Zadarske benediktinke izgubile su pravo vlasništva nad stubiištem ispred svojeg samostana i crkve Sv. Marije na Trgu Opatice Čike u srcu grada u sudskom sporu kojeg je protiv njih prije osam godina pokrenuo Grad.

Iako su "skaline" koje povezuju Trg opatice Čike s ulicama Šimuna Kožičića Benje i Madijavaca, tik uz Forum i crkvu sv. Donata, u zemljišnim knjigama bile upisane na koludrice, u novom sudskom postupku utvrđeno je da su ipak u vlasništvu lokalne uprave.

Presudom Ane Markač, sutkinje Trgovačkog suda u Zadru, utvrđeno je da je Grad pravo na stubište stekao – građenjem, što su benediktinke nakon pravomoćnosti presude dužne priznati uz brisanje vlasništva sa svojeg imena. Gradski oci su još 2014. podignuli vlasničku tužbu protiv redovnica zbog utvrđenja prava vlasništva nad zonom koja su nezaobilazni turistički motiv Zadra.

Trgovački sud je 2015. donio presudu u korist benediktinki, što je tri godine kasnije potvrdio i Visoki trgovački sud. Grad je zatim tražio reviziju zbog pogrešne primjene materijalnog prava, što je 2020. prihvatio Vrhovni sud i predmet vratio prvostupanjskom sudu na ponovni postupak.

Vrhovni sud je, među ostalim, tražio da se u novom postupku utvrdi kada je izvršena deposedacija Grada iz sporne nekretnine, te jesu li redovnice na bilo kojih način štitile svoje pravo. Trebalo se i pojasniti pravni status stubišta, odnosno je li riječ o nekretnini koja je javno dobro u općoj uporabi, nerazvrstana prometnica ili neka druga površina javne namjene.

Posebno je bilo potrebno utvrditi jesu li sporne "skaline" građevinski objekt u skladu s propisima koji su vrijedili u vrijeme njihove izgradnje, je li sporna nekretnina nacionalizirana, kao i je li izgradnjom nositelj prava korištenja izgubio bilo kakva prava na spornoj nekretnini, s učincima kao da je proveden postupka izvlaštenja.

Grad je u sporu navodio kako su benediktinke bile pogrešno upisane na stubište koje je od 1945. javna površina, odnosno zona koju je izgradio pravni prednik današnje vlasti, a koriste je svi građani. Naveli su i kako benediktinke nikada nisu tražile posjedovnu niti vlasničku zaštitu, jer za to nisu imale nikakvog pravnog temelja, te da Grad održava cjelokupnu javnu površinu i to na način da renovira i popravlja ploče.

Benediktinke su u postupku navele kako povjesnica tužbe grada Zadar vrvi netočnostima, među kojima je i ta da da stubište postoji od 1945. godine. Tvrde kako je točno da su "sklaine" izgrađene neposredno prije otvaranja muzeja Stalne izložbe crkvene umjetnosti 70-ih godina prošlog stoljeća koji se nalazi u samostanskom krugu.

Pojasnile su kako je cjelokupan postupak pregovaranja i pripremanja izgradnje Stalne izložbe crkvene umjetnosti i Arheološkog muzeja bio pisano dokumentiran. Nisu tražile posjedovnu niti vlasničku zaštitu jer su očito smatrale da se ništa niti ne gradi, budući je tu ranije bila izgrađena zgrada u njihovu vlasništvu.

Smatrale su da se samo uređuje prostor ispred crkve i Muzeja u svrhu dostojanstvenog svečanog otvaranja, te da slijedom toga tadašnja Skupština općine Zadar nije mogla niti biti pošten graditelj jer je znala da nema pravo graditi na čestici "Zadar-stari".

Navele su kako nikada nisu bile deposedirane, već suprotno, što je poznato i Gradu, jer je Grad sa svojim prednikom precizno i u pisanom obliku i kroz tada propisanu proceduru uređivao svoje odnose, a sam prednik tuženika da se pisano obvezao da će urediti građevinsku parcelu sukladno tada važećim propisima.

Sud je, međutim prihvatio građevinsko vještačenje Tomislava Jurline koji je u postupku utvrdio da sporna nekretnina predstavlja javne stube, tj. javnu površinu koja je namijenjena za kretanje većeg broja ljudi i koja povezuju Trg opatice Čike s ulicama Šimuna Kožičića Benje i Madijavaca. Zaključio je da se radi o javnom dobru u općoj uporabi, a kojim upravlja i koju održava upravo Grad.

O tome je iskazivao i svjedok Ivan Vidić, zaposlenik "Čistoće", navodeći kako djelatnici te gradske tvrtke održavaju sve javne površine na Poluotoku, pa među ostalim i stubište i plato ispred crkve sv. Marije. Rekao je kako troškove održavanja i čišćenja snosi upravo Grad, kao i da nikada nije bio zaprimljen prigovor od strane benediktinki da se taj prostor ne čisti.

Osim brisanja vlasništva, presudom Trgovačkog suda, Benediktinke u roku od osam dana moraju nadoknaditi i trošak sudskog postupka u iznosu od 65.371 kunu. Sud je, međutim, odbio gradu platiti dodatnih 2000 kuna troškova za građevinsko vještačenje, jer je za to vještačenje najprije zatražen iznos od 3000 kuna, a nakon postupka 5000.

