Suđenje bivšoj glasnogovornici Tužiteljstva Haaškog suda Florence Hartmann (46), optuženoj za nepoštivanje suda, počelo je u ponedjeljak, objavljeno je iz tog suda.
Francusku novinarku, koja je glasnogovornica Tužiteljstva ICTY-a bila od 2000. do 2006. godine optužnica tereti za nepoštivanje Suda zbog objave podataka iz tajnih odluka Žalbenog vijeća Haaškog suda u predmetu "Milošević".
Ona je, po optužnici, tajne podatke objavila u rujnu pretprošle godine u svojoj knjizi ""Mir i kazna: Tajni ratovi međunarodne politike i pravosuđa" i u članku "Prikriveni ključni dokazi o genocidu" koji je u siječnju 2008. objavio Bosanski institut.
Ti su dokumenti, prema tvrdnji Hartmann, omogućili dokazivanje upletenosti srbijanske države u genocid u Srebrenici u kojem je 1995. usmrćeno osam tisuća muslimana.
"Suci ovog suda sami su javno obznanili te odluke" u presudama koje su iznijeli na raspravama otvorenim za javnost, naglasio je branitelj Florence Hartmann Karim Khan. "Zato nije ni bilo kršenja povjerljivosti", dodao je.
Obrana ustrajno ponavlja tezu kako je Hartmann jedina osoba koju je Haaški sud optužio zbog toga što je "rekla nešto što su svi već znali" te da "nema dokaza da je Hartmann namjeravala nanijeti štetu ugledu Suda".
Haaški je sud 1. veljače 2008. pokrenuo istragu protiv bivše glasnogovornice Tužiteljstva kako bi utvrdio je li otkrila tajne podatke. Optužnica protiv nje podignuta je 27. kolovoza 2008., suđenje je bilo zakazano za 5. i 6. veljače, ali je 3. veljače odgođeno do daljnjeg zbog zahtjeva obrane za izuzećem dvojice članova sudskog vijeća zbog sukoba interesa.
To se poslije i dogodilo, jer je ICTY 18. veljače odlučio dotad predsjedavajućeg Carmela Agiusa i suca Alphonsa Oriea zamijeniti Mehmetom Gueneyem i Liuom Daqunom.
Potom je obrana zatražila obustavu postupka zbog brojnih propusta i nedosljednosti u istražnom i sudskom postupku protiv njihove klijentice, napomenuvši kako su zbog sudjelovanja u istrazi protiv nje zamijenjena dva suca u postupku.
Zahtjev za poništenjem odluka Raspravnog vijeća u podnesku se argumentira činjenicom kako je logično zaključiti da odluke koje je donijelo vijeće iz kojeg su u međuvremenu zbog sukoba interesa maknuta dva člana "nisu nepristrane, a posljedično ni legitimne, te ih treba smatrati nevažećim".
Zahtjev ipak nije prihvaćen i počelo je suđenje koje bi trebalo trajati do srijede. Pravila Haaškog suda za nepoštivanje Suda predviđaju kaznu do sedam godina zatvora ili novčanu kaznu do 100 tisuća eura. Obrana je prije dva mjeseca navela kako je Hartmann majka dvoje djece i da je bez redovitih prihoda te da bi bilo kakva presuda imala "dramatične posljedice za njezinu obitelj".

Suđenje bivšoj glasnogovornici Tužiteljstva Haaškog suda Florence Hartmann (46), optuženoj za nepoštivanje suda, počelo je u ponedjeljak, objavljeno je iz tog suda.
Francusku novinarku, koja je glasnogovornica Tužiteljstva ICTY-a bila od 2000. do 2006. godine optužnica tereti za nepoštivanje Suda zbog objave podataka iz tajnih odluka Žalbenog vijeća Haaškog suda u predmetu "Milošević".
Ona je, po optužnici, tajne podatke objavila u rujnu pretprošle godine u svojoj knjizi ""Mir i kazna: Tajni ratovi međunarodne politike i pravosuđa" i u članku "Prikriveni ključni dokazi o genocidu" koji je u siječnju 2008. objavio Bosanski institut.
Ti su dokumenti, prema tvrdnji Hartmann, omogućili dokazivanje upletenosti srbijanske države u genocid u Srebrenici u kojem je 1995. usmrćeno osam tisuća muslimana.
"Suci ovog suda sami su javno obznanili te odluke" u presudama koje su iznijeli na raspravama otvorenim za javnost, naglasio je branitelj Florence Hartmann Karim Khan. "Zato nije ni bilo kršenja povjerljivosti", dodao je.
Obrana ustrajno ponavlja tezu kako je Hartmann jedina osoba koju je Haaški sud optužio zbog toga što je "rekla nešto što su svi već znali" te da "nema dokaza da je Hartmann namjeravala nanijeti štetu ugledu Suda".
Haaški je sud 1. veljače 2008. pokrenuo istragu protiv bivše glasnogovornice Tužiteljstva kako bi utvrdio je li otkrila tajne podatke. Optužnica protiv nje podignuta je 27. kolovoza 2008., suđenje je bilo zakazano za 5. i 6. veljače, ali je 3. veljače odgođeno do daljnjeg zbog zahtjeva obrane za izuzećem dvojice članova sudskog vijeća zbog sukoba interesa.
To se poslije i dogodilo, jer je ICTY 18. veljače odlučio dotad predsjedavajućeg Carmela Agiusa i suca Alphonsa Oriea zamijeniti Mehmetom Gueneyem i Liuom Daqunom.
Potom je obrana zatražila obustavu postupka zbog brojnih propusta i nedosljednosti u istražnom i sudskom postupku protiv njihove klijentice, napomenuvši kako su zbog sudjelovanja u istrazi protiv nje zamijenjena dva suca u postupku.
Zahtjev za poništenjem odluka Raspravnog vijeća u podnesku se argumentira činjenicom kako je logično zaključiti da odluke koje je donijelo vijeće iz kojeg su u međuvremenu zbog sukoba interesa maknuta dva člana "nisu nepristrane, a posljedično ni legitimne, te ih treba smatrati nevažećim".
Zahtjev ipak nije prihvaćen i počelo je suđenje koje bi trebalo trajati do srijede. Pravila Haaškog suda za nepoštivanje Suda predviđaju kaznu do sedam godina zatvora ili novčanu kaznu do 100 tisuća eura. Obrana je prije dva mjeseca navela kako je Hartmann majka dvoje djece i da je bez redovitih prihoda te da bi bilo kakva presuda imala "dramatične posljedice za njezinu obitelj".
