Nevenka Tuđman, kćer prvog hrvatskog predsjednika sutra bi se po treći put trebala naći na optuženičkoj klupi zbog optužbe da je koristila svoj društveni položaj i ugled te bivšem poslovnom partneru namještala poslove i za to četiri godine dobivala proviziju.

Za istu optužbu njoj se već dva puta sudilo, no obje nepravomoćne oslobađajuće presude, koje je donio sudac zagrebačkog Županijskog suda Vladimir Pavleković, ukinuo je Vrhovni sud, vrativši postupak na početak.

Ovoga puta suđenje će voditi sudac Marijan Garac koji je danas Hini potvrdio da je sve spremno za početak ponovljenog postupka i da je optužena uredno primila poziv na raspravu.

Krajem prošle godine Vrhovni sud je po drugi put ukinuo oslobađajuću presudu za protuzakonito posredovanje za koje je, prema tvrdnjama USKOK-a, optužena primila 980 tisuća kuna provizije.

USKOK se žalio tvrdeći da je prvostupanjski sud pogrešno utvrdio činjenično stanje jer je nezakonito posredovanje optužene, koja je bivšem poslovnom partneru Igoru Kneževiću 1996. namjestila posao u Ministarstvu znanosti, ocijenio kao dopušten pravni posao pri kojemu je poštivana procedura.

U žalbi je istaknuta i kako je pogrešno utvrđeno da potpisivanje Ugovora o konzaltingu između Kneževićeve tvrtke i Ministarstva ne predstavlja službenu radnju koja se ne bi smjela obaviti. USKOK, pak, tvrdi da su se na taj ugovor trebale primjenjivati odredbe o javnoj nabavi jer je vrijednost posla bila veća od 200.000 kuna, ali da su u Ministarstvu "namjerno i svjesno" zaobišli te odredbe.

Vrhovni sud prihvatio je argumente USKOK-a te vratio predmet prvostupanjskom sudu koji ponovno mora izvesti sve već jednom izvedene dokaze, uz obavezu da točno utvrdi vrijednost Kneževićevih usluga, a samim time i je li Ministarstvo bilo obvezno na taj posao primjeniti odredbe o javnoj nabavi.

Nevenka Tuđman, kćer prvog hrvatskog predsjednika sutra bi se po treći put trebala naći na optuženičkoj klupi zbog optužbe da je koristila svoj društveni položaj i ugled te bivšem poslovnom partneru namještala poslove i za to četiri godine dobivala proviziju.

Za istu optužbu njoj se već dva puta sudilo, no obje nepravomoćne oslobađajuće presude, koje je donio sudac zagrebačkog Županijskog suda Vladimir Pavleković, ukinuo je Vrhovni sud, vrativši postupak na početak.

Ovoga puta suđenje će voditi sudac Marijan Garac koji je danas Hini potvrdio da je sve spremno za početak ponovljenog postupka i da je optužena uredno primila poziv na raspravu.

Krajem prošle godine Vrhovni sud je po drugi put ukinuo oslobađajuću presudu za protuzakonito posredovanje za koje je, prema tvrdnjama USKOK-a, optužena primila 980 tisuća kuna provizije.

USKOK se žalio tvrdeći da je prvostupanjski sud pogrešno utvrdio činjenično stanje jer je nezakonito posredovanje optužene, koja je bivšem poslovnom partneru Igoru Kneževiću 1996. namjestila posao u Ministarstvu znanosti, ocijenio kao dopušten pravni posao pri kojemu je poštivana procedura.

U žalbi je istaknuta i kako je pogrešno utvrđeno da potpisivanje Ugovora o konzaltingu između Kneževićeve tvrtke i Ministarstva ne predstavlja službenu radnju koja se ne bi smjela obaviti. USKOK, pak, tvrdi da su se na taj ugovor trebale primjenjivati odredbe o javnoj nabavi jer je vrijednost posla bila veća od 200.000 kuna, ali da su u Ministarstvu "namjerno i svjesno" zaobišli te odredbe.

Vrhovni sud prihvatio je argumente USKOK-a te vratio predmet prvostupanjskom sudu koji ponovno mora izvesti sve već jednom izvedene dokaze, uz obavezu da točno utvrdi vrijednost Kneževićevih usluga, a samim time i je li Ministarstvo bilo obvezno na taj posao primjeniti odredbe o javnoj nabavi.
