Stupanjem na snagu izmjena Ustava Federacije Bosne i Hercegovine i Izbornog zakona Bosne i Hercegovine, prema nametnutim odlukama Visokog predstavnika, koje su u značajnom dijelu neustavne, stvorilo je obavezu da se putem zahtjeva Ustavnom sudu BiH takve neustavne odluke stave izvan snage, priopćio je član Predsjedništva BiH Željko Komšić.

Komšić kaže da je posebno zabrinjavajuće da svojom nametnutom odlukom Visoki predstavnik krši ranije donesene odluke Ustavnog suda Bosne i Hercegovine, a time i sam Ustav BiH.

- Visoki predstavnik je svojim nametnutim odlukama, u noći kada je obavljeno glasanje građana Bosne i Hercegovine, izvršio izravan udar na integritet izbornog procesa tako što je izvršio prijevaru birača, koji bi eventualno drugačije glasali da su znali za nova izborna pravila, kao što je prevario i sve političke stranke i druge sudionike izbora, koji bi izvjesno ponudili drugačije izborne liste, prilagođene tim novim pravilima.

Osim toga, Visoki predstavnik je izvršio i izravan udar na demokraciju u Bosni i Hercegovini, što je obveza iz Ustava BiH, na način da je doveo u zabludu sve glasače u njihovoj namjeri da svojim glasom izaberu svoje izabrane predstavnike u zakonodavne organe vlasti koje su željeli, posebno u domove naroda koji se biraju indirektno kroz kantonalne skupštine.

Svojom odlukom da se koriste dva različita popisa, jedan za formiranje zakonodavnog organa vlasti i drugi popis za formiranje izvršnih organa vlasti u bh. entitetu Federacija Bosne i Hercegovine, Visoki predstavnik je učinio neviđen i nezapamćen presedan i doveo sve građane Bosne i Hercegovine u stanje pravne nesigurnosti.

Posebno iz razloga, što je uvođenjem "posljednjeg popisa" ili onoga iz 2013. godine, neformalno proglasio okončanim Aneks 7 Daytonskog mirovnog sporazuma ili povratak svih prognanih u svoje prijeratne domove, čime je ušao u veoma opasan i delikatan prostor eventualnog prihvaćanja rezultata etničkog čišćenja. Osim toga, Visoki predstavnik je svojom odlukom umanjio stupanj ranije dosegnutih prava građana BiH, što je također neprihvatljivo i pravno nemoguće.

Najzad, svojom formulom 1, 3, 5, 7, 9… (što je zapravo Sainte-Lague metoda za dodjelu mandata i ne može se koristiti za druge svrhe) koja služi za izračun količnika ili koeficijenta brojnosti delegata u klubovima konstituentnih naroda u Domu naroda Federacije Bosne i Hercegovine, Visoki predstavnik je učinio formaliziranje diskriminacije na najgori mogući način, jer bi u tom novom sistemu građani Bosne i Hercegovine, kao osobe imali veću ili manju vlastitu osobnu vrijednost, ovisno o mjestu prebivališta.

To su sve razlozi za podnošenje zahtjeva Ustavnom sudu Bosne i Hercegovine za ocjenu ustavnosti ovih nametnutih odluka Visokog predstavnika od 2. listopada 2022.  s prijedlogom privremene mjere, kao i slanja odgovarajućeg pisma Centralnoj izbornoj komisiji da ne vrši dodjelu mandata na temelju odluka Visokog predstavnika, sve dok Ustavni sud Bosne i Hercegovine ne obavi svoj postupak i odluči o ustavnosti spomenutih odluka Visokog predstavnika - poručuju javnosti iz kabineta Željka Komšića.

Stupanjem na snagu izmjena Ustava Federacije Bosne i Hercegovine i Izbornog zakona Bosne i Hercegovine, prema nametnutim odlukama Visokog predstavnika, koje su u značajnom dijelu neustavne, stvorilo je obavezu da se putem zahtjeva Ustavnom sudu BiH takve neustavne odluke stave izvan snage, priopćio je član Predsjedništva BiH Željko Komšić.

Komšić kaže da je posebno zabrinjavajuće da svojom nametnutom odlukom Visoki predstavnik krši ranije donesene odluke Ustavnog suda Bosne i Hercegovine, a time i sam Ustav BiH.

