Odvjetnik Anto Nobilo komentirao je za Dnevnik.hr blokadu 813 milijuna kuna u aferi preprodaje Ininog plina koja je najveća u povijesti Ureda za sprječavanje pranja novca.

Upitan što će točno biti s tim novcem, s obzirom na nastavak kaznenog postupka kazao je kako u ovom trenutku postoje dva moguća scenarija, a koji će se scenarij ostvariti ovisi o tome što će se dokazati na sudu.

"Da, dvije su moguće varijante: Ina može istaknuti svoj oštetni zahtjev, i ako uspije dokazati da je za oštećena za 813 milijuna kuna, taj se novac vraća oštećenoj tvrtki. Ukoliko se uspije dokazati da je Ina oštećena samo za dio novca, a preostali dio predstavlja protupravno stečenu imovinsku dobit, taj dio ide u državni proračun", pojasnio je.

Budući da kazneni postupak traje, situacija se treba procijeniti, ali Nobilo je uvjeren da će Ina ostvariti barem djelomični povrat novca. "Mislim da je Ina oštećena za 200 milijuna kuna sigurno, i da će to uspjeti dokazati, a za ostalo ćemo vidjeti", rekao je.

Međutim, ako je plin prodavan drugim subjektima pod ugovornom obvezom, situacija se komplicira. "Da, u tom slučaju, Ina nije oštećena jer je sklopljena ugovorna obaveza. Ali, to se sve može kaznenim postupkom riješiti, samo se treba dobro procijeniti".

"Dobra stvar je da je novac na vrijeme identificiran i da su računi na vrijeme blokirani, prije nego što su imali priliku odlepršati u moru stranih tvrtki, banaka i računa", dodao je Nobilo za Dnevnik.hr.

Odvjetnik Anto Nobilo komentirao je za Dnevnik.hr blokadu 813 milijuna kuna u aferi preprodaje Ininog plina koja je najveća u povijesti Ureda za sprječavanje pranja novca.

Upitan što će točno biti s tim novcem, s obzirom na nastavak kaznenog postupka kazao je kako u ovom trenutku postoje dva moguća scenarija, a koji će se scenarij ostvariti ovisi o tome što će se dokazati na sudu.

"Da, dvije su moguće varijante: Ina može istaknuti svoj oštetni zahtjev, i ako uspije dokazati da je za oštećena za 813 milijuna kuna, taj se novac vraća oštećenoj tvrtki. Ukoliko se uspije dokazati da je Ina oštećena samo za dio novca, a preostali dio predstavlja protupravno stečenu imovinsku dobit, taj dio ide u državni proračun", pojasnio je.

Budući da kazneni postupak traje, situacija se treba procijeniti, ali Nobilo je uvjeren da će Ina ostvariti barem djelomični povrat novca. "Mislim da je Ina oštećena za 200 milijuna kuna sigurno, i da će to uspjeti dokazati, a za ostalo ćemo vidjeti", rekao je.

Međutim, ako je plin prodavan drugim subjektima pod ugovornom obvezom, situacija se komplicira. "Da, u tom slučaju, Ina nije oštećena jer je sklopljena ugovorna obaveza. Ali, to se sve može kaznenim postupkom riješiti, samo se treba dobro procijeniti".

"Dobra stvar je da je novac na vrijeme identificiran i da su računi na vrijeme blokirani, prije nego što su imali priliku odlepršati u moru stranih tvrtki, banaka i računa", dodao je Nobilo za Dnevnik.hr.

Odvjetnik Anto Nobilo komentirao je za Dnevnik.hr blokadu 813 milijuna kuna u aferi preprodaje Ininog plina koja je najveća u povijesti Ureda za sprječavanje pranja novca.

Upitan što će točno biti s tim novcem, s obzirom na nastavak kaznenog postupka kazao je kako u ovom trenutku postoje dva moguća scenarija, a koji će se scenarij ostvariti ovisi o tome što će se dokazati na sudu.

"Da, dvije su moguće varijante: Ina može istaknuti svoj oštetni zahtjev, i ako uspije dokazati da je za oštećena za 813 milijuna kuna, taj se novac vraća oštećenoj tvrtki. Ukoliko se uspije dokazati da je Ina oštećena samo za dio novca, a preostali dio predstavlja protupravno stečenu imovinsku dobit, taj dio ide u državni proračun", pojasnio je.
