[fulltext] => Problem arbitraže o granici između Hrvatske i Slovenije nije riješen ostavkom slovenskog arbitra i imenovanjem novog, jer su u postupku ostali 'zagađeni' dokumenti na temelju kojih sud ne može donijeti zakonitu odluku, izjavila je u srijedu ministrica vanjskih i europskih poslova Vesna Pusić.
Hrvatski sabor odlučio je o izlasku Hrvatske iz Arbitražnog sporazuma sa Slovenijom nakon što su mediji objavili transkripte koji pokazuju da su se slovenski arbitar i agentica dogovarali o daljnjim koracima u postupku.
I sudac Jernej Sekolec i zastupnica Simona Drenik u međuvremenu su odstupili, a Slovenija je imenovala novog arbitra i predložila nastavak arbitraže.
Šefica hrvatske diplomacije pozvala je u srijedu navečer strane veleposlanike i objasnila im razloge za izlazak iz arbitraže koja se, prema Zagrebu, više ne može smatrati poštenom i neovisnom.
'Temeljni problem nije kompromitacija slovenskog arbitra... Glavna primjedba je da je dokumentacija temeljem koje bi arbitri trebali donijeti odluku zagađena činjenicom da je slovenski arbitar stavio unutra stavove, papire, dokumente nakon što je arbitraža već počela svoju raspravu i razmatranje slučaja', rekla je Pusić.
Potpredsjednica vlade je dodala da je to suprotno dogovorenim pravilima i da se tako ne može donijeti zakonita odluka.
'Budući da je nakon takvih poteza nemoguće ustanoviti koji su dokumenti koji su došli legalno, a koji su došli naknadno... Hrvatska smatra da je nemoguće donijeti odluku temeljem tako kontaminiranog materijala'", istaknula je.
Unatoč skandalu 'Pirangate', ministrica ističe da određivanje granice na kopnu i moru ostaje interes i Hrvatske i Slovenije, ali kroz neki drugi postupak.
"Hrvatska je svakako željela to riješiti putem arbitražnog sporazuma, u to smo uložili puno vremena, kvalitetnih ljudi i novaca. Ovakvo ponašanje slovenskog arbitra i agentice nanijelo je štetu i nama i slovenskoj strani koja također neće kroz ovaj postupak riješiti problem", rekla je.
Veleposlanicima je na sastanku u ministarstvu dan opis najnovijih događaja oko arbitraže, prijevodi transkripata objavljeni u medijima, prijedlog zaključka Sabora te govori premijera i ministrice Pusić u parlamentu.
Na sastanku su bili i predsjednik saborskog odbora za vanjsku politiku Milorad Pupovac te bivša premijerka Jadranka Kosor koja je 2009. u me Hrvatske potpisala Arbitražni sporazum.

[text] => {OCMSplitter}Problem arbitraže o granici između Hrvatske i Slovenije nije riješen ostavkom slovenskog arbitra i imenovanjem novog, jer su u postupku ostali 'zagađeni' dokumenti na temelju kojih sud ne može donijeti zakonitu odluku, izjavila je u srijedu ministrica vanjskih i europskih poslova Vesna Pusić.
Hrvatski sabor odlučio je o izlasku Hrvatske iz Arbitražnog sporazuma sa Slovenijom nakon što su mediji objavili transkripte koji pokazuju da su se slovenski arbitar i agentica dogovarali o daljnjim koracima u postupku.
I sudac Jernej Sekolec i zastupnica Simona Drenik u međuvremenu su odstupili, a Slovenija je imenovala novog arbitra i predložila nastavak arbitraže.
Šefica hrvatske diplomacije pozvala je u srijedu navečer strane veleposlanike i objasnila im razloge za izlazak iz arbitraže koja se, prema Zagrebu, više ne može smatrati poštenom i neovisnom.
'Temeljni problem nije kompromitacija slovenskog arbitra... Glavna primjedba je da je dokumentacija temeljem koje bi arbitri trebali donijeti odluku zagađena činjenicom da je slovenski arbitar stavio unutra stavove, papire, dokumente nakon što je arbitraža već počela svoju raspravu i razmatranje slučaja', rekla je Pusić.
Potpredsjednica vlade je dodala da je to suprotno dogovorenim pravilima i da se tako ne može donijeti zakonita odluka.
'Budući da je nakon takvih poteza nemoguće ustanoviti koji su dokumenti koji su došli legalno, a koji su došli naknadno... Hrvatska smatra da je nemoguće donijeti odluku temeljem tako kontaminiranog materijala'", istaknula je.
Unatoč skandalu 'Pirangate', ministrica ističe da određivanje granice na kopnu i moru ostaje interes i Hrvatske i Slovenije, ali kroz neki drugi postupak.
"Hrvatska je svakako željela to riješiti putem arbitražnog sporazuma, u to smo uložili puno vremena, kvalitetnih ljudi i novaca. Ovakvo ponašanje slovenskog arbitra i agentice nanijelo je štetu i nama i slovenskoj strani koja također neće kroz ovaj postupak riješiti problem", rekla je.
Veleposlanicima je na sastanku u ministarstvu dan opis najnovijih događaja oko arbitraže, prijevodi transkripata objavljeni u medijima, prijedlog zaključka Sabora te govori premijera i ministrice Pusić u parlamentu.
Na sastanku su bili i predsjednik saborskog odbora za vanjsku politiku Milorad Pupovac te bivša premijerka Jadranka Kosor koja je 2009. u me Hrvatske potpisala Arbitražni sporazum.
