Vrhovni sud potvrdio je odluku o uvjetnom otpustu iz zatvora ratnog pomoćnika ministra unutarnjih poslova Tomislava Merčepa koji je zbog zločina nad srpskim civilima u slučaju Pakračka Poljana pravomoćno osuđen na sedam godina zatvora.

Datum Merčepova uvjetnog izlaska odredit će sudac istrage u roku od tri dana od zaprimanja rješenja Vrhovnog suda, a Merčep iz zatvora mora biti otpušten najkasnije tri dana od donošenja naloga suca izvršenja, izvijestio je Vrhovni sud.

Merčep će se nakon izlaska iz zatvora morati redovito javljati nadležnoj policijskoj postaji. Prvo javljanje mora biti u roku dva dana od dana otpuštanja na uvjetni otpust, a dalje jednom mjesečno do isteka uvjetnog otpusta.

Osim toga, dužan je javiti se i Probacijskom uredu dva dana od otpuštanja na uvjetni otpust i dalje prema pojedinačnom programu postupanja koji će izraditi Probacijski ured.

Merčep pritom može promijeniti mjesto prebivališta, odnosno boravišta, samo uz suglasnost suca izvršenja Županijskog suda u Zagrebu.

Vrhovni sud je priopćio kako smatra da su ispunjene zakonske pretpostavke za primjenu uvjetnog otpusta. Navode da je od kolovoza 2019. kada mu je pravomoćno odbijen prethodni prijedlog za uvjetni otpust nastupila nova okolnost, odnosno da mu je znatno pogoršano zdravstveno stanje, teško je pokretan i potrebna mu je stalna njega i pomoć.

"Prije nije kazneno osuđivan, drugi se postupak ne vodi, a zatvorenik se potpuno pridržava kućnog reda kaznionice. Sudjelovao je i u provođenju pojedinačnog programa izvršavanja kazne zatvora. Zatvorenik je do sada izdržao tri četvrtine izrečene mu kazne", navode u priopćenju.

Vrhovni sud je zaključio i da je kod zatvorenika "dosadašnjim izdržavanjem ove kazne zatvora u cijelosti ostvarena svrha kažnjavanja" te da je za očekivati da na slobodi neće činiti nova kaznena djela.

Merčep je u svibnju 2016. osuđen na pet i pol godina zatvora jer kao zapovjednik postrojbe poznate kao "merčepovci" nije spriječio zločine nad srpskim civilima, a Vrhovni sud mu je u veljači 2017. kaznu povisio na sedam godina.

Od početka je tvrdio da je nevin, a poricao je i da je zapovijedao postrojbom koja se nazivala njegovim imenom. Tužiteljstvo ga je isprva teretilo da je zapovijedao zločine, no optužnica je potom ublažena pa je osuđen jer svoje podređene u zločinima nije spriječio.

Vrhovni sud potvrdio je odluku o uvjetnom otpustu iz zatvora ratnog pomoćnika ministra unutarnjih poslova Tomislava Merčepa koji je zbog zločina nad srpskim civilima u slučaju Pakračka Poljana pravomoćno osuđen na sedam godina zatvora.

Datum Merčepova uvjetnog izlaska odredit će sudac istrage u roku od tri dana od zaprimanja rješenja Vrhovnog suda, a Merčep iz zatvora mora biti otpušten najkasnije tri dana od donošenja naloga suca izvršenja, izvijestio je Vrhovni sud.

Merčep će se nakon izlaska iz zatvora morati redovito javljati nadležnoj policijskoj postaji. Prvo javljanje mora biti u roku dva dana od dana otpuštanja na uvjetni otpust, a dalje jednom mjesečno do isteka uvjetnog otpusta.

Osim toga, dužan je javiti se i Probacijskom uredu dva dana od otpuštanja na uvjetni otpust i dalje prema pojedinačnom programu postupanja koji će izraditi Probacijski ured.

Merčep pritom može promijeniti mjesto prebivališta, odnosno boravišta, samo uz suglasnost suca izvršenja Županijskog suda u Zagrebu.

Vrhovni sud je priopćio kako smatra da su ispunjene zakonske pretpostavke za primjenu uvjetnog otpusta. Navode da je od kolovoza 2019. kada mu je pravomoćno odbijen prethodni prijedlog za uvjetni otpust nastupila nova okolnost, odnosno da mu je znatno pogoršano zdravstveno stanje, teško je pokretan i potrebna mu je stalna njega i pomoć.

"Prije nije kazneno osuđivan, drugi se postupak ne vodi, a zatvorenik se potpuno pridržava kućnog reda kaznionice. Sudjelovao je i u provođenju pojedinačnog programa izvršavanja kazne zatvora. Zatvorenik je do sada izdržao tri četvrtine izrečene mu kazne", navode u priopćenju.

Vrhovni sud je zaključio i da je kod zatvorenika "dosadašnjim izdržavanjem ove kazne zatvora u cijelosti ostvarena svrha kažnjavanja" te da je za očekivati da na slobodi neće činiti nova kaznena djela.

Merčep je u svibnju 2016. osuđen na pet i pol godina zatvora jer kao zapovjednik postrojbe poznate kao "merčepovci" nije spriječio zločine nad srpskim civilima, a Vrhovni sud mu je u veljači 2017. kaznu povisio na sedam godina.

Od početka je tvrdio da je nevin, a poricao je i da je zapovijedao postrojbom koja se nazivala njegovim imenom. Tužiteljstvo ga je isprva teretilo da je zapovijedao zločine, no optužnica je potom ublažena pa je osuđen jer svoje podređene u zločinima nije spriječio.

Vrhovni sud potvrdio je odluku o uvjetnom otpustu iz zatvora ratnog pomoćnika ministra unutarnjih poslova Tomislava Merčepa koji je zbog zločina nad srpskim civilima u slučaju Pakračka Poljana pravomoćno osuđen na sedam godina zatvora.

Datum Merčepova uvjetnog izlaska odredit će sudac istrage u roku od tri dana od zaprimanja rješenja Vrhovnog suda, a Merčep iz zatvora mora biti otpušten najkasnije tri dana od donošenja naloga suca izvršenja, izvijestio je Vrhovni sud.

Merčep će se nakon izlaska iz zatvora morati redovito javljati nadležnoj policijskoj postaji. Prvo javljanje mora biti u roku dva dana od dana otpuštanja na uvjetni otpust, a dalje jednom mjesečno do isteka uvjetnog otpusta.