Zadarske benediktinke izgubile su pravo vlasništva nad stubiištem ispred svojeg samostana i crkve Sv. Marije na Trgu Opatice Čike u srcu grada u sudskom sporu kojeg je protiv njih prije osam godina pokrenuo Grad.

Iako su "skaline" koje povezuju Trg opatice Čike s ulicama Šimuna Kožičića Benje i Madijavaca, tik uz Forum i crkvu sv. Donata, u zemljišnim knjigama bile upisane na koludrice, u novom sudskom postupku utvrđeno je da su ipak u vlasništvu lokalne uprave.

Presudom Ane Markač, sutkinje Trgovačkog suda u Zadru, utvrđeno je da je Grad pravo na stubište stekao – građenjem, što su benediktinke nakon pravomoćnosti presude dužne priznati uz brisanje vlasništva sa svojeg imena. Gradski oci su još 2014. podignuli vlasničku tužbu protiv redovnica zbog utvrđenja prava vlasništva nad zonom koja su nezaobilazni turistički motiv Zadra.

Trgovački sud je 2015. donio presudu u korist benediktinki, što je tri godine kasnije potvrdio i Visoki trgovački sud. Grad je zatim tražio reviziju zbog pogrešne primjene materijalnog prava, što je 2020. prihvatio Vrhovni sud i predmet vratio prvostupanjskom sudu na ponovni postupak.

Vrhovni sud je, među ostalim, tražio da se u novom postupku utvrdi kada je izvršena deposedacija Grada iz sporne nekretnine, te jesu li redovnice na bilo kojih način štitile svoje pravo. Trebalo se i pojasniti pravni status stubišta, odnosno je li riječ o nekretnini koja je javno dobro u općoj uporabi, nerazvrstana prometnica ili neka druga površina javne namjene.

Posebno je bilo potrebno utvrditi jesu li sporne "skaline" građevinski objekt u skladu s propisima koji su vrijedili u vrijeme njihove izgradnje, je li sporna nekretnina nacionalizirana, kao i je li izgradnjom nositelj prava korištenja izgubio bilo kakva prava na spornoj nekretnini, s učincima kao da je proveden postupka izvlaštenja.

Grad je u sporu navodio kako su benediktinke bile pogrešno upisane na stubište koje je od 1945. javna površina, odnosno zona koju je izgradio pravni prednik današnje vlasti, a koriste je svi građani. Naveli su i kako benediktinke nikada nisu tražile posjedovnu niti vlasničku zaštitu, jer za to nisu imale nikakvog pravnog temelja, te da Grad održava cjelokupnu javnu površinu i to na način da renovira i popravlja ploče.

Benediktinke su u postupku navele kako povjesnica tužbe grada Zadar vrvi netočnostima, među kojima je i ta da da stubište postoji od 1945. godine. Tvrde kako je točno da su "sklaine" izgrađene neposredno prije otvaranja muzeja Stalne izložbe crkvene umjetnosti 70-ih godina prošlog stoljeća koji se nalazi u samostanskom krugu.

Pojasnile su kako je cjelokupan postupak pregovaranja i pripremanja izgradnje Stalne izložbe crkvene umjetnosti i Arheološkog muzeja bio pisano dokumentiran. Nisu tražile posjedovnu niti vlasničku zaštitu jer su očito smatrale da se ništa niti ne gradi, budući je tu ranije bila izgrađena zgrada u njihovu vlasništvu.

Smatrale su da se samo uređuje prostor ispred crkve i Muzeja u svrhu dostojanstvenog svečanog otvaranja, te da slijedom toga tadašnja Skupština općine Zadar nije mogla niti biti pošten graditelj jer je znala da nema pravo graditi na čestici "Zadar-stari".

Navele su kako nikada nisu bile deposedirane, već suprotno, što je poznato i Gradu, jer je Grad sa svojim prednikom precizno i u pisanom obliku i kroz tada propisanu proceduru uređivao svoje odnose, a sam prednik tuženika da se pisano obvezao da će urediti građevinsku parcelu sukladno tada važećim propisima.

Sud je, međutim prihvatio građevinsko vještačenje Tomislava Jurline koji je u postupku utvrdio da sporna nekretnina predstavlja javne stube, tj. javnu površinu koja je namijenjena za kretanje većeg broja ljudi i koja povezuju Trg opatice Čike s ulicama Šimuna Kožičića Benje i Madijavaca. Zaključio je da se radi o javnom dobru u općoj uporabi, a kojim upravlja i koju održava upravo Grad.

O tome je iskazivao i svjedok Ivan Vidić, zaposlenik "Čistoće", navodeći kako djelatnici te gradske tvrtke održavaju sve javne površine na Poluotoku, pa među ostalim i stubište i plato ispred crkve sv. Marije. Rekao je kako troškove održavanja i čišćenja snosi upravo Grad, kao i da nikada nije bio zaprimljen prigovor od strane benediktinki da se taj prostor ne čisti.

Osim brisanja vlasništva, presudom Trgovačkog suda, Benediktinke u roku od osam dana moraju nadoknaditi i trošak sudskog postupka u iznosu od 65.371 kunu. Sud je, međutim, odbio gradu platiti dodatnih 2000 kuna troškova za građevinsko vještačenje, jer je za to vještačenje najprije zatražen iznos od 3000 kuna, a nakon postupka 5000.
