stdClass Object ( [id] => 256664 [title] => Ustavni sud odobrio Janši privremeno puštanje na slobodu [alias] => ustavni-sud-odobrio-jansi-privremeno-pustanje-na-slobodu [catid] => 241 [published] => 1 [introtext] => [fulltext] => Slovenski ustavni sud u petak je čelniku vodeće oporbene stranke i bivšem premijeru Janezu Janši odobrio puštanje na slobodu do konačnog rješenja njegove ustavne žalbe kojom je tražio poništenje presude kojom je pravomoćno osuđen na dvije godine zatvora zbog korupcijske afere Patria.

Svih devet ustavnih sudaca glasovalo je za to da se Janšina presuda privremeno suspendira i da bude na slobodi sve do konačnog pravorijeka pa je on u petak pušten iz zatvora Dob u kojemu se nalazio od 20. lipnja.

U obrazloženju svoje odluke ustavni sud je naveo da je izdržavanje kazne Janši obustavio temeljem 58. članka zakona o ustavnom sudu. Njime se predviđa da je za suspendiranje kazne dovoljan razlog ako bi u suprotnome mogle nastati posljedice koje bi teško bilo popraviti, što bi se dogodilo u slučaju da i konačni pravorijek ustavnog suda za Janšu bude pozitivan.

Prihvate li u konačnici ustavni suci Janšinu ustavnu žalbu da mu krivnja za mito u korupcijskoj aferi Patria nije bila dokazana i da su bila kršena njegova prava, on će ostati na slobodi, a u suprotnome će se morati vratiti na izdržavanje kazne.

Janšina stranka i "Odbor 2014", koji se od Janšina zatvaranja borio za njegovo puštanje iz zatvora i više puta javno prosvjedovao, najavili su da će se Janša popodne u Ljubljani obratiti svojim pristašama.

Odluku ustavnog suda komentirao je i premijer Miro Cerar, rekavši da će je vlada i on kao premijer poštovati.

Cerar je rekao da je ustavni sud privremeno obustavio Janšinu kaznu te da će vlada i parlament poštovati tu odluku, kao i kasniju konačnu odluku, bez obzira kakva bude, i tome se prilagoditi.

Parlament je Janši već oduzeo zastupnički mandat, ali je ustavni sud već ranije tu odluku obustavio dok se ne utvrdi je li oduzimanje mandata bilo u skladu s ustavom pa je Janša i dalje prisustvovao sjednicama parlamenta.

je čelniku vodeće oporbene stranke i bivšem premijeru Janezu Janši odobrio puštanje na slobodu do konačnog rješenja njegove ustavne žalbe kojom je tražio poništenje presude kojom je pravomoćno osuđen na dvije godine zatvora zbog korupcijske afere Patria.

Svih devet ustavnih sudaca glasovalo je za to da se Janšina presuda privremeno suspendira i da bude na slobodi sve do konačnog pravorijeka pa je on u petak pušten iz zatvora Dob u kojemu se nalazio od 20. lipnja.

U obrazloženju svoje odluke ustavni sud je naveo da je izdržavanje kazne Janši obustavio temeljem 58. članka zakona o ustavnom sudu. Njime se predviđa da je za suspendiranje kazne dovoljan razlog ako bi u suprotnome mogle nastati posljedice koje bi teško bilo popraviti, što bi se dogodilo u slučaju da i konačni pravorijek ustavnog suda za Janšu bude pozitivan.

Prihvate li u konačnici ustavni suci Janšinu ustavnu žalbu da mu krivnja za mito u korupcijskoj aferi Patria nije bila dokazana i da su bila kršena njegova prava, on će ostati na slobodi, a u suprotnome će se morati vratiti na izdržavanje kazne.

Janšina stranka i "Odbor 2014", koji se od Janšina zatvaranja borio za njegovo puštanje iz zatvora i više puta javno prosvjedovao, najavili su da će se Janša popodne u Ljubljani obratiti svojim pristašama.

Odluku ustavnog suda komentirao je i premijer Miro Cerar, rekavši da će je vlada i on kao premijer poštovati.

Cerar je rekao da je ustavni sud privremeno obustavio Janšinu kaznu te da će vlada i parlament poštovati tu odluku, kao i kasniju konačnu odluku, bez obzira kakva bude, i tome se prilagoditi.

Parlament je Janši već oduzeo zastupnički mandat, ali je ustavni sud već ranije tu odluku obustavio dok se ne utvrdi je li oduzimanje mandata bilo u skladu s ustavom pa je Janša i dalje prisustvovao sjednicama parlamenta.

Ustavni sud odobrio Janši privremeno puštanje na slobodu
