Međunarodni kazneni sud za bivšu Jugoslaviju (ICTY) u utorak je objavio kako je vođenje optužbe u postupku za nepoštivanje suda protiv bivše glasnogovornice Tužiteljstva ICTY-a Florence Hartmann odlučio povjeriti vanjskom tužitelju, tzv. prijatelju suda (amicus curiae).

Na ročištu, zakazanom za 15. rujna, optužbu po dvije točke za nepoštivanje suda protiv Hartmann vodit će prijatelj suda, kanadski odvjetnik Bruce MacFarlane.

Pravila o postupku i dokazima pred Haškim sudom predviđaju da u slučajevima nepoštivanja suda ICTY može odrediti prijatelja suda da vodi postupak optužbe ili taj postupak voditi sam. No, kad kod tužitelja postoji sukob interesa u vezi s predmetom, onda se od glavnog tajnika suda traži da imenuje prijatelja suda da provede istragu i izvijesti o rezultatima te, analogijom, i vodi optužbu u postupku.

Florence Hartmann, koja je do 2006. godine bila glasnogovornica tadašnje glavne tužiteljice ICTY-a Carle del Ponte, prošle je srijede optužena za nepoštivanje Haškog suda te joj je naloženo da se 15. rujna pojavi pred sudom. Optužena je po dvije točke, i to zbog otkrivanja povjerljivih informacija vezanih uz slučaj Slobodana Miloševića.

Hartmann je optužena da je u svojoj knjizi "Mir i kazna", koja je objavljena 10. rujna prošle godine, na stranicama 120-122 otkrila povjerljive podatke sa suđenja Slobodanu Miloševiću. Podaci i odluke koje je koristila izneseni su na Miloševićevu suđenju 20. rujna 2005. i 6. travnja 2006. godine.

Isto tako se tereti da je u autorskom članku, koji je pod nazivom "Skriveni ključni dokumenti o genocidu" objavio Bosanski institut 21. siječnja 2008., otkrila iste te povjerljive podatke.

U zaključku naloga izdanog umjesto optužnice navodi se kako je, u vrijeme njihova objavljivanja, Hartmann znala da je riječ o povjerljivim informacijama koje se ne smiju objavljivati u javnosti.

Raspravno vijeće stoga je naložilo "kazneni progon Florence Hartmann ... zbog svjesnog i namjernog objavljivanja informacija, čime se svjesno oglušila o nalog sudskog vijeća".

Međunarodni kazneni sud za bivšu Jugoslaviju (ICTY) u utorak je objavio kako je vođenje optužbe u postupku za nepoštivanje suda protiv bivše glasnogovornice Tužiteljstva ICTY-a Florence Hartmann odlučio povjeriti vanjskom tužitelju, tzv. prijatelju suda (amicus curiae).

Na ročištu, zakazanom za 15. rujna, optužbu po dvije točke za nepoštivanje suda protiv Hartmann vodit će prijatelj suda, kanadski odvjetnik Bruce MacFarlane.

Pravila o postupku i dokazima pred Haškim sudom predviđaju da u slučajevima nepoštivanja suda ICTY može odrediti prijatelja suda da vodi postupak optužbe ili taj postupak voditi sam. No, kad kod tužitelja postoji sukob interesa u vezi s predmetom, onda se od glavnog tajnika suda traži da imenuje prijatelja suda da provede istragu i izvijesti o rezultatima te, analogijom, i vodi optužbu u postupku.

Florence Hartmann, koja je do 2006. godine bila glasnogovornica tadašnje glavne tužiteljice ICTY-a Carle del Ponte, prošle je srijede optužena za nepoštivanje Haškog suda te joj je naloženo da se 15. rujna pojavi pred sudom. Optužena je po dvije točke, i to zbog otkrivanja povjerljivih informacija vezanih uz slučaj Slobodana Miloševića.

Hartmann je optužena da je u svojoj knjizi "Mir i kazna", koja je objavljena 10. rujna prošle godine, na stranicama 120-122 otkrila povjerljive podatke sa suđenja Slobodanu Miloševiću. Podaci i odluke koje je koristila izneseni su na Miloševićevu suđenju 20. rujna 2005. i 6. travnja 2006. godine.

Isto tako se tereti da je u autorskom članku, koji je pod nazivom "Skriveni ključni dokumenti o genocidu" objavio Bosanski institut 21. siječnja 2008., otkrila iste te povjerljive podatke.

U zaključku naloga izdanog umjesto optužnice navodi se kako je, u vrijeme njihova objavljivanja, Hartmann znala da je riječ o povjerljivim informacijama koje se ne smiju objavljivati u javnosti.

Raspravno vijeće stoga je naložilo "kazneni progon Florence Hartmann ... zbog svjesnog i namjernog objavljivanja informacija, čime se svjesno oglušila o nalog sudskog vijeća".
