Čovjek bez registarskih oznaka može ostati po raznim osnovama. Bilo kako bilo, nemojte sami i na svoju ruku nikako rješavati stvari! Bitno da je vozilo registrirano i osigurano! Nikakav problem osim ako ne krenete u najboljoj namjeri sami privremeno popraviti stvar! Ako ste stava da nije zgodno voziti baš bez tablica, pa ćete vi dok se problem ne riješi malo improvizirati – onako sami u vlastitoj režiji, tek toliko da ne vozite okolo bez oznaka – stop!

Zaustavite tu misao odmah u začetku! Ako ste krenuli što kreirati udarite se po prstima, pričepite ruku. Sve je bolje od toga da vam se natovari na leđa počinjenje kaznenog djela! Sigurno ćete se zapitati odakle vjetar puše i odakle vam prijeti opasnost! Čak i nevješto rukom napisana registracija na komadu običnog papira ili na kartonu može vas učiniti počiniteljem kaznenog djela! Ne bilo kakvog, već počiniteljem kaznenog djela krivotvorenja isprave, piše HAK revija. 

Možda zvuči nevjerojatno, ali vaš ručni rad na komadu kartona, koji zapravo predstavlja stvarnu registarsku oznaku vašeg vozila, ako je „prikvačite“ na vozilo s nakanom da privremeno odglumi registarsku tablicu koju ste netom izgubili, uredno će biti kvalificirana kao kazneno djelo krivotvorenja isprave iz čl. 278. st. 1. Kaznenog zakona.

Kazneni zakon propisuje kako će se onaj: „tko izradi lažnu ispravu ili preinači pravu s ciljem da se takva isprava uporabi kao prava ili tko takvu ispravu nabavi radi uporabe ili je uporabi kao pravu, kazniti se kaznom zatvora do tri godine“. Nadalje propisuje kako će se onaj tko to kazneno djelo „počini glede javne isprave, oporuke, mjenice, čeka, platne kartice ili javne ili službene knjige koja se mora voditi na temelju zakona, kaznit će se kaznom zatvora od šest mjeseci do pet godina“.

Ovo je mišljenje drugostupanjskog suda!

„Pogrešno prvostupanjski sud pravno zaključuje da se na komadu kartona rukom napisana registracija vozila ne može okvalificirati kao kazneno djelo krivotvorenja isprave iz čl. 278. st. 1. KZ-a, jer izvješen komad kartona sadrži samo podatak o pripadajućem registarskom broju vozila, a ni oblikom, materijalom niti ostalim oznakama ne imitira valjanu registarsku pločicu. Naprotiv, ovako izrađena registarska oznaka, bez obzira što u potpunosti ne odgovara pravoj, predstavlja lažnu javnu ispravu, obzirom da je izrađena od strane okrivljenika, a ne od nadležne policijske uprave, koja je na temelju Zakona o sigurnosti prometa na cestama isključivo nadležna za njihovo izdavanje. Takvim postupanjem okrivljenik je ostvario sva potrebna bitna obilježja kaznenog djela krivotvorenja isprave iz čl. 278. st. 3. u vezi st. 1. KZ-a.

Radi se međutim o beznačajnom kaznenom djelu u smislu odredbe čl. 33. KZ-a, jer se registarska oznaka ispisana na kartonu doista i odnosila na konkretno vozilo, isto je bilo uredno registrirano, a time što je bilo samo kraće vrijeme u prometu nije došlo do nastupanja nikakvih štetnih posljedica, te nema potrebe za kažnjavanjem okrivljenika, koji nije osuđivan ili prekršajno kažnjavan, ozbiljan je, poslovan i obiteljski čovjek, u pedesetim godinama“.

Eto takav vam je stav Županijskog suda Bjelovar, u odluci Kž-194/2018 od 14. veljače 2019. Ujedno možete uočiti kako je ponekad dobro biti u pedesetim godinama ma kako se neki pribojavali ulaska u taj period. Sud ga uz ostale okolnosti smatra olakotnom, zaključuje HAK revija.

Čovjek bez registarskih oznaka može ostati po raznim osnovama. Bilo kako bilo, nemojte sami i na svoju ruku nikako rješavati stvari! Bitno da je vozilo registrirano i osigurano! Nikakav problem osim ako ne krenete u najboljoj namjeri sami privremeno popraviti stvar! Ako ste stava da nije zgodno voziti baš bez tablica, pa ćete vi dok se problem ne riješi malo improvizirati – onako sami u vlastitoj režiji, tek toliko da ne vozite okolo bez oznaka – stop!

