Točno 14 godina od tragičnog poroda, u kojemu je zbog liječničke pogreške prekasno izveden carski rez, Općinski sud u Zadru donio je presudu po kojoj zadarska bolnica mora isplatiti 1,5 milijuna kuna odštete obitelji i dječaku koji je najveća žrtva nemara tog događaja iz travnja 2007. godine.

Po presudi koja je još uvijek nepravomoćna, bolnica će morati platiti kamatu od 2007. godine do danas, troškove postupka od 306.875 kuna, a stradalom dječaku do daljnjega isplaćivati mjesečnu rentu u iznosu od 4.800 kuna.

Dječak je rođen u travnju 2007. godine, malo prije ponoći, carskim rezom. Do tog trenutka majka je imala je uredan tijek trudnoće te je u 39. tjednu upućena na Odjel ginekologije radi nadzora zbog promjena u CTG zapisu. Na Odjelu je u CTG zapisu od 16,50 sati bio vidljiv pad otkucaja srca djeteta uz lošu cirkulaciju, u 19,45 sati daleko jači pad otkucaja srca djeteta, a posebice od 21,25 sati nadalje.

“Dežurni ginekolozi, međutim, nisu uočili problem ili su uočili, ali nisu poduzeli niti jednu medicinsku radnju sukladnu pravilima medicinske struke, koja bi omogućila da kod novorođenčeta ne nastupi hipoksija, nego su se odlučili na hitan carski rez tek u 23:45 sati.

Dijete je tada rođeno, nakon 7 sati gušenja u majčinoj utrobi, što je dovelo do teškog i trajnog pogoršanja zdravstvenog stanja. Tijekom porođaja nastupile su teške hipoksijsko-ishemijske promjene i edem mozga, zbog čega je dječak nakon poroda reanimiran, što je dovelo do trajnih posljedica na njegovo zdravlje - stoji u presudi.

Tijekom postupka, vještak s Medicinskog fakulteta u Zagrebu ocijenio je da je odluka o provođenju carskog reza donesena prekasno, uslijed čega je došlo do stanja fetalne patnje, odnosno “razvoja asfiksije zbog zatezanja pupkovine oko vrata te opsežnog oštećenja mozga čije su posljedice trajno prisutne i nepopravljive”.

U bolnici su se branili kako su bili poduzeti svi standardni medicinski postupci kod prijema trudnice, nalaz je bio uredan s manjim odstupanjima koji se, prema njihovom viđenju, ne mogu tretirati kao ozbiljne poteškoće. Sve je upućivalo na to da će se žena uspješno poroditi prirodnim putem, ali je nakon neuspješnog pokušaja organiziran hitan carski rez.

Neželjeni ishod, prema bolnici, nastao je kao posljedica akutne hipoksije i kompresije pupkovine, a ne kao posljedica kronične hipoksije koja je trajala satima. Međutim, iz nalaza i mišljenja vještaka Medicinskog fakulteta u Zagrebu proizlazi da je odluka o provođenju carskog reza donesena prekasno.

Prva vještakinja je na sudu iskazala da je porod učinjen po pravilima struke, ali je na dodatnom ročištu ponovno saslušana te je potvrdila da najvjerojatnije dijete ne bi bilo u ovakvom stanju da je porod učinjen odmah kod prijema.

Zbog njezinih kontradiktornih izjava angažiran je novi vještak s Medicinskog fakulteta u Zagrebu, koji je rekao da je odluka o provođenju carskog reza donesena prekasno, “uslijed čega je došlo do stanja fetalne patnje, odnosno razvoja asfiksije zbog zatezanja pupkovine oko vrata te opsežnog oštećenja mozga čije su posljedice trajno prisutne i nepopravljive”.

