Njemački Vrhovni savezni sud u Karlsruheu odbacio je zahtjev hrvatskog državljanina Krunoslava Pratesa za revizijom procesa u kojem je on prošle godine zbog ubojstva hrvatskog emigrantskog političara Stjepana Đurekovića osuđen na doživotni zatvor, tako da je ta presuda pravomoćna, priopćio je savezni sud u četvrtak.
"Treće kazneno vijeće saveznog suda odbacuje zahtjev optuženog za revizijom čime je presuda Višega zemaljskog suda u Muenchenu od 16. srpnja 2008. pravomoćna", priopćio je savezni sud. Sud je odluku o odbijanju zahtjeva za revizijom donio još 10. veljače, ali je objavljena tek u četvrtak jer je, kako je priopćeno, najprije morala biti dostavljena stranama uključenima u proces.
U obrazloženju odluke vrhovni sud navodi presudu višega zemaljskog suda u Muenchenu koji je Pratesa prošle godine osudio zbog ubojstva, a ne samo zbog, kako je prvotno glasila optužba, sudioništva u ubojstvu.
Prates je kao pripadnik hrvatske emigracijske scene, ali i suradnik tadašnje jugoslavenske Službe državne sigurnosti (SDS) Đurekovića namamio na mjesto na kojem su ga 28. srpnja 1983. ubili zasad nepoznati počinitelji.
Viši zemaljski sud u Muenchenu tada je zaključio da je Đureković ubijen po nalogu bivšeg predsjednika predsjedništva SFRJ Mike Špiljka jer se strahovalo da bi Đureković, koji je do svoje emigracije obnašao visoke dužnosti u Ininu vodstvu, mogao otkriti financijske zlouporabe u toj tvrtki i u koje je, kako se navodi, bio umiješan i Vanja Špiljak, sin Mike Špiljka.
Iako je Vanja Špiljak pred sudom u Muenchenu nekoliko tjedana prije zanijekao ikakvu povezanost s Đurekovićevim ubojstvom, sudsko se vijeće u potpunosti oslonilo na iskaz svjedoka optužbe koji su iznijeli detalje po kojima je iza ubojstva stajao sam jugoslavenski državni vrh.
Kad je prošle godine izricao presudu, sud je kritizirao ponašanje Republike Hrvatske tijekom suđenja Pratesu zato što ne "surađuje" i "ne pokazuje interes" za taj slučaj. Sud je posebice kritizirao činjenicu da se pred sudom ne pojavljuje bivši načelnik hrvatskog SDS-a Josip Perković koji je, po mišljenju njemačkog sudstva, bio također umiješan u Đurekovićevo ubojstvo.

Njemački Vrhovni savezni sud u Karlsruheu odbacio je zahtjev hrvatskog državljanina Krunoslava Pratesa za revizijom procesa u kojem je on prošle godine zbog ubojstva hrvatskog emigrantskog političara Stjepana Đurekovića osuđen na doživotni zatvor, tako da je ta presuda pravomoćna, priopćio je savezni sud u četvrtak.
"Treće kazneno vijeće saveznog suda odbacuje zahtjev optuženog za revizijom čime je presuda Višega zemaljskog suda u Muenchenu od 16. srpnja 2008. pravomoćna", priopćio je savezni sud. Sud je odluku o odbijanju zahtjeva za revizijom donio još 10. veljače, ali je objavljena tek u četvrtak jer je, kako je priopćeno, najprije morala biti dostavljena stranama uključenima u proces.
U obrazloženju odluke vrhovni sud navodi presudu višega zemaljskog suda u Muenchenu koji je Pratesa prošle godine osudio zbog ubojstva, a ne samo zbog, kako je prvotno glasila optužba, sudioništva u ubojstvu.
Prates je kao pripadnik hrvatske emigracijske scene, ali i suradnik tadašnje jugoslavenske Službe državne sigurnosti (SDS) Đurekovića namamio na mjesto na kojem su ga 28. srpnja 1983. ubili zasad nepoznati počinitelji.
Viši zemaljski sud u Muenchenu tada je zaključio da je Đureković ubijen po nalogu bivšeg predsjednika predsjedništva SFRJ Mike Špiljka jer se strahovalo da bi Đureković, koji je do svoje emigracije obnašao visoke dužnosti u Ininu vodstvu, mogao otkriti financijske zlouporabe u toj tvrtki i u koje je, kako se navodi, bio umiješan i Vanja Špiljak, sin Mike Špiljka.
Iako je Vanja Špiljak pred sudom u Muenchenu nekoliko tjedana prije zanijekao ikakvu povezanost s Đurekovićevim ubojstvom, sudsko se vijeće u potpunosti oslonilo na iskaz svjedoka optužbe koji su iznijeli detalje po kojima je iza ubojstva stajao sam jugoslavenski državni vrh.
Kad je prošle godine izricao presudu, sud je kritizirao ponašanje Republike Hrvatske tijekom suđenja Pratesu zato što ne "surađuje" i "ne pokazuje interes" za taj slučaj. Sud je posebice kritizirao činjenicu da se pred sudom ne pojavljuje bivši načelnik hrvatskog SDS-a Josip Perković koji je, po mišljenju njemačkog sudstva, bio također umiješan u Đurekovićevo ubojstvo.