- Visoki predstavnik je svojim nametnutim odlukama, u noći kada je obavljeno glasanje građana Bosne i Hercegovine, izvršio izravan udar na integritet izbornog procesa tako što je izvršio prijevaru birača, koji bi eventualno drugačije glasali da su znali za nova izborna pravila, kao što je prevario i sve političke stranke i druge sudionike izbora, koji bi izvjesno ponudili drugačije izborne liste, prilagođene tim novim pravilima.

Osim toga, Visoki predstavnik je izvršio i izravan udar na demokraciju u Bosni i Hercegovini, što je obveza iz Ustava BiH, na način da je doveo u zabludu sve glasače u njihovoj namjeri da svojim glasom izaberu svoje izabrane predstavnike u zakonodavne organe vlasti koje su željeli, posebno u domove naroda koji se biraju indirektno kroz kantonalne skupštine.

Svojom odlukom da se koriste dva različita popisa, jedan za formiranje zakonodavnog organa vlasti i drugi popis za formiranje izvršnih organa vlasti u bh. entitetu Federacija Bosne i Hercegovine, Visoki predstavnik je učinio neviđen i nezapamćen presedan i doveo sve građane Bosne i Hercegovine u stanje pravne nesigurnosti.

Posebno iz razloga, što je uvođenjem "posljednjeg popisa" ili onoga iz 2013. godine, neformalno proglasio okončanim Aneks 7 Daytonskog mirovnog sporazuma ili povratak svih prognanih u svoje prijeratne domove, čime je ušao u veoma opasan i delikatan prostor eventualnog prihvaćanja rezultata etničkog čišćenja. Osim toga, Visoki predstavnik je svojom odlukom umanjio stupanj ranije dosegnutih prava građana BiH, što je također neprihvatljivo i pravno nemoguće.

Najzad, svojom formulom 1, 3, 5, 7, 9… (što je zapravo Sainte-Lague metoda za dodjelu mandata i ne može se koristiti za druge svrhe) koja služi za izračun količnika ili koeficijenta brojnosti delegata u klubovima konstituentnih naroda u Domu naroda Federacije Bosne i Hercegovine, Visoki predstavnik je učinio formaliziranje diskriminacije na najgori mogući način, jer bi u tom novom sistemu građani Bosne i Hercegovine, kao osobe imali veću ili manju vlastitu osobnu vrijednost, ovisno o mjestu prebivališta.

To su sve razlozi za podnošenje zahtjeva Ustavnom sudu Bosne i Hercegovine za ocjenu ustavnosti ovih nametnutih odluka Visokog predstavnika od 2. listopada 2022.  s prijedlogom privremene mjere, kao i slanja odgovarajućeg pisma Centralnoj izbornoj komisiji da ne vrši dodjelu mandata na temelju odluka Visokog predstavnika, sve dok Ustavni sud Bosne i Hercegovine ne obavi svoj postupak i odluči o ustavnosti spomenutih odluka Visokog predstavnika - poručuju javnosti iz kabineta Željka Komšića.

Komšić ruši Schmidtovu odluku koja ide na ruku zastupljenosti Hrvata u BiH: ‘To je prijevara birača, udar na demokraciju, izborni proces i neviđen presedan!‘

Stupanjem na snagu izmjena Ustava Federacije Bosne i Hercegovine i Izbornog zakona Bosne i Hercegovine, prema nametnutim odlukama Visokog predstavnika, koje su u značajnom dijelu neustavne, stvorilo je obavezu da se putem zahtjeva Ustavnom sudu BiH takve neustavne odluke stave izvan snage, priopćio je član Predsjedništva BiH Željko Komšić.

Komšić kaže da je posebno zabrinjavajuće da svojom nametnutom odlukom Visoki predstavnik krši ranije donesene odluke Ustavnog suda Bosne i Hercegovine, a time i sam Ustav BiH.

- Visoki predstavnik je svojim nametnutim odlukama, u noći kada je obavljeno glasanje građana Bosne i Hercegovine, izvršio izravan udar na integritet izbornog procesa tako što je izvršio prijevaru birača, koji bi eventualno drugačije glasali da su znali za nova izborn...
