložio nam je Toni Šoljan, direktor sektora upravljanja zgradama u "Tehnoplastu", uz "Stano-upravu" vodećeg upravitelja zgrada na splitskom području.
- Osim toga, suvlasnici imaju i mogućnost pokretanja postupka za naknadu štete ako je počinitelj poznat.
Sve je više videonadzora u zgradama, pa je time olakšano pronalaženje počinitelja, pa i naplata počinjene štete. Ako se ne može utvrditi počinitelj, onda taj trošak snose suvlasnici iz sredstava pričuve – kazuje Šoljan.

Naš sugovornik navodi i situaciju kad je jedan suvlasnik u zgradi razbio ulazna vrata i staklo, udaljio se, ali su ga kamere snimile pa je dogovorno pristao platiti štetu.
Razbijena garažna vrata
Osim toga, bilo je primjera kada suvlasnik vozilom razbije rampu ili garažna vrata, s tim da je tu situacija nešto drukčija jer osiguranje od automobilske odgovornosti vlasnika vozila pokriva takve štete, pa se u takvim slučajevima uglavnom šteta naplati od osiguranja štetnika.
- Imali smo i situacije bijega s mjesta takve nezgode, ali je zahvaljujući videosnimkama poslana prijava MUP-u te je počinitelj pronađen po registarskoj oznaci vozila pa je u konačnici šteta i naplaćena, a počinitelj je dobio i kaznu zbog napuštanja mjesta nastanka štete.
Iz splitske "Stano-uprave", najvećeg upravitelja zgrada u Dalmaciji, navode da slučajevi vandalizma unutar lifta, poput primjera iz uvoda teksta, nisu česti, barem ne u zgradama pod njihovim upravljanjem, nego, dapače, vrlo rijetki.
Proširenje rizika u polici
Što se pokretanja postupka tiče kad se (ne)djelo otkrije, naglašavaju da “Sukladno pozitivnim propisima, protiv počinitelja, ukoliko je isti poznat, prijavu policiji podnosi osoba koja je očevidac protupravnog djela".
S obzirom na to da u slučajevima kad počinitelj nije otkriven suvlasnici snose trošak sanacije, iz "Tehnoplasta" i "Stano-uprave" podsjećaju na rješenje kojim bi se mogao barem smanjiti.
- Da bi ubuduće izbjegli troškove u ovakvim slučajevima, mogu zatražiti preko svog upravitelja proširenje rizika u polici osiguranja, za što bi im bila određena uvećana premija.

Što kaže Kazneni zakon
(Članak 235.)
(1) Tko ošteti, uništi, izobliči ili učini neuporabljivom tuđu stvar, kaznit će se kaznom zatvora do dvije godine.
(2) Kaznom iz stavka 1. ovoga članka kaznit će se onaj tko crtežima ili natpisima neovlašteno mijenja izgled zidova, motornih vozila ili drugih površina.
(3) Ako je počinitelj kazneno djelo iz stavka 1. ili 2. ovoga članka počinio iz niskih pobuda ili je njime prouzročio znatnu štetu, kaznit će se kaznom zatvora od šest mjeseci do pet godina.
