Bivša glasnogovornica haškog tužiteljstva Florence Hartmann osporit će presudu kojom je proglašena krivom za nepoštivanje Haškog suda. Ona, kao i mnogi novinari, smatra da presuda ugrožava pravo na slobodu izražavanja.
Žalbeno vijeće Haškog suda potvrdilo je presudu Florence Hartmann za nepoštivanje suda jer je u svojoj knjizi "Mir i kazna" objavila povjerljive informacije o odlukama Žalbenog vijeća kojima su povjerljivi dokumenti Vrhovnog vijeća obrane bivše Savezne Republike Jugoslavije, kao i neke transkripte sa suđenja Slobodanu Miloševiću. Francuska novinarka zato će morati platiti novčanu kaznu u iznosu od 7.000 eura.
Bivša glasnogovornica Haškog tužiteljstva Florence Hartmann smatra da "presuda nije u skladu s pravima novinara na slobodu izražavanja".
"Zato je važno pred drugim instancama, posebnim tijelima Ujedinjenih naroda, osporiti ovu presudu jer Haški sud nije oformljen kako bi se bavio tim pitanjima, već pitanjima ratnih zločina", rekla je za Deutsche Welle Florence Hartmann.
"Na izricanje presude čekalo se jako dugo iz čega se može zaključiti da sucima nije bilo jednostavno presuditi u ovom slučaju", kaže direktor i urednik agencije SENSE Mirko Klarin.
"Hartmannova i njeni branitelji razmatraju mogućnost da se obrate nadležnim tijelima kako bi pokrenuli pitanja u pogledu usklađenosti presude s međunarodnim pravnim standardima i slobodom izražavanja", kaže Klarin.
"Prema ocjenama nekih ljudi, zaštita slobode izražavanja sada je dovedena u pitanje", kaže direktor agencije SENSE.
"S obzirom na činjenicu da međunarodni sudovi imaju prednost nad nacionalnima, moglo bi se tumačiti da je presudom koja je izrečena Hartmannovoj uspostavljen jedan pravni presedan na koji se mogu pozivati neke druge države ako žele ograničiti slobodu izražavanja u nacionalnim okvirima", upozorava Mirko Klarin.
Glavna tajnica Udruženja "BH novinari" Borka Rudić kaže da je Žalbeno vijeće dalo prednost zaštiti interesa pojedinih država, u ovom slučaju Srbije, i ugleda suda u odnosu na pravo na slobodu izražavanja koje je koristila Florence Hartmann.
"Odluka je sporna zato što su prava građana da budu sveobuhvatno informirani o radu Haškog suda zanemarena i stavljena u kontekst zaštite interesa suda i pojedinih država", pojašnjava Borka Rudić.
"Nedopustivo je individualnim procjenama sudaca dati takvu mogućnost da odlučuju o načinu prakticiranja prava na slobodu izražavanja i procjenjuju šta jest, a šta nije u interesu javnosti", kaže glavna tajnica udruženja "BH novinari".
Udruženje će o ovom slučaju obavijestiti relevantne međunarodne organizacije, te organizirati potpisivanje javne peticije za podršku Florence Hartmann. "BH novinari" će, ako to bude potrebno, organizirati i prikupljanje sredstava kako bi se u ime Florence Hartmann sudu platila novčana kazna od 7.000 eura.

Bivša glasnogovornica haškog tužiteljstva Florence Hartmann osporit će presudu kojom je proglašena krivom za nepoštivanje Haškog suda. Ona, kao i mnogi novinari, smatra da presuda ugrožava pravo na slobodu izražavanja.
Žalbeno vijeće Haškog suda potvrdilo je presudu Florence Hartmann za nepoštivanje suda jer je u svojoj knjizi "Mir i kazna" objavila povjerljive informacije o odlukama Žalbenog vijeća kojima su povjerljivi dokumenti Vrhovnog vijeća obrane bivše Savezne Republike Jugoslavije, kao i neke transkripte sa suđenja Slobodanu Miloševiću. Francuska novinarka zato će morati platiti novčanu kaznu u iznosu od 7.000 eura.
Bivša glasnogovornica Haškog tužiteljstva Florence Hartmann smatra da "presuda nije u skladu s pravima novinara na slobodu izražavanja".
"Zato je važno pred drugim instancama, posebnim tijelima Ujedinjenih naroda, osporiti ovu presudu jer Haški sud nije oformljen kako bi se bavio tim pitanjima, već pitanjima ratnih zločina", rekla je za Deutsche Welle Florence Hartmann.
"Na izricanje presude čekalo se jako dugo iz čega se može zaključiti da sucima nije bilo jednostavno presuditi u ovom slučaju", kaže direktor i urednik agencije SENSE Mirko Klarin.
"Hartmannova i njeni branitelji razmatraju mogućnost da se obrate nadležnim tijelima kako bi pokrenuli pitanja u pogledu usklađenosti presude s međunarodnim pravnim standardima i slobodom izražavanja", kaže Klarin.
"Prema ocjenama nekih ljudi, zaštita slobode izražavanja sada je dovedena u pitanje", kaže direktor agencije SENSE.
"S obzirom na činjenicu da međunarodni sudovi imaju prednost nad nacionalnima, moglo bi se tumačiti da je presudom koja je izrečena Hartmannovoj uspostavljen jedan pravni presedan na koji se mogu pozivati neke druge države ako žele ograničiti slobodu izražavanja u nacionalnim okvirima", upozorava Mirko Klarin.
Glavna tajnica Udruženja "BH novinari" Borka Rudić kaže da je Žalbeno vijeće dalo prednost zaštiti interesa pojedinih država, u ovom slučaju Srbije, i ugleda suda u odnosu na pravo na slobodu izražavanja koje je koristila Florence Hartmann.
"Odluka je sporna zato što su prava građana da budu sveobuhvatno informirani o radu Haškog suda zanemarena i stavljena u kontekst zaštite interesa suda i pojedinih država", pojašnjava Borka Rudić.
"Nedopustivo je individualnim procjenama sudaca dati takvu mogućnost da odlučuju o načinu prakticiranja prava na slobodu izražavanja i procjenjuju šta jest, a šta nije u interesu javnosti", kaže glavna tajnica udruženja "BH novinari".
Udruženje će o ovom slučaju obavijestiti relevantne međunarodne organizacije, te organizirati potpisivanje javne peticije za podršku Florence Hartmann. "BH novinari" će, ako to bude potrebno, organizirati i prikupljanje sredstava kako bi se u ime Florence Hartmann sudu platila novčana kazna od 7.000 eura.
