Njemačka je vlada u četvrtak pozvala Hrvatsku da poštuje i provede odluku arbitražnog suda o graničnom sporu Hrvatske i Slovenije.

U priopćenju njemačkog veleposlanstva u Zagrebu, objavljenom nekoliko sati prije presude Arbitražnog suda o graničnom sporu Hrvatske i Slovenije, ističe se da vlada u Berlinu smatra važnim "načelo međunarodnog prava da se odluke arbitražnih sudova moraju poštivati te da ih stranke moraju implementirati". 

Međunarodno arbitražno sudstvo vrijedan je instrument međunarodnog prava te igra važnu ulogu u rješavanju međudržavnih sporova, ističe se u priopćenju.

"U vezi s jednim bilateralnim pitanjem Slovenija i Hrvatska su se zajedno podvrgnule međunarodnom arbitražnom postupku sporazumom od 4. studenoga 2009. godine. Stoga je, posve neovisno o sadržaju odluke, s gledišta njemačke vlade važno načelo međunarodnog prava da se odluke arbitražnih sudova moraju poštivati te da ih stranke moraju implementirati", poručuje njemačko veleposlanstvo.

"Očuvanje integriteta međunarodnog sudstva u zajedničkom je interesu svih država. Države članice Europske unije u tome moraju prednjačiti dobrim primjerom", zaključuje se u priopćenju.

Hrvatska neće niti prihvatiti niti priznati presudu sukladno odluci Hrvatskog sabora iz srpnja 2015. o povlačenju iz arbitraže zbog "teške povrede arbitražnog postupka".

Zagreb je tada ocijenio da je arbitražni proces nepovratno kompromitiran nakon što je otkriveno da su se slovenski predstavnik u arbitražnom sudu Jernej Sekolec i djelatnica slovenskog ministarstva vanjskih poslova Simona Drenik dogovarali o iznošenju slovenskih argumenata i lobiranju kod drugih arbitražnih sudaca. I Sekolec i Drenik nakon toga su odstupili.

Hrvatska je izašla iz arbitraže pozivajući se na članak 60. Bečke konvencije koji dopušta razvrgnuće sporazuma u slučaju njegove "teške povrede".

Njemačka je vlada u četvrtak pozvala Hrvatsku da poštuje i provede odluku arbitražnog suda o graničnom sporu Hrvatske i Slovenije.

U priopćenju njemačkog veleposlanstva u Zagrebu, objavljenom nekoliko sati prije presude Arbitražnog suda o graničnom sporu Hrvatske i Slovenije, ističe se da vlada u Berlinu smatra važnim "načelo međunarodnog prava da se odluke arbitražnih sudova moraju poštivati te da ih stranke moraju implementirati". 

Međunarodno arbitražno sudstvo vrijedan je instrument međunarodnog prava te igra važnu ulogu u rješavanju međudržavnih sporova, ističe se u priopćenju.

"U vezi s jednim bilateralnim pitanjem Slovenija i Hrvatska su se zajedno podvrgnule međunarodnom arbitražnom postupku sporazumom od 4. studenoga 2009. godine. Stoga je, posve neovisno o sadržaju odluke, s gledišta njemačke vlade važno načelo međunarodnog prava da se odluke arbitražnih sudova moraju poštivati te da ih stranke moraju implementirati", poručuje njemačko veleposlanstvo.

"Očuvanje integriteta međunarodnog sudstva u zajedničkom je interesu svih država. Države članice Europske unije u tome moraju prednjačiti dobrim primjerom", zaključuje se u priopćenju.

Hrvatska neće niti prihvatiti niti priznati presudu sukladno odluci Hrvatskog sabora iz srpnja 2015. o povlačenju iz arbitraže zbog "teške povrede arbitražnog postupka".

Zagreb je tada ocijenio da je arbitražni proces nepovratno kompromitiran nakon što je otkriveno da su se slovenski predstavnik u arbitražnom sudu Jernej Sekolec i djelatnica slovenskog ministarstva vanjskih poslova Simona Drenik dogovarali o iznošenju slovenskih argumenata i lobiranju kod drugih arbitražnih sudaca. I Sekolec i Drenik nakon toga su odstupili.

Hrvatska je izašla iz arbitraže pozivajući se na članak 60. Bečke konvencije koji dopušta razvrgnuće sporazuma u slučaju njegove "teške povrede".
