Svaki put kad pomislimo da je dosegnuo dno, i da ispod toga više ne može ići, predsjednik Republike nas iznenadi. I zaroni još dublje.

Tako je bilo i ovaj put. Napričao je Zoran Milanović posljednjih godinu dana popriličnu količinu budalaština. Od toga da Putin neće napasti Ukrajinu – nakon čega je ruski hazjajin naredio opću invaziju na susjednu državu. Do toga da se ruska čizma tamo gdje stane ne povlači, na što je ruska vojska odlučila propisno se obrukati kod Harkiva, kasnije i Hersona. Protivio se sankcijama protiv Moskve, pokušavao staviti veto na ulazak Finske i Švedske u NATO, tvrdio da “nije budala koja će pljeskati Ukrajincima”, šurovao s Putinovim pijunom u BiH Miloradom Dodikom.

Kap koja je prelila čašu

A nakon toga uslijedilo je novo dno. Ovih dana tako je izrijekom ustvrdio da je Kosovo “anektirano” od Srbije. I da Ukrajince, umjesto da se brane od agresije, treba natjerati da pregovaraju s Rusima.

Milanovićev najnoviji istup bio je kap koja je prelila čašu. Niz oporbenih stranaka koje su do sada više ili manje otvoreno držale stranu predsjedniku Republike javno su se ogradile od njegovih stavova oko Ukrajine i Kosova.

Znači li to da je Milanović na pragu opoziva?

Ne. Procedura za smjenu izravno izabranog predsjednika Republike nije jednostavna. I treba uključivati dvije važne pretpostavke: da je Milanović svojim ponašanjem prekršio Ustav, te da njegov opoziv žele podržati oporbene stranke. U prvom redu SDP ili Most.

Ustavnopravni stručnjak prof. dr. Mato Palić u izjavi za Slobodnu Dalmaciju objašnjava koja je procedura propisana Ustavom za pokretanje opoziva predsjednika Republike.

– Proceduru opoziva može pokrenuti jedna petina zastupnika u Hrvatskom saboru. Oni su dužni navesti razloge za opoziv i obrazložiti ih. To se onda dostavlja predsjedniku RH na očitovanje. O utemeljenosti tih tvrdnji očituje se i Odbor za Ustav, Poslovnik i politički sustav kao radno tijelo Hrvatskog sabora. Kad se predsjednik Republike očituje, onda Hrvatski sabor dvotrećinskom većinom glasova svih zastupnika, dakle najmanje 101, podnosi Ustavnom sudu RH zahtjev za utvrđivanje odgovornosti predsjednika za povredu Ustava u obnašanju dužnosti – objašnjava Palić. Pritom napominje da se predsjednika Republike može opozvati samo ako se dokaže da je povrijedio Ustav u obnašanju dužnosti.

Iznošenje dubioznih stavova može nanijeti štetu hrvatskim nacionalnim interesima, ali ne mora ujedno značiti i kršenje Ustava.

– Kad Ustavni sud primi taj zahtjev, u roku od 30 dana mora donijeti odluku. Da bi se odluka o opozivu donijela, za nju mora glasati dvije trećine sudaca Ustavnog suda. Od njih 13 za opoziv treba glasati njih devet. Ako se to dogodi, predsjedniku države prestaje dužnost po sili Ustava i ide se na izvanredne izbore – ističe Palić. U tom intermezzu između opoziva i novih izbora, predsjednika Republike privremeno zamjenjuje predsjednik Sabora.

Odnos snaga u Saboru

Odnos snaga u parlamentu u ovom je trenutku takav da nije realno očekivati da oporba – bilo desna bilo lijeva – podrži Milanovićev opoziv. Sve dok on javno napada HDZ i Andreja Plenkovića, oni će ga smatrati svojim saveznikom. Koliko god bili svjesni da su neki njegovi stavovi “uvrnuti”, a diskurs pogrešan.

Član Odbora za Ustav, Poslovnik i politički sustav Arsen Bauk potvrdio nam je da SDP neće podržati nikakvu inicijativu za Milanovićev opoziv. Za to nisu, navodi Bauk, stvorene ni ustavne ni političke pretpostavke.

– SDP će podržati opoziv predsjednika Vlade, izvjesnog AP – u svojem je stilu dometnuo Bauk.

Nikola Grmoja tvrdi da ni Most ne planira podržati inicijativu za Milanovićevim opozivom.

– Predsjednik Republike izravno je izabran na izborima i doista bi bilo neviđeno da ga opoziva Sabor. Ni ja se ne slažem s njegovim najnovijim stavovima i to sam jasno rekao, no predsjednik ima izravan legitimitet, za razliku od saborskih zastupnika, koji su izabrani na listama – ističe Grmoja u izjavi za Slobodnu Dalmaciju. Što se tiče samoga opoziva, takva bi inicijativa trebala, prema njegovim riječima, biti itekako dobro utemeljena.

– Tu se ne bi trebalo raditi o nekim njegovim izjavama i “filipikama”, nego doista o ozbiljnom kršenju Ustava – zaključuje Grmoja.

