Udruga Franak u četvrtak je pozvala vladu i sabor da predložene izmjene Ovršnog zakona "pojačaju" mjerama kojima bi se omogućilo smanjenje troškova ovršnog postupka za sve potrošače ovršenike, kao i spriječile nezakonite ovrhe, u cilju čega su iznijeli i četiri zahtjeva.
U otvorenom pismu pozdravili su "određene pomake nabolje" u prijedlogu izmjena Ovršnog zakona, no smatraju ih nedovoljnim, dodajući da hrvatsko pravo i pravo EU-a omogućuju da se ostvare daleko veći pomaci nabolje.
Tako pozivaju vladu da amandmanima dodatno zaštiti ovršenike od prekomjernih troškova i nezakonitih ovrha, a prvi prijedlog odnosno zahtjev se odnosi na izričitu zabranu ovrha nekretnina koje su opterećene hipotekama iz nepoštenih kredita, a na temelju presude Suda EU-a.
Predloženim izmjenama djelomično je prihvaćena intencija te presude, pa je omogućeno da se ovrha nekretnine odgodi na maksimalno 30 dana do podnošenja tužbe za nedopuštenost ovrhe, ako postoji vjerojatna ništetnost ugovornih odredaba.
No iz Franka smatraju da intencija presude C-407/18 nije time potpuno usvojena.
Naime, ukoliko postoje ništetne ugovorne odredbe u ugovoru na temelju kojega se ovrha provodi, onda se ovrha mora odgoditi sve dok se ne razriješi prije svega pitanje restitucije zbog nepoštenih odredaba. Budući da imamo u Hrvatskoj 125 tisuća ugovorenih CHF kredita, svaki takav kredit sadrži najmanje dvije nepoštene ugovorne odredbe, a to su odredbe o valuti i kamati, o predmetu i cijeni, pojašnjavaju iz Franka.
Tako imamo već i pravomoćno utvrđenje ništetnosti dvaju takvih ugovora. U skladu s presudom C-407/18 potrebno je izričito zabraniti ovrhu nekretnine za svaki takav kredit sve dok se ne utvrdi koliko novca banka mora vratiti potrošaču zajedno sa zateznim kamatama te je tek po utvrđenju stvarnoga stanja duga moguće pokrenuti ovrhu nekretnine ako bi i nakon toga potrošač imao dugovanje veće od 40 tisuća kuna koje ne bi nikako mogao namiriti, naveli su iz Udruge Franak u otvorenom pismu.
Nadalje, zahtijevaju da se propiše da veliki trgovci s velikim prihodima, primjerice većim od tri milijuna kuna godišnje, nemaju pravo naplaćivati troškove odvjetnika od potrošača ovršenika, ako su za pokretanje ovrhe koristili odvjetničke usluge, nego da u tome slučaju taj trošak sami snose.
Takva odredba odnosila bi se na sve odvjetničke troškove nastale prije pokretanja sudske parnice, a u slučaju pokretanja sudske parnice za proglašenje ovrhe nedopuštenom, troškove bi platio onaj tko je parnicu izgubio, pojašnavaju.
Treći zahtjev se odnosi na donošenje propisa koji bi regulirao da se kod naplate dugova od potrošača najprije naplaćuje trošak, potom glavnica i tek na kraju zatezna kamata.
Takva odredba mogla bi i trebala bi imati retroaktivno djelovanje na sve aktivne ovrhe koje još uvijek nisu ostvarene do kraja, dodaju iz Franka.
Naposljetku, zahtijevaju da se propiše kako zatezna kamata ne smije prijeći visinu glavnice, također samo u slučaju potrošačkih ovrha.
Iz Udruge Franak su uvjereni da su njihovi prijedlozi realni i ostvarivi te da bi se njihovim usvajanjem itekako olakšao položaj ovršenika potrošača, koji su u posebno teškom položaju za vrijeme aktualne zdravstvene krize.
Izmjene Ovršnog zakona su ovaj tjedan predstavljene i raspravljene u Saboru, o njima bi se trebalo glasovati sutra, a na snagu bi trebale stupiti 1. prosinca.
Ministar pravosuđa i uprave Ivan Malenica u utorak je u Saboru poručio da se izmjenama i dopunama Ovršnog zakona štiti dostojanstvo dužnosnika, te uspostavlja ravnoteža između ovršenika i vjerovnika.
Ustvrdio je da će se izmjenama uravnotežiti i unaprijediti postojeći sustav, da će se postupci provoditi brže, jeftinije i ekonomičnije, istovremeno štiteći prava ovršenika i vjerovnika.
Između ostalog, novine zakona su da se troškovi postupka smanjuju jer više neće biti troška izdavanja potvrde o pravomoćnosti i ovršnosti. Ona se više ne bi izdavala na zahtjev ovrhovoditelja, već ju javni bilježnik izdaje ako u roku 15 dana od isteka roka za prigovor ne zaprimi prigovor ovršenika.
Uvodi se i institut prethodne obavijesti, koju će dužniku upućivati javni bilježnici, te će dužnik moći ispuniti svoje obveze u roku 15 dana. Deložacije se neće provoditi od 1. studenog do 1. travnja, a povećava se i iznos glavnice za koju se ovrha nad nekretninom ne može pokrenuti s 20.000 kuna na 40.000 kuna.
Krug primanja izuzetih od ovrhe proširuje se i na božićnice, uskrsnice, regres i ostale novčane prigodne nagrade, kao i na naknadu za topli obrok.

