Veliku pobjedu nad Saborom i Vladom odnijela je sudačka struka i sada 1700 sudaca u Hrvatskoj više ne mora strepiti da će ih svakih pet godina sigurnosno provjeravati Sigurnosno-obavještajna agencija (SOA) kako bi uopće mogli živjeti i raditi.

Niti godinu dana tako nije izdržala novela Zakon o sudovima gdje se u članku 86A baš definirala takva odredba o sigurnosnoj provjeri sudaca, koju je na prijedlog Vlade izglasao Hrvatski sabor 11. veljače 2022. godine. Do toga je došlo nakon afere s osječkim sucima koje je Zdravko Mamić prozvao za korupciju, a temelj sigurnosne provjere svakih pet godina po zakonodavcu je bila loša percepcija pravosuđa u očima građana i javnosti.

Sucima osobit položaj

Ustavni sud je 7. veljače ukinuo taj članak Zakona o sudovima naglasivši da je proklamirani zakonodavni cilj "popravljanja" loše javne percepcije pravosuđa uvođenjem periodičnih sigurnosnih provjera svih sudaca upitne legitimnosti.

Sud tvrdi da mjera kojom bi taj cilj imao biti ostvaren nije opravdana ni jednim argumentom nužnosti i razmjernosti.

U pravnom poretku Republike Hrvatske i drugih uređenih demokracija sucima pripada osobit položaj, koji se mora, prije svega, promatrati u svjetlu njihove Ustavom zajamčene samostalnosti, neovisnosti i nepristranosti, navodi sud.

Podsjećaju da su sigurnosne provjere 2010. određene za tzv. "uskočke" suce, a zatim je 2015. određeno provođenje sigurnosnih provjera kandidata za pravosudne dužnosti koji po prvi put ulaze u sustav.

Odvjetnik Dejan Uljarević iz Zagreba je prvi po unošenju ovog članka u Zakon podnio prijedlog za ocjenu suglasnosti i ovog zakona s Ustavom. Bilo je to 11. travnja prošle godine, da bi mjesec dana poslije to isto učinila i Udruga hrvatskih sudaca zastupana po njihovom predsjedniku Damiru Kontrecu, kao i Vrhovni sud zastupan po svom predsjedniku mr. sc. Radovanu Dobroniću.

Naš sugovornik Damir Kontrec, predsjednik Udruge hrvatskih sudaca i predsjednik Građanskog odjela Vrhovnog suda, kaže nam da je i očekivao ovakvu odluku Ustavnog suda.

– Svi naši članovi su to očekivali, a do ovoga svega nije ni trebalo doći da je naše Ministarstvo pravosuđa kao zakonodavac poslušalo preporuke Venecijanske komisije da to ne čine jer za takvu odluku nema potrebe, suprotna je europskoj praksi i neovisnosti sudstva. Baš se to ministarstvo obratilo Komisiji čiji su članovi bili u Zagrebu u veljači prošle godine i iznijeli su svoje preporuke i mišljenja, ali se požurilo s donošenjem Zakona mimo te suglasnosti – objašnjava Kontrec.

Kodeks sudačke etike

Za neupućene red je navesti da je Venecijanska komisija savjetodavno tijelo Vijeća Europe, međunarodne asocijacije koje čini ukupno 47 europskih i susjednih zemalja. Puno službeno ime tog savjetodavnog tijela je "Europska komisija za demokraciju putem prava", a bavi se ustavnim pitanjima, izbornim pitanjima i općenito djelovanjem demokratskih ustanova.

– Zakon o sudovima, usvojen 2013. godine, sasvim je dobro definirao ovo pitanje i nama je bilo neprihvatljivo kao Udruzi hrvatskih sudaca da se na osnovu percepcije javnosti o lošem stanju u pravosuđu i nepovjerenju građana u njega donosi ovakav zakon.

Istina, bile su afere sa sucima, ali zar nisu bile i afere u drugim sektorima rada državnog sustava, pa se nigdje nije donosio zakon da se sve ljude koji tu rade kontrolira svakih pet godina?

U našem sudačkom poslu postoji stegovna i kaznena odgovornost, kao i Kodeks sudačke etike, i mislim da smo dovoljno kontrolirani sa svih razina, pa je uistinu uvođenje sigurnosne provjere svakog suca nakon pet godina bilo nepotrebno. U konačnici, što se sada pokazalo, i neustavno – zaključio je Kontrec.