Svaki put kad pomislimo da je dosegnuo dno, i da ispod toga više ne može ići, predsjednik Republike nas iznenadi. I zaroni još dublje.

Tako je bilo i ovaj put. Napričao je Zoran Milanović posljednjih godinu dana popriličnu količinu budalaština. Od toga da Putin neće napasti Ukrajinu – nakon čega je ruski hazjajin naredio opću invaziju na susjednu državu. Do toga da se ruska čizma tamo gdje stane ne povlači, na što je ruska vojska odlučila propisno se obrukati kod Harkiva, kasnije i Hersona. Protivio se sankcijama protiv Moskve, pokušavao staviti veto na ulazak Finske i Švedske u NATO, tvrdio da “nije budala koja će pljeskati Ukrajincima”, šurovao s Putinovim pijunom u BiH Miloradom Dodikom.

Kap koja je prelila čašu

A nakon toga uslijedilo je novo dno. Ovih dana tako je izrijekom ustvrdio da je Kosovo “anektirano” od Srbije. I da Ukrajince, umjesto da se brane od agresije, treba natjerati da pregovaraju s Rusima.

Milanovićev najnoviji istup bio je kap koja je prelila čašu. Niz oporbenih stranaka koje su do sada više ili manje otvoreno držale stranu predsjedniku Republike javno su se ogradile od njegovih stavova oko Ukrajine i Kosova.

Znači li to da je Milanović na pragu opoziva?

Ne. Procedura za smjenu izravno izabranog predsjednika Republike nije jednostavna. I treba uključivati dvije važne pretpostavke: da je Milanović svojim ponašanjem prekršio Ustav, te da njegov opoziv žele podržati oporbene stranke. U prvom redu SDP ili Most.

Ustavnopravni stručnjak prof. dr. Mato Palić u izjavi za Slobodnu Dalmaciju objašnjava koja je procedura propisana Ustavom za pokretanje opoziva predsjednika Republike.

– Proceduru opoziva može pokrenuti jedna petina zastupnika u Hrvatskom saboru. Oni su dužni navesti razloge za opoziv i obrazložiti ih. To se onda dostavlja predsjedniku RH na očitovanje. O utemeljenosti tih tvrdnji očituje se i Odbor za Ustav, Poslovnik i politički sustav kao radno tijelo Hrvatskog sabora. Kad se predsjednik Republike očituje, onda Hrvatski sabor dvotrećinskom većinom glasova svih zastupnika, dakle najmanje 101, podnosi Ustavnom sudu RH zahtjev za utvrđivanje odgovornosti predsjednika za povredu Ustava u obnašanju dužnosti – objašnjava Palić. Pritom napominje da se predsjednika Republike može opozvati samo ako se dokaže da je povrijedio Ustav u obnašanju dužnosti.

Iznošenje dubioznih stavova može nanijeti štetu hrvatskim nacionalnim interesima, ali ne mora ujedno značiti i kršenje Ustava.

– Kad Ustavni sud primi taj zahtjev, u roku od 30 dana mora donijeti odluku. Da bi se odluka o opozivu donijela, za nju mora glasati dvije trećine sudaca Ustavnog suda. Od njih 13 za opoziv treba glasati njih devet. Ako se to dogodi, predsjedniku države prestaje dužnost po sili Ustava i ide se na izvanredne izbore – ističe Palić. U tom intermezzu između opoziva i novih izbora, predsjednika Republike privremeno zamjenjuje predsjednik Sabora.

Odnos snaga u Saboru

Odnos snaga u parlamentu u ovom je trenutku takav da nije realno očekivati da oporba – bilo desna bilo lijeva – podrži Milanovićev opoziv. Sve dok on javno napada HDZ i Andreja Plenkovića, oni će ga smatrati svojim saveznikom. Koliko god bili svjesni da su neki njegovi stavovi “uvrnuti”, a diskurs pogrešan.

Član Odbora za Ustav, Poslovnik i politički sustav Arsen Bauk potvrdio nam je da SDP neće podržati nikakvu inicijativu za Milanovićev opoziv. Za to nisu, navodi Bauk, stvorene ni ustavne ni političke pretpostavke.

– SDP će podržati opoziv predsjednika Vlade, izvjesnog AP – u svojem je stilu dometnuo Bauk.

Nikola Grmoja tvrdi da ni Most ne planira podržati inicijativu za Milanovićevim opozivom.

– Predsjednik Republike izravno je izabran na izborima i doista bi bilo neviđeno da ga opoziva Sabor. Ni ja se ne slažem s njegovim najnovijim stavovima i to sam jasno rekao, no predsjednik ima izravan legitimitet, za razliku od saborskih zastupnika, koji su izabrani na listama – ističe Grmoja u izjavi za Slobodnu Dalmaciju. Što se tiče samoga opoziva, takva bi inicijativa trebala, prema njegovim riječima, biti itekako dobro utemeljena.

– Tu se ne bi trebalo raditi o nekim njegovim izjavama i “filipikama”, nego doista o ozbiljnom kršenju Ustava – zaključuje Grmoja.
