Međunarodni kazneni sud za bivšu Jugoslaviju (ICTY) odgodio je prvo pojavljivanje bivše glasnogovornice Haškog tužiteljstva Florence Hartmann, koju tereti za nepoštivanje suda, na njezin zahtjev za mjesec dana, objavio je Haški sud.

Prvo pojavljivanje Florence Hartman, koja je bila glasnogovornica bivše glavne tužiteljice Suda Carle del Ponte, izvorno zakazano za 15. rujna, odgođeno je do 13. listopada zbog njezinih profesionalnih obveza prema OESS-u zbog kojih nije mogla doći u rujnu u Haag, navodi se u odluci o zakazivanju novog datuma njezina prvog pojavljivanja.

Hartmannovu se tereti u dvije točke optužnice za nepoštivanje suda zbog objave podataka iz tajnih odluka Žalbenog vijeća Haškog suda u predmetu "Milošević". Ona je, prema optužnici, tajne podatke objavila u rujnu prošle godine u svojoj knjizi "Mir i kazna", kao i u članku "Prikriveni ključni dokazi o genocidu" koji je u siječnju 2008. objavio Bosanski institut.

"Florence Hartmann znala je da su ti podaci tajni u vrijeme kad ih je objavila, da su odluke, iz kojih potječu te informacije, tajne i da je svojim postupkom otkrila javnosti tajne podatke", navodi se u obrazloženju optužnice.

Haški sud je 1. veljače 2008., prema sudskim dokumentima, pokrenuo istragu kako bi utvrdio je li Hartmannova otkrila tajne podatke. Ta je istraga pokazala da postoji osnova za njezin kazneni progon i posebno oformljeno sudsko vijeće Haškog suda 27. kolovoza ove godine izdalo je tzv. "nalog in lieu", umjesto optužnice protiv bivše glasnogovornice Haškog suda tereteći ju po dvije točke optužnice. Vijeće je tada zakazalo njezino prvo pojavljivanje, odnosno izjašnjavanje o krivnji, za 15. rujna.

Tajništvo Haškog suda imenovalo je u međuvremenu vanjskog tužitelja Brucea MacFarlanea za tužitelja u ovom predmetu, jer je zaključeno da su haški tužitelji u sukobu interesa s obzirom na to da se radi o postupku protiv bivše glasnogovornice tužiteljstva.

Hartmann je bila glasnogovornica od 1999. do 2006.

Pravila Haškog suda predviđaju kaznu do sedam godina zatvora i/ili novčanu kaznu do 100.000 eura za nepoštivanje suda.

Međunarodni kazneni sud za bivšu Jugoslaviju (ICTY) odgodio je prvo pojavljivanje bivše glasnogovornice Haškog tužiteljstva Florence Hartmann, koju tereti za nepoštivanje suda, na njezin zahtjev za mjesec dana, objavio je Haški sud.

Prvo pojavljivanje Florence Hartman, koja je bila glasnogovornica bivše glavne tužiteljice Suda Carle del Ponte, izvorno zakazano za 15. rujna, odgođeno je do 13. listopada zbog njezinih profesionalnih obveza prema OESS-u zbog kojih nije mogla doći u rujnu u Haag, navodi se u odluci o zakazivanju novog datuma njezina prvog pojavljivanja.

Hartmannovu se tereti u dvije točke optužnice za nepoštivanje suda zbog objave podataka iz tajnih odluka Žalbenog vijeća Haškog suda u predmetu "Milošević". Ona je, prema optužnici, tajne podatke objavila u rujnu prošle godine u svojoj knjizi "Mir i kazna", kao i u članku "Prikriveni ključni dokazi o genocidu" koji je u siječnju 2008. objavio Bosanski institut.

"Florence Hartmann znala je da su ti podaci tajni u vrijeme kad ih je objavila, da su odluke, iz kojih potječu te informacije, tajne i da je svojim postupkom otkrila javnosti tajne podatke", navodi se u obrazloženju optužnice.

Haški sud je 1. veljače 2008., prema sudskim dokumentima, pokrenuo istragu kako bi utvrdio je li Hartmannova otkrila tajne podatke. Ta je istraga pokazala da postoji osnova za njezin kazneni progon i posebno oformljeno sudsko vijeće Haškog suda 27. kolovoza ove godine izdalo je tzv. "nalog in lieu", umjesto optužnice protiv bivše glasnogovornice Haškog suda tereteći ju po dvije točke optužnice. Vijeće je tada zakazalo njezino prvo pojavljivanje, odnosno izjašnjavanje o krivnji, za 15. rujna.

Tajništvo Haškog suda imenovalo je u međuvremenu vanjskog tužitelja Brucea MacFarlanea za tužitelja u ovom predmetu, jer je zaključeno da su haški tužitelji u sukobu interesa s obzirom na to da se radi o postupku protiv bivše glasnogovornice tužiteljstva.

Hartmann je bila glasnogovornica od 1999. do 2006.

Pravila Haškog suda predviđaju kaznu do sedam godina zatvora i/ili novčanu kaznu do 100.000 eura za nepoštivanje suda.