Udruga Franak u četvrtak je pozvala vladu i sabor da predložene izmjene Ovršnog zakona "pojačaju" mjerama kojima bi se omogućilo smanjenje troškova ovršnog postupka za sve potrošače ovršenike, kao i spriječile nezakonite ovrhe, u cilju čega su iznijeli i četiri zahtjeva.
U otvorenom pismu pozdravili su "određene pomake nabolje" u prijedlogu izmjena Ovršnog zakona, no smatraju ih nedovoljnim, dodajući da hrvatsko pravo i pravo EU-a omogućuju da se ostvare daleko veći pomaci nabolje.
Tako pozivaju vladu da amandmanima dodatno zaštiti ovršenike od prekomjernih troškova i nezakonitih ovrha, a prvi prijedlog odnosno zahtjev se odnosi na izričitu zabranu ovrha nekretnina koje su opterećene hipotekama iz nepoštenih kredita, a na temelju presude Suda EU-a.
Predloženim izmjenama djelomično je prihvaćena intencija te presude, pa je omogućeno da se ovrha nekretnine odgodi na maksimalno 30 dana do podnošenja tužbe za nedopuštenost ovrhe, ako postoji vjerojatna ništetnost ugovornih odredaba.
No iz Franka smatraju da intencija presude C-407/18 nije time potpuno usvojena.
Naime, ukoliko postoje ništetne ugovorne odredbe u ugovoru na temelju kojega se ovrha provodi, onda se ovrha mora odgoditi sve dok se ne razriješi prije svega pitanje restitucije zbog nepoštenih odredaba. Budući da imamo u Hrvatskoj 125 tisuća ugovorenih CHF kredita, svaki takav kredit sadrži najmanje dvije nepoštene ugovorne odredbe, a to su odredbe o valuti i kamati, o predmetu i cijeni, pojašnjavaju iz Franka.
Tako imamo već i pravomoćno utvrđenje ništetnosti dvaju takvih ugovora. U skladu s presudom C-407/18 potrebno je izričito zabraniti ovrhu nekretnine za svaki takav kredit sve dok se ne utvrdi koliko novca banka mora vratiti potrošaču zajedno sa zateznim kamatama te je tek po utvrđenju stvarnoga stanja duga moguće pokrenuti ovrhu nekretnine ako bi i nakon toga potrošač imao dugovanje veće od 40 tisuća kuna koje ne bi nikako mogao namiriti, naveli su iz Udruge Franak u otvorenom pismu.
Nadalje, zahtijevaju da se propiše da veliki trgovci s velikim prihodima, primjerice većim od tri milijuna kuna godišnje, nemaju pravo naplaćivati troškove odvjetnika od potrošača ovršenika, ako su za pokretanje ovrhe koristili odvjetničke usluge, nego da u tome slučaju taj trošak sami snose.
Takva odredba odnosila bi se na sve odvjetničke troškove nastale prije pokretanja sudske parnice, a u slučaju pokretanja sudske parnice za proglašenje ovrhe nedopuštenom, troškove bi platio onaj tko je parnicu izgubio, pojašnavaju.
Treći zahtjev se odnosi na donošenje propisa koji bi regulirao da se kod naplate dugova od potrošača najprije naplaćuje trošak, potom glavnica i tek na kraju zatezna kamata.
Takva odredba mogla bi i trebala bi imati retroaktivno djelovanje na sve aktivne ovrhe koje još uvijek nisu ostvarene do kraja, dodaju iz Franka.
Naposljetku, zahtijevaju da se propiše kako zatezna kamata ne smije prijeći visinu glavnice, također samo u slučaju potrošačkih ovrha.
Iz Udruge Franak su uvjereni da su njihovi prijedlozi realni i ostvarivi te da bi se njihovim usvajanjem itekako olakšao položaj ovršenika potrošača, koji su u posebno teškom položaju za vrijeme aktualne zdravstvene krize.
Izmjene Ovršnog zakona su ovaj tjedan predstavljene i raspravljene u Saboru, o njima bi se trebalo glasovati sutra, a na snagu bi trebale stupiti 1. prosinca.
Ministar pravosuđa i uprave Ivan Malenica u utorak je u Saboru poručio da se izmjenama i dopunama Ovršnog zakona štiti dostojanstvo dužnosnika, te uspostavlja ravnoteža između ovršenika i vjerovnika.
Ustvrdio je da će se izmjenama uravnotežiti i unaprijediti postojeći sustav, da će se postupci provoditi brže, jeftinije i ekonomičnije, istovremeno štiteći prava ovršenika i vjerovnika.
Između ostalog, novine zakona su da se troškovi postupka smanjuju jer više neće biti troška izdavanja potvrde o pravomoćnosti i ovršnosti. Ona se više ne bi izdavala na zahtjev ovrhovoditelja, već ju javni bilježnik izdaje ako u roku 15 dana od isteka roka za prigovor ne zaprimi prigovor ovršenika.
Uvodi se i institut prethodne obavijesti, koju će dužniku upućivati javni bilježnici, te će dužnik moći ispuniti svoje obveze u roku 15 dana. Deložacije se neće provoditi od 1. studenog do 1. travnja, a povećava se i iznos glavnice za koju se ovrha nad nekretninom ne može pokrenuti s 20.000 kuna na 40.000 kuna.
Krug primanja izuzetih od ovrhe proširuje se i na božićnice, uskrsnice, regres i ostale novčane prigodne nagrade, kao i na naknadu za topli obrok.
