Zatezne kamate odnose se na razdoblje od 1. srpnja 2009. do 30. lipnja 2011. godine po stopi 17 posto godišnje, a za razdoblje od 1. srpnja 2011. do isplate po stopi od 15 posto godišnje. Sutkinja Marija Balić Jurišić presudila je prije nekoliko dana, da je Splitska banka protuugovorno povećala kamate na dugoročni kredit od 240 i pol tisuća eura koji je zagrebačkoj tvrtki odobren u ožujku 2009. godine.

Tvrtka je podigla kredit za kupnju i uređenje poslovnog prostora, a krajnji rok kredita je 31. ožujka 2016. godine. Prema ugovoru, “Dokument IT” ga je trebao otplaćivati u jednakim tromjesečnim ratama i pripadajućim redovnim kamatama. Kredit je odobren uz ugovorenu godišnju kamatnu stopu koja se sastoji od tromjesečnog euribora uvećanog za 3,70 postotnih poena. No, kako je istaknuto u tužbi, banka je i prije dospijeća prve rate protuugovorno povećala kamatnu stopu, odnosno njezin fiksni dio sa 3,70 na 7 postotnih poena.

Sporni obračun

- Na taj je način banka tvrtki obračunala kamatnu stopu za razdoblje od 30. travnja do 30. lipnja 2009. u visini od 8,372 postotna poena. Zbog takvog protuugovornog povećanja kamatne stope, ona je za razdoblje od 30. lipnja do 30. rujna 2009. godine iznosila 7,508 postotnih poena, a od 30. rujna do 30. prosinca 2009. godine iznosila je 7,150 postotnih poena.

U 2010. godini tuženik je povećao kamatnu stopu, tj. njezin fiksni dio na čak 8,8 postotnih poena. Zbog protuugovornog povećanja kamatne stope, banka je u razdoblju od početka kredita do uključivo rate koja je dospjela 31. prosinca 2013. godine na ime redovnih kamata naplatila ukupno 29.924,58 eura više od ugovorenog. Kako je tužitelj bio u zakašnjenju s plaćanjem rata kredita, tuženik je na ime zateznih kamata naplatio 3.500.00 eura više od onog što je imao pravo naplatiti - stajalo je u tužbi.

Banka je, naravno, tvrdila da su postupili u skladu s međusobnim pravima i obvezama preuzetim ugovorom o kreditu i da stoga ne postoji nikakva povreda ugovorene obveze.

Zatezne kamate odnose se na razdoblje od 1. srpnja 2009. do 30. lipnja 2011. godine po stopi 17 posto godišnje, a za razdoblje od 1. srpnja 2011. do isplate po stopi od 15 posto godišnje. Sutkinja Marija Balić Jurišić presudila je prije nekoliko dana, da je Splitska banka protuugovorno povećala kamate na dugoročni kredit od 240 i pol tisuća eura koji je zagrebačkoj tvrtki odobren u ožujku 2009. godine.

Tvrtka je podigla kredit za kupnju i uređenje poslovnog prostora, a krajnji rok kredita je 31. ožujka 2016. godine. Prema ugovoru, “Dokument IT” ga je trebao otplaćivati u jednakim tromjesečnim ratama i pripadajućim redovnim kamatama. Kredit je odobren uz ugovorenu godišnju kamatnu stopu koja se sastoji od tromjesečnog euribora uvećanog za 3,70 postotnih poena. No, kako je istaknuto u tužbi, banka je i prije dospijeća prve rate protuugovorno povećala kamatnu stopu, odnosno njezin fiksni dio sa 3,70 na 7 postotnih poena.

Sporni obračun

- Na taj je način banka tvrtki obračunala kamatnu stopu za razdoblje od 30. travnja do 30. lipnja 2009. u visini od 8,372 postotna poena. Zbog takvog protuugovornog povećanja kamatne stope, ona je za razdoblje od 30. lipnja do 30. rujna 2009. godine iznosila 7,508 postotnih poena, a od 30. rujna do 30. prosinca 2009. godine iznosila je 7,150 postotnih poena.

U 2010. godini tuženik je povećao kamatnu stopu, tj. njezin fiksni dio na čak 8,8 postotnih poena. Zbog protuugovornog povećanja kamatne stope, banka je u razdoblju od početka kredita do uključivo rate koja je dospjela 31. prosinca 2013. godine na ime redovnih kamata naplatila ukupno 29.924,58 eura više od ugovorenog. Kako je tužitelj bio u zakašnjenju s plaćanjem rata kredita, tuženik je na ime zateznih kamata naplatio 3.500.00 eura više od onog što je imao pravo naplatiti - stajalo je u tužbi.

Banka je, naravno, tvrdila da su postupili u skladu s međusobnim pravima i obvezama preuzetim ugovorom o kreditu i da stoga ne postoji nikakva povreda ugovorene obveze.
