Bivši ministar unutarnjih poslova i aktualni gradonačelnik Virovitice Ivica Kirin oslobođen je optužbi u aferi Fimi Media, potvrdio je Vrhovni sud bez navođenja imena oslobođene osobe.

“Vrhovni je sud donio presudu kojom je odbio žalbu USKOK-a i potvrdio prvostupanjsku presudu Županijskog suda u Zagrebu. Time je postala pravomoćna presuda kojom je optuženik oslobođen optužbe da bi počinio kazneno djelo zlouporabe položaja i ovlasti”, objavio je sud.

Obrazlažu kako se otpuženik teretio da je od 2006. do 2008. kao ministar naložio stručnim službama svog ministarstva da poslove dvije promidžbene kampanje ugovore s trgovačkim društvom (Fimi Media op.a.), prenosi tportal.

Stavljalo mu se na teret da je znao je da se poslovanjem tog društva prikupljaju sredstva za potrebe financiranja političke stranke i da će takvim poslom ministarstvu nastupiti šteta velikih razmjera. Teretio se da je, radi osiguranja poslova tom društvu, imenovao stručno povjerenstvo ministarstva za pripremu i provedbu postupka javne nabave usluga. Za obje promidžbene kampanje odredio je da se provede izravna pogodba.

“Naložio je u oba navrata da se poziv za javnu nabavu uputi samo tom trgovačkom društvu i društvima s kojima to društvo poslovno surađuje. Prema optužnici na oba se poziva javilo samo to trgovačko društvo. Za prvu kampanju trgovačko je društvo s ministarstvom zaključio ugovor vrijedan 958.565,00 kuna. Taj je iznos ministarstvo u cijelosti platilo. Prema optužnici dogovorene usluge su se mogle napraviti za 143.382,80 kuna manje troška”, objavio je Vrhovni sud.

Za drugu promidžbenu kampanju optuženik se teretio da je naložio da se ponuda društva prihvati bez obzira na uvjete i unatoč tomu što je znao da bi se pregovorom s TV kućama ishodilo popust. Ministarstvo je s društvom zaključilo ugovor vrijednosti 16.123.977,50 kuna i taj iznos u cijelosti platilo, premda je te iste usluge moglo nabaviti za 5.920.174,73 kune.

“Vrhovni sud Republike Hrvatske smatra da je prvostupanjski sud pravilno zaključio da nije dokazano da je optuženik nezakonito postupao s ciljem da zlouporabom svog položaja osigura posao tom trgovačkom društvu, a ministarstvu prouzroči štetu. Radnjama za koje se optuženik tereti da ih je naređivao nije prouzročena nikakva šteta ministarstvu”, kaže se u presudi.

Bivši ministar unutarnjih poslova i aktualni gradonačelnik Virovitice Ivica Kirin oslobođen je optužbi u aferi Fimi Media, potvrdio je Vrhovni sud bez navođenja imena oslobođene osobe.

“Vrhovni je sud donio presudu kojom je odbio žalbu USKOK-a i potvrdio prvostupanjsku presudu Županijskog suda u Zagrebu. Time je postala pravomoćna presuda kojom je optuženik oslobođen optužbe da bi počinio kazneno djelo zlouporabe položaja i ovlasti”, objavio je sud.

Obrazlažu kako se otpuženik teretio da je od 2006. do 2008. kao ministar naložio stručnim službama svog ministarstva da poslove dvije promidžbene kampanje ugovore s trgovačkim društvom (Fimi Media op.a.), prenosi tportal.

Stavljalo mu se na teret da je znao je da se poslovanjem tog društva prikupljaju sredstva za potrebe financiranja političke stranke i da će takvim poslom ministarstvu nastupiti šteta velikih razmjera. Teretio se da je, radi osiguranja poslova tom društvu, imenovao stručno povjerenstvo ministarstva za pripremu i provedbu postupka javne nabave usluga. Za obje promidžbene kampanje odredio je da se provede izravna pogodba.

“Naložio je u oba navrata da se poziv za javnu nabavu uputi samo tom trgovačkom društvu i društvima s kojima to društvo poslovno surađuje. Prema optužnici na oba se poziva javilo samo to trgovačko društvo. Za prvu kampanju trgovačko je društvo s ministarstvom zaključio ugovor vrijedan 958.565,00 kuna. Taj je iznos ministarstvo u cijelosti platilo. Prema optužnici dogovorene usluge su se mogle napraviti za 143.382,80 kuna manje troška”, objavio je Vrhovni sud.

Za drugu promidžbenu kampanju optuženik se teretio da je naložio da se ponuda društva prihvati bez obzira na uvjete i unatoč tomu što je znao da bi se pregovorom s TV kućama ishodilo popust. Ministarstvo je s društvom zaključilo ugovor vrijednosti 16.123.977,50 kuna i taj iznos u cijelosti platilo, premda je te iste usluge moglo nabaviti za 5.920.174,73 kune.

“Vrhovni sud Republike Hrvatske smatra da je prvostupanjski sud pravilno zaključio da nije dokazano da je optuženik nezakonito postupao s ciljem da zlouporabom svog položaja osigura posao tom trgovačkom društvu, a ministarstvu prouzroči štetu. Radnjama za koje se optuženik tereti da ih je naređivao nije prouzročena nikakva šteta ministarstvu”, kaže se u presudi.

Vrhovni sud potvrdio oslobađajuću presudu bivšem ministru unutarnjih poslova Ivici Kirinu: oslobođen je optužbi u aferi Fimi Media

Bivši ministar unutarnjih poslova i aktualni gradonačelnik Virovitice Ivica Kirin oslobođen je optužbi u aferi Fimi Media, potvrdio je Vrhovni sud bez navođenja imena oslobođene osobe.

“Vrhovni je sud donio presudu kojom je odbio žalbu USKOK-a i potvrdio prvostupanjsku presudu Županijskog suda u Zagrebu. Time je postala pravomoćna presuda kojom je optuženik oslobođen optužbe da bi počinio kazneno djelo zlouporabe položaja i ovlasti”, objavio je sud.

Obrazlažu kako se otpuženik teretio da je od 2006. do 2008. kao ministar naložio stručnim službama svog ministarstva da poslove dvije promidžbene kampanje ugovore s trgovačkim društvom (Fimi Media op.a.), prenosi tportal.