Točno 14 godina od tragičnog poroda, u kojemu je zbog liječničke pogreške prekasno izveden carski rez, Općinski sud u Zadru donio je presudu po kojoj zadarska bolnica mora isplatiti 1,5 milijuna kuna odštete obitelji i dječaku koji je najveća žrtva nemara tog događaja iz travnja 2007. godine.

Po presudi koja je još uvijek nepravomoćna, bolnica će morati platiti kamatu od 2007. godine do danas, troškove postupka od 306.875 kuna, a stradalom dječaku do daljnjega isplaćivati mjesečnu rentu u iznosu od 4.800 kuna.

Dječak je rođen u travnju 2007. godine, malo prije ponoći, carskim rezom. Do tog trenutka majka je imala je uredan tijek trudnoće te je u 39. tjednu upućena na Odjel ginekologije radi nadzora zbog promjena u CTG zapisu. Na Odjelu je u CTG zapisu od 16,50 sati bio vidljiv pad otkucaja srca djeteta uz lošu cirkulaciju, u 19,45 sati daleko jači pad otkucaja srca djeteta, a posebice od 21,25 sati nadalje.

“Dežurni ginekolozi, međutim, nisu uočili problem ili su uočili, ali nisu poduzeli niti jednu medicinsku radnju sukladnu pravilima medicinske struke, koja bi omogućila da kod novorođenčeta ne nastupi hipoksija, nego su se odlučili na hitan carski rez tek u 23:45 sati.

Dijete je tada rođeno, nakon 7 sati gušenja u majčinoj utrobi, što je dovelo do teškog i trajnog pogoršanja zdravstvenog stanja. Tijekom porođaja nastupile su teške hipoksijsko-ishemijske promjene i edem mozga, zbog čega je dječak nakon poroda reanimiran, što je dovelo do trajnih posljedica na njegovo zdravlje - stoji u presudi.

Tijekom postupka, vještak s Medicinskog fakulteta u Zagrebu ocijenio je da je odluka o provođenju carskog reza donesena prekasno, uslijed čega je došlo do stanja fetalne patnje, odnosno “razvoja asfiksije zbog zatezanja pupkovine oko vrata te opsežnog oštećenja mozga čije su posljedice trajno prisutne i nepopravljive”.

U bolnici su se branili kako su bili poduzeti svi standardni medicinski postupci kod prijema trudnice, nalaz je bio uredan s manjim odstupanjima koji se, prema njihovom viđenju, ne mogu tretirati kao ozbiljne poteškoće. Sve je upućivalo na to da će se žena uspješno poroditi prirodnim putem, ali je nakon neuspješnog pokušaja organiziran hitan carski rez.

Neželjeni ishod, prema bolnici, nastao je kao posljedica akutne hipoksije i kompresije pupkovine, a ne kao posljedica kronične hipoksije koja je trajala satima. Međutim, iz nalaza i mišljenja vještaka Medicinskog fakulteta u Zagrebu proizlazi da je odluka o provođenju carskog reza donesena prekasno.

Prva vještakinja je na sudu iskazala da je porod učinjen po pravilima struke, ali je na dodatnom ročištu ponovno saslušana te je potvrdila da najvjerojatnije dijete ne bi bilo u ovakvom stanju da je porod učinjen odmah kod prijema.

Zbog njezinih kontradiktornih izjava angažiran je novi vještak s Medicinskog fakulteta u Zagrebu, koji je rekao da je odluka o provođenju carskog reza donesena prekasno, “uslijed čega je došlo do stanja fetalne patnje, odnosno razvoja asfiksije zbog zatezanja pupkovine oko vrata te opsežnog oštećenja mozga čije su posljedice trajno prisutne i nepopravljive”.

Točno 14 godina od tragičnog poroda, u kojemu je zbog liječničke pogreške prekasno izveden carski rez, Općinski sud u Zadru donio je presudu po kojoj zadarska bolnica mora isplatiti 1,5 milijuna kuna odštete obitelji i dječaku koji je najveća žrtva nemara tog događaja iz travnja 2007. godine.
