Zadarski Županijski sud potvrdio je 23. travnja 2020. pravomoćnost pozitivne presude Općinskoga suda u Vukovaru za jedan konvertirani kredit. Ta presuda potvrđuje da konverzije nisu prepreke za obeštećenje, kao što je to već utvrđeno na Sudu EU presudom C-118/17, Dunai, izvijestili su iz udruge Franak.

Zastupnica tužitelja bila je odvjetnica Martina Alagić iz Vukovara, prvostupanjsku presudu donio je vukovarski sudac Ivica Grubišić te je pravomoćnost potvrdila zadarska sutkinja Marina Tanta.

Kako je navedeno u objavi udruge Franak, presudom je potvrđeno da PBZ mora vratiti 46.000 kn preplaćenih anuiteta i platiti zatezne kamate, što znači da ukupno mora tužitelju platiti oko 90.000 kuna te da mora platiti još i 12.000 kuna sudskih troškova.

Presudom iz Vukovara, koja je potvrđena na Županijskom sudu u Zadru utvrđeno je da nije potrebno provoditi dokazni postupak, jer se na konkretnu tužbu primjenjuje pravorijek iz kolektivnog sudskog procesa, što je već prije utvrdio Vrhovni sud RH.
Nadalje, utvrđeno je kako provedena konverzija nema značaj za tužbeni zahtjev; da konverzijom nisu vraćeni preplaćeni anuiteti iz temeljnog CHF kredita; kao i da je presudom suda EU C118/17 (slučaj Dunai) utvrđeno da nacionalni sudovi moraju utvrditi je li zakonodavnom intervencijom izvršena potpuna restitucija. Isto tako i da je nakon provedenog vještačenja utvrđeno da preplaćeni anuiteti nisu vraćeni te je očigledan pravni interes tužitelja za podnošenje predmetne tužbe.

-Radosni smo zbog činjenice da je konkretni sudski postupak završio onako kako to prema pravu EU i presudi Suda EU Dunai mora završiti. Vjerujemo da će tako na kraju završiti svi naši postupci. Naravno da možemo očekivati i to da će nakon bespotrebnog oglednog postupka u režiji banaka dio sudaca zaključiti kako je valjanost konverzije razlog da se tužbeni zahtjev iz konvertiranog kredita odbije, no pravo Europske unije jest obvezujuće za sve sudove i nemamo nikakvih dvojbi u naše pravo na puno obeštećenje - poručuju iz udruge Franak naglašavajući kako su već pokrenuli potrebne aktivnosti oko izrade kvalitetnih prethodnih pitanja prema Sudu EU, koja će onda biti poslana s općinskih sudova radi konačnog razrješenja pravnih pitanja o
ništetnosti temeljnih CHF ugovora i prava na obeštećenje do dana konverzije za konvertirane kredite.

Također naglašavaju kako svi potrošači koji su otplatili kredite prije konverzije, ili ih plaćaju i dalje, ali ih nisu konvertirali, nemaju nikakvih dvojbi na sudovima, i ne moraju se uopće brinuti kako će njihovi sudski postupci završiti.

-Pobjeda na sudu u takvim slučajevima jest samo pitanje vremena, bez obzira radi li se o auto kreditima, nenamjenskim ili stambenim kreditima. Mi idemo do kraja, sve dok ne osvojimo i pravo i pravdu - ističu u udruzi Franak.

Zadarski Županijski sud potvrdio je 23. travnja 2020. pravomoćnost pozitivne presude Općinskoga suda u Vukovaru za jedan konvertirani kredit. Ta presuda potvrđuje da konverzije nisu prepreke za obeštećenje, kao što je to već utvrđeno na Sudu EU presudom C-118/17, Dunai, izvijestili su iz udruge Franak.

Zastupnica tužitelja bila je odvjetnica Martina Alagić iz Vukovara, prvostupanjsku presudu donio je vukovarski sudac Ivica Grubišić te je pravomoćnost potvrdila zadarska sutkinja Marina Tanta.