Zaustavite tu misao odmah u začetku! Ako ste krenuli što kreirati udarite se po prstima, pričepite ruku. Sve je bolje od toga da vam se natovari na leđa počinjenje kaznenog djela! Sigurno ćete se zapitati odakle vjetar puše i odakle vam prijeti opasnost! Čak i nevješto rukom napisana registracija na komadu običnog papira ili na kartonu može vas učiniti počiniteljem kaznenog djela! Ne bilo kakvog, već počiniteljem kaznenog djela krivotvorenja isprave, piše HAK revija. 

Možda zvuči nevjerojatno, ali vaš ručni rad na komadu kartona, koji zapravo predstavlja stvarnu registarsku oznaku vašeg vozila, ako je „prikvačite“ na vozilo s nakanom da privremeno odglumi registarsku tablicu koju ste netom izgubili, uredno će biti kvalificirana kao kazneno djelo krivotvorenja isprave iz čl. 278. st. 1. Kaznenog zakona.

Kazneni zakon propisuje kako će se onaj: „tko izradi lažnu ispravu ili preinači pravu s ciljem da se takva isprava uporabi kao prava ili tko takvu ispravu nabavi radi uporabe ili je uporabi kao pravu, kazniti se kaznom zatvora do tri godine“. Nadalje propisuje kako će se onaj tko to kazneno djelo „počini glede javne isprave, oporuke, mjenice, čeka, platne kartice ili javne ili službene knjige koja se mora voditi na temelju zakona, kaznit će se kaznom zatvora od šest mjeseci do pet godina“.

Ovo je mišljenje drugostupanjskog suda!

„Pogrešno prvostupanjski sud pravno zaključuje da se na komadu kartona rukom napisana registracija vozila ne može okvalificirati kao kazneno djelo krivotvorenja isprave iz čl. 278. st. 1. KZ-a, jer izvješen komad kartona sadrži samo podatak o pripadajućem registarskom broju vozila, a ni oblikom, materijalom niti ostalim oznakama ne imitira valjanu registarsku pločicu. Naprotiv, ovako izrađena registarska oznaka, bez obzira što u potpunosti ne odgovara pravoj, predstavlja lažnu javnu ispravu, obzirom da je izrađena od strane okrivljenika, a ne od nadležne policijske uprave, koja je na temelju Zakona o sigurnosti prometa na cestama isključivo nadležna za njihovo izdavanje. Takvim postupanjem okrivljenik je ostvario sva potrebna bitna obilježja kaznenog djela krivotvorenja isprave iz čl. 278. st. 3. u vezi st. 1. KZ-a.

Radi se međutim o beznačajnom kaznenom djelu u smislu odredbe čl. 33. KZ-a, jer se registarska oznaka ispisana na kartonu doista i odnosila na konkretno vozilo, isto je bilo uredno registrirano, a time što je bilo samo kraće vrijeme u prometu nije došlo do nastupanja nikakvih štetnih posljedica, te nema potrebe za kažnjavanjem okrivljenika, koji nije osuđivan ili prekršajno kažnjavan, ozbiljan je, poslovan i obiteljski čovjek, u pedesetim godinama“.

Eto takav vam je stav Županijskog suda Bjelovar, u odluci Kž-194/2018 od 14. veljače 2019. Ujedno možete uočiti kako je ponekad dobro biti u pedesetim godinama ma kako se neki pribojavali ulaska u taj period. Sud ga uz ostale okolnosti smatra olakotnom, zaključuje HAK revija.

Čovjek bez registarskih oznaka može ostati po raznim osnovama. Bilo kako bilo, nemojte sami i na svoju ruku nikako rješavati stvari! Bitno da je vozilo registrirano i osigurano! Nikakav problem osim ako ne krenete u najboljoj namjeri sami privremeno popraviti stvar! Ako ste stava da nije zgodno voziti baš bez tablica, pa ćete vi dok se problem ne riješi malo improvizirati – onako sami u vlastitoj režiji, tek toliko da ne vozite okolo bez oznaka – stop!

Zaustavite tu misao odmah u začetku! Ako ste krenuli što kreirati udarite se po prstima, pričepite ruku. Sve je bolje od toga da vam se natovari na leđa počinjenje kaznenog djela!
