Kako doznaje Jutarnji list, dok još čekamo mišljenje Europske komisije o Zakonu o ništetnosti, Vlada Jadranke Kosor je daleko od očiju javnosti već izmijenila sporni zakon.

Jutarnji posjeduje pisma i pojašnjenja koja je ministar pravosuđa Dražen Bošnjaković poslao u Bruxelles kao odgovore na pitanja Europske komisije.

Iz pisma proizlazi da je Vlada prihvatila argumente državnog odvjetnika Mladena Bajića samo nekoliko dana nakon što su potpuno ignorirali njegova vrlo ozbiljna upozorenja da je zakon štetan i neprihvatljiv.

Vlada obavještava EK da zakon neće biti usvojen bez amandmana koji ga bitno ograničava: ne bi automatski svi zahtjevi iz Srbije bili proglašeni “ništetnima” niti bi hrvatska pravosudna tijela prekinula svaku suradnju s Beogradom, nego bi ništavnima bili proglašeni samo pojedinačni dokumenti za koje ministar pravosuđa procijeni da “mogu narušiti suverenitet, sigurnost i ključne interese Republike Hrvatske”.

To znači da novi zakon uopće nije potreban jer i po starom Zakonu o međunarodnoj pravnoj pomoći u kaznenim stvarima zahtjev iz druge države može se odbiti “ako bi udovoljavanje zamolbi dovelo do narušavanja suvereniteta, sigurnosti, pravnog poretka ili drugih bitnih interesa RH”.

Kako doznaje Jutarnji list, dok još čekamo mišljenje Europske komisije o Zakonu o ništetnosti, Vlada Jadranke Kosor je daleko od očiju javnosti već izmijenila sporni zakon.

Jutarnji posjeduje pisma i pojašnjenja koja je ministar pravosuđa Dražen Bošnjaković poslao u Bruxelles kao odgovore na pitanja Europske komisije.

Iz pisma proizlazi da je Vlada prihvatila argumente državnog odvjetnika Mladena Bajića samo nekoliko dana nakon što su potpuno ignorirali njegova vrlo ozbiljna upozorenja da je zakon štetan i neprihvatljiv.

Vlada obavještava EK da zakon neće biti usvojen bez amandmana koji ga bitno ograničava: ne bi automatski svi zahtjevi iz Srbije bili proglašeni “ništetnima” niti bi hrvatska pravosudna tijela prekinula svaku suradnju s Beogradom, nego bi ništavnima bili proglašeni samo pojedinačni dokumenti za koje ministar pravosuđa procijeni da “mogu narušiti suverenitet, sigurnost i ključne interese Republike Hrvatske”.

To znači da novi zakon uopće nije potreban jer i po starom Zakonu o međunarodnoj pravnoj pomoći u kaznenim stvarima zahtjev iz druge države može se odbiti “ako bi udovoljavanje zamolbi dovelo do narušavanja suvereniteta, sigurnosti, pravnog poretka ili drugih bitnih interesa RH”.

Kako doznaje Jutarnji list, dok još čekamo mišljenje Europske komisije o Zakonu o ništetnosti, Vlada Jadranke Kosor je daleko od očiju javnosti već izmijenila sporni zakon.
