Splitski građevinski poduzetnik Zvonko Kotarac oslobođen je na Općinskom sudu u Splitu optužbe za nevođenje poslovnih knjiga, odnosno kazneno djelo povrede obveze vođenja trgovačkih i poslovnih knjiga, dok je optužba za utaju poreza odbačena zbog zastare.

Naime, Kotarca se teretilo da je u razdoblju od 27. svibnja 2003. godine do 31. prosinca iste godine kao direktor tvrtke “Brodarica” d.o.o. propustio otvoriti i voditi poslovne knjige ulaznih i izdanih računa za tu godinu. Na prvom je suđenju za to djelo bio osuđen četiri mjeseca uvjetno na jednu godinu, no Županijski je sud uvažio njegovu žalbu i vratio sve na ponovno suđenje sutkinji Marisi Matić.

Prema njihovu naputku u kojem stoji da se Kotarac opravdano žalio kad je tvrdio da “predmetno kazneno djelo čini osoba koja je po zakonu i unutrašnjem ustrojstvu radnih mjesta u pravnoj osobi dužna voditi poslovne knjige, a ne isključivo odgovorna osoba u pravnoj osobi” te izjavama svjedoka Ante Šošića, koji je bio voditelj financijske službe “Dalkoninga”, a koji je potvrdio da je baš Kotarac dao nalog da se za “Brodaricu” ustroje poslovne knjige, sutkinja nije mogla drukčije presuditi.

Što se tiče utaje poreza, Kotarca se sumnjičilo da nije u zakonskom roku prikazao aneks kupoprodajnog ugovora od 13. ožujka 1997. godine s prodavateljima dvije tisuće kvadrata zemlje, čime je utajio više od 67 tisuća kuna poreza. Također ga se teretilo da nije iskazao dohodak ostvaren prodajom nekretnine koju je kupio od Centra Bonačić “Mediteran” d.o.o. te da je tako utajio više od 323 tisuće kuna.

Kako je Porezna uprava kaznenu prijavu Općinskom državnom odvjetništvu podnijela samo mjesec dana prije nastupa zastare za to djelo, a iako su oni učinili što su mogli, taj je dio optužbe ipak odbačen zbog zastare. Kotarac je na izricanju presude naglasio kako je porezna inspektorica koja je svjedočila protiv njega ista ona koja je u četiri godine prije podnošenja kaznene prijave izdala šest rješenja protiv njega, a koja su sva ukinuta u drugom stupnju.

Splitski građevinski poduzetnik Zvonko Kotarac oslobođen je na Općinskom sudu u Splitu optužbe za nevođenje poslovnih knjiga, odnosno kazneno djelo povrede obveze vođenja trgovačkih i poslovnih knjiga, dok je optužba za utaju poreza odbačena zbog zastare.

Naime, Kotarca se teretilo da je u razdoblju od 27. svibnja 2003. godine do 31. prosinca iste godine kao direktor tvrtke “Brodarica” d.o.o. propustio otvoriti i voditi poslovne knjige ulaznih i izdanih računa za tu godinu. Na prvom je suđenju za to djelo bio osuđen četiri mjeseca uvjetno na jednu godinu, no Županijski je sud uvažio njegovu žalbu i vratio sve na ponovno suđenje sutkinji Marisi Matić.

Prema njihovu naputku u kojem stoji da se Kotarac opravdano žalio kad je tvrdio da “predmetno kazneno djelo čini osoba koja je po zakonu i unutrašnjem ustrojstvu radnih mjesta u pravnoj osobi dužna voditi poslovne knjige, a ne isključivo odgovorna osoba u pravnoj osobi” te izjavama svjedoka Ante Šošića, koji je bio voditelj financijske službe “Dalkoninga”, a koji je potvrdio da je baš Kotarac dao nalog da se za “Brodaricu” ustroje poslovne knjige, sutkinja nije mogla drukčije presuditi.

Što se tiče utaje poreza, Kotarca se sumnjičilo da nije u zakonskom roku prikazao aneks kupoprodajnog ugovora od 13. ožujka 1997. godine s prodavateljima dvije tisuće kvadrata zemlje, čime je utajio više od 67 tisuća kuna poreza. Također ga se teretilo da nije iskazao dohodak ostvaren prodajom nekretnine koju je kupio od Centra Bonačić “Mediteran” d.o.o. te da je tako utajio više od 323 tisuće kuna.

Kako je Porezna uprava kaznenu prijavu Općinskom državnom odvjetništvu podnijela samo mjesec dana prije nastupa zastare za to djelo, a iako su oni učinili što su mogli, taj je dio optužbe ipak odbačen zbog zastare. Kotarac je na izricanju presude naglasio kako je porezna inspektorica koja je svjedočila protiv njega ista ona koja je u četiri godine prije podnošenja kaznene prijave izdala šest rješenja protiv njega, a koja su sva ukinuta u drugom stupnju.
