Lisabonski sporazum je prošao i češki Senat (gornji dom Parlamenta). Ostala je posljednja, ali možda najteža prepreka - predsjednik Vaclav Klaus, bez čijeg potpisa ratifikacija nije potpuna.
Čim je Klaus nagovijestio da o tome on “neće odlučivati tako brzo”, najavivši i mogućnost da uopće i ne potpiše ovaj dokument ključan za razvoj i produbljivanje eurointegracije, u redovima eurofila počelo se govoriti o radikalnom rješenju za slamanje njegova otpora.
Potpredsjednica Senata Alena Gajduškova iz Češke socijaldemokratske stranke (ČSSD) predložila je nešto što su dosad samo teoretski spominjali pravnici.
Ukratko, ako predsjednik, koji je podređen Parlamentu što ga je izabrao, ignorira činjenicu da je “lisabonac” usvojen u oba doma Parlamenta te nastavi blokirati sporazum, onda bi se trebao sam povući ili će ga smijeniti s funkcije tužbom Ustavnom sudu zbog veleizdaje.
“Ako ne postupa u skladu s Ustavom i ne poštuje odluke zakonodavne vlasti, koja je izvedena iz volje naroda, to može biti kvalificirano kao veleizdaja”, tumače pravni stručnjaci.
Klausovi suradnici odbili su komentirati ove izjave.
U Češkoj, a tako je uostalom i u drugim zemljama, rijetka su iskustva u rješavanju spora parlamenta i predsjednika. Prema mišljenju ustavnih pravnika, Klaus bi se, utoliko više što u Češkoj šefa države bira Parlament, morao podrediti zakonodavnom tijelu.
Veleizdaja je, zapravo, jedini delikt koji predsjednik može učiniti. Kazna za to može biti smjenjivanje i onemogućavanje ponovnog izbora.
A prema češkom Ustavu, “pod veleizdajom se podrazumijeva postupanje predsjednika usmjereno protiv suvereniteta i teritorijalnog integriteta republike kao i protiv njezina demokratskog poretka”.

Benešovi dekreti
Opravdavajući svoju odbojnost prema Lisabonskom sporazumu, češki predsjednik, poznat inače po obrani Benešovih dekreta (iz 1945. - pravna osnova oduzimanja imovine i deportacije 3,2 milijuna sudetskih Nijemaca iz tadašnje Čehoslovačke), ustvrdio je kako se pribojava da bi “lisabonac” mogao ugroziti važenje ovih dekreta, što implicite znači mogućnost povratka Nijemaca, povrat imovine, odštetu...

Lisabonski sporazum je prošao i češki Senat (gornji dom Parlamenta). Ostala je posljednja, ali možda najteža prepreka - predsjednik Vaclav Klaus, bez čijeg potpisa ratifikacija nije potpuna.
Čim je Klaus nagovijestio da o tome on “neće odlučivati tako brzo”, najavivši i mogućnost da uopće i ne potpiše ovaj dokument ključan za razvoj i produbljivanje eurointegracije, u redovima eurofila počelo se govoriti o radikalnom rješenju za slamanje njegova otpora.
Potpredsjednica Senata Alena Gajduškova iz Češke socijaldemokratske stranke (ČSSD) predložila je nešto što su dosad samo teoretski spominjali pravnici.
Ukratko, ako predsjednik, koji je podređen Parlamentu što ga je izabrao, ignorira činjenicu da je “lisabonac” usvojen u oba doma Parlamenta te nastavi blokirati sporazum, onda bi se trebao sam povući ili će ga smijeniti s funkcije tužbom Ustavnom sudu zbog veleizdaje.
“Ako ne postupa u skladu s Ustavom i ne poštuje odluke zakonodavne vlasti, koja je izvedena iz volje naroda, to može biti kvalificirano kao veleizdaja”, tumače pravni stručnjaci.
Klausovi suradnici odbili su komentirati ove izjave.
U Češkoj, a tako je uostalom i u drugim zemljama, rijetka su iskustva u rješavanju spora parlamenta i predsjednika. Prema mišljenju ustavnih pravnika, Klaus bi se, utoliko više što u Češkoj šefa države bira Parlament, morao podrediti zakonodavnom tijelu.
Veleizdaja je, zapravo, jedini delikt koji predsjednik može učiniti. Kazna za to može biti smjenjivanje i onemogućavanje ponovnog izbora.
A prema češkom Ustavu, “pod veleizdajom se podrazumijeva postupanje predsjednika usmjereno protiv suvereniteta i teritorijalnog integriteta republike kao i protiv njezina demokratskog poretka”.

Benešovi dekreti
Opravdavajući svoju odbojnost prema Lisabonskom sporazumu, češki predsjednik, poznat inače po obrani Benešovih dekreta (iz 1945. - pravna osnova oduzimanja imovine i deportacije 3,2 milijuna sudetskih Nijemaca iz tadašnje Čehoslovačke), ustvrdio je kako se pribojava da bi “lisabonac” mogao ugroziti važenje ovih dekreta, što implicite znači mogućnost povratka Nijemaca, povrat imovine, odštetu...