Veliku pobjedu nad Saborom i Vladom odnijela je sudačka struka i sada 1700 sudaca u Hrvatskoj više ne mora strepiti da će ih svakih pet godina sigurnosno provjeravati Sigurnosno-obavještajna agencija (SOA) kako bi uopće mogli živjeti i raditi.

Niti godinu dana tako nije izdržala novela Zakon o sudovima gdje se u članku 86A baš definirala takva odredba o sigurnosnoj provjeri sudaca, koju je na prijedlog Vlade izglasao Hrvatski sabor 11. veljače 2022. godine. Do toga je došlo nakon afere s osječkim sucima koje je Zdravko Mamić prozvao za korupciju, a temelj sigurnosne provjere svakih pet godina po zakonodavcu je bila loša percepcija pravosuđa u očima građana i javnosti.

Sucima osobit položaj

Ustavni sud je 7. veljače ukinuo taj članak Zakona o sudovima naglasivši da je proklamirani zakonodavni cilj "popravljanja" loše javne percepcije pravosuđa uvođenjem periodičnih sigurnosnih provjera svih sudaca upitne legitimnosti.

Sud tvrdi da mjera kojom bi taj cilj imao biti ostvaren nije opravdana ni jednim argumentom nužnosti i razmjernosti.

U pravnom poretku Republike Hrvatske i drugih uređenih demokracija sucima pripada osobit položaj, koji se mora, prije svega, promatrati u svjetlu njihove Ustavom zajamčene samostalnosti, neovisnosti i nepristranosti, navodi sud.

Podsjećaju da su sigurnosne provjere 2010. određene za tzv. "uskočke" suce, a zatim je 2015. određeno provođenje sigurnosnih provjera kandidata za pravosudne dužnosti koji po prvi put ulaze u sustav.

Odvjetnik Dejan Uljarević iz Zagreba je prvi po unošenju ovog članka u Zakon podnio prijedlog za ocjenu suglasnosti i ovog zakona s Ustavom. Bilo je to 11. travnja prošle godine, da bi mjesec dana poslije to isto učinila i Udruga hrvatskih sudaca zastupana po njihovom predsjedniku Damiru Kontrecu, kao i Vrhovni sud zastupan po svom predsjedniku mr. sc. Radovanu Dobroniću.

Naš sugovornik Damir Kontrec, predsjednik Udruge hrvatskih sudaca i predsjednik Građanskog odjela Vrhovnog suda, kaže nam da je i očekivao ovakvu odluku Ustavnog suda.

– Svi naši članovi su to očekivali, a do ovoga svega nije ni trebalo doći da je naše Ministarstvo pravosuđa kao zakonodavac poslušalo preporuke Venecijanske komisije da to ne čine jer za takvu odluku nema potrebe, suprotna je europskoj praksi i neovisnosti sudstva. Baš se to ministarstvo obratilo Komisiji čiji su članovi bili u Zagrebu u veljači prošle godine i iznijeli su svoje preporuke i mišljenja, ali se požurilo s donošenjem Zakona mimo te suglasnosti – objašnjava Kontrec.

Kodeks sudačke etike

Za neupućene red je navesti da je Venecijanska komisija savjetodavno tijelo Vijeća Europe, međunarodne asocijacije koje čini ukupno 47 europskih i susjednih zemalja. Puno službeno ime tog savjetodavnog tijela je "Europska komisija za demokraciju putem prava", a bavi se ustavnim pitanjima, izbornim pitanjima i općenito djelovanjem demokratskih ustanova.

– Zakon o sudovima, usvojen 2013. godine, sasvim je dobro definirao ovo pitanje i nama je bilo neprihvatljivo kao Udruzi hrvatskih sudaca da se na osnovu percepcije javnosti o lošem stanju u pravosuđu i nepovjerenju građana u njega donosi ovakav zakon.

Istina, bile su afere sa sucima, ali zar nisu bile i afere u drugim sektorima rada državnog sustava, pa se nigdje nije donosio zakon da se sve ljude koji tu rade kontrolira svakih pet godina?

U našem sudačkom poslu postoji stegovna i kaznena odgovornost, kao i Kodeks sudačke etike, i mislim da smo dovoljno kontrolirani sa svih razina, pa je uistinu uvođenje sigurnosne provjere svakog suca nakon pet godina bilo nepotrebno. U konačnici, što se sada pokazalo, i neustavno – zaključio je Kontrec.