Kako je navedeno u objavi udruge Franak, presudom je potvrđeno da PBZ mora vratiti 46.000 kn preplaćenih anuiteta i platiti zatezne kamate, što znači da ukupno mora tužitelju platiti oko 90.000 kuna te da mora platiti još i 12.000 kuna sudskih troškova.

Presudom iz Vukovara, koja je potvrđena na Županijskom sudu u Zadru utvrđeno je da nije potrebno provoditi dokazni postupak, jer se na konkretnu tužbu primjenjuje pravorijek iz kolektivnog sudskog procesa, što je već prije utvrdio Vrhovni sud RH.
Nadalje, utvrđeno je kako provedena konverzija nema značaj za tužbeni zahtjev; da konverzijom nisu vraćeni preplaćeni anuiteti iz temeljnog CHF kredita; kao i da je presudom suda EU C118/17 (slučaj Dunai) utvrđeno da nacionalni sudovi moraju utvrditi je li zakonodavnom intervencijom izvršena potpuna restitucija. Isto tako i da je nakon provedenog vještačenja utvrđeno da preplaćeni anuiteti nisu vraćeni te je očigledan pravni interes tužitelja za podnošenje predmetne tužbe.

-Radosni smo zbog činjenice da je konkretni sudski postupak završio onako kako to prema pravu EU i presudi Suda EU Dunai mora završiti. Vjerujemo da će tako na kraju završiti svi naši postupci. Naravno da možemo očekivati i to da će nakon bespotrebnog oglednog postupka u režiji banaka dio sudaca zaključiti kako je valjanost konverzije razlog da se tužbeni zahtjev iz konvertiranog kredita odbije, no pravo Europske unije jest obvezujuće za sve sudove i nemamo nikakvih dvojbi u naše pravo na puno obeštećenje - poručuju iz udruge Franak naglašavajući kako su već pokrenuli potrebne aktivnosti oko izrade kvalitetnih prethodnih pitanja prema Sudu EU, koja će onda biti poslana s općinskih sudova radi konačnog razrješenja pravnih pitanja o
ništetnosti temeljnih CHF ugovora i prava na obeštećenje do dana konverzije za konvertirane kredite.

Također naglašavaju kako svi potrošači koji su otplatili kredite prije konverzije, ili ih plaćaju i dalje, ali ih nisu konvertirali, nemaju nikakvih dvojbi na sudovima, i ne moraju se uopće brinuti kako će njihovi sudski postupci završiti.

-Pobjeda na sudu u takvim slučajevima jest samo pitanje vremena, bez obzira radi li se o auto kreditima, nenamjenskim ili stambenim kreditima. Mi idemo do kraja, sve dok ne osvojimo i pravo i pravdu - ističu u udruzi Franak.

U Zadru potvrđena pozitivna presuda iz Vukovara za konvertirani kredit: banka mora vratiti oko 90.000 kuna i platiti sudske troškove

Zadarski Županijski sud potvrdio je 23. travnja 2020. pravomoćnost pozitivne presude Općinskoga suda u Vukovaru za jedan konvertirani kredit. Ta presuda potvrđuje da konverzije nisu prepreke za obeštećenje, kao što je to već utvrđeno na Sudu EU presudom C-118/17, Dunai, izvijestili su iz udruge Franak.

Zastupnica tužitelja bila je odvjetnica Martina Alagić iz Vukovara, prvostupanjsku presudu donio je vukovarski sudac Ivica Grubišić te je pravomoćnost potvrdila zadarska sutkinja Marina Tanta.

Kako je navedeno u objavi udruge Franak, presudom je potvrđeno da PBZ mora vratiti 46.000 kn preplaćenih anuiteta i platiti zatezne kamate, što znači da ukupno mora tužitelju platiti oko 90.000 kuna te da mora platiti još i 12.000 kuna sudskih troškova.
