Marko Bekavac, bivši načelnik splitske policije i sadašnji djelatnik Splitsko-dalmatinske županije, na radnome mjestu savjetnika za nacionalne manjine i sigurnost, izgubio je spor na Upravnom sudu u Splitu koji je pokrenuo protiv Sigurnosno-obavještajne agencije (SOA).
On je zatražio dostavljanje klasificiranih podataka kojima raspolaže to tijelo, koji se odnose na njega osobno, za razdoblje od 1995. do 2018. godine, pozivajući se na Zakon o pravu na pristup informacijama.
Uputili ga Markiću
No, nije mu udovoljeno jer se ti podaci klasificiraju kao tajna koja bi mogla ugroziti sigurnosni poredak Republike Hrvatske.
Bekavac i njegov odvjetnik Nediljko Ivančević smatraju da to nije točno, niti da je utemeljeno na zakonu.
Više od godinu i pol dana traje Bekavčeva sudska borba nakon što je SOA svojim dopisom od kraja srpnja 2018. odbila takav njegov zahtjev, upućujući ga na podnošenje prigovora ravnatelju SOA-e Danielu Markiću.
Bekavac je to i učinio te je SOA svojim rješenjem mjesec dana kasnije odbila i taj njegov prigovor kao neosnovan, ali je dala uputu da Bekavac protiv toga rješenja može izjaviti žalbu povjerenici za informiranje.
Stoga je on i povjerenici za informiranje podnio žalbu protiv rješenja SOA-e, međutim, ona je svojim rješenjem od 11. listopada 2018. odbila Bekavčevu žalbu protiv rješenja SOA-e. Nakon toga tužitelj Marko Bekavac podnio je tužbu i Visokom upravnom sudu RH, jer smatra da je to rješenje pogrešno i nije utemeljeno na zakonu.
Taj sud donio je presudu 1. veljače 2019. kojom je poništio rješenje povjerenika za informiranje od 11.10. 2018., kao i rješenje SOA-e od 21.8. 2018., ali je i odbacio prigovor Marka Bekavca.
Ukratko, Visoki upravni sud zauzeo je pravni stav kako, “budući da tužitelj traži podatke koji se odnose na njega osobno, ovdje treba primijeniti odredbu čl. 40. Zakona o sigurnosno-obavještajnom sustavu Republike Hrvatske, te ovisno o postupanju Sigurnosno-obavještajne agencije daljnju pravnu zaštitu ostvariti po odredbi čl. 22. st. 1. t. 3. ZUS-a”.
To zapravo znači da mu je SOA te podatke bila dužna dati – ističe Bekavčev odvjetnik.
Hvataju rok
– Sada se vi pitate zašto mi i nakon toga podnosimo upravnu tužbu na niži Upravni sud, kada je viši sud već odlučio o o tome. Pa, da nam ne istekne zakonski rok od 30 dana jer se SOA oglušila da Bekavcu da te podatke i nakon što je sud jasno rekao da ona to treba učiniti, a ne nikakav povjerenik za informiranje. Podaci nam se ne daju jer se ustraje na tome da oni mogu ugroziti sigurnosni poredak RH, što nije istina. Ali, vidim da ćemo se morati opet boriti nakon ove presude Upravnog suda u Splitu na koju ću se žaliti – rekao je Nediljko Ivančević.

Marko Bekavac, bivši načelnik splitske policije i sadašnji djelatnik Splitsko-dalmatinske županije, na radnome mjestu savjetnika za nacionalne manjine i sigurnost, izgubio je spor na Upravnom sudu u Splitu koji je pokrenuo protiv Sigurnosno-obavještajne agencije (SOA).
On je zatražio dostavljanje klasificiranih podataka kojima raspolaže to tijelo, koji se odnose na njega osobno, za razdoblje od 1995. do 2018. godine, pozivajući se na Zakon o pravu na pristup informacijama.
Uputili ga Markiću
No, nije mu udovoljeno jer se ti podaci klasificiraju kao tajna koja bi mogla ugroziti sigurnosni poredak Republike Hrvatske.
Bekavac i njegov odvjetnik Nediljko Ivančević smatraju da to nije točno, niti da je utemeljeno na zakonu.
Više od godinu i pol dana traje Bekavčeva sudska borba nakon što je SOA svojim dopisom od kraja srpnja 2018. odbila takav njegov zahtjev, upućujući ga na podnošenje prigovora ravnatelju SOA-e Danielu Markiću.
Bekavac je to i učinio te je SOA svojim rješenjem mjesec dana kasnije odbila i taj njegov prigovor kao neosnovan, ali je dala uputu da Bekavac protiv toga rješenja može izjaviti žalbu povjerenici za informiranje.
Stoga je on i povjerenici za informiranje podnio žalbu protiv rješenja SOA-e, međutim, ona je svojim rješenjem od 11. listopada 2018. odbila Bekavčevu žalbu protiv rješenja SOA-e. Nakon toga tužitelj Marko Bekavac podnio je tužbu i Visokom upravnom sudu RH, jer smatra da je to rješenje pogrešno i nije utemeljeno na zakonu.
Taj sud donio je presudu 1. veljače 2019. kojom je poništio rješenje povjerenika za informiranje od 11.10. 2018., kao i rješenje SOA-e od 21.8. 2018., ali je i odbacio prigovor Marka Bekavca.
Ukratko, Visoki upravni sud zauzeo je pravni stav kako, “budući da tužitelj traži podatke koji se odnose na njega osobno, ovdje treba primijeniti odredbu čl. 40. Zakona o sigurnosno-obavještajnom sustavu Republike Hrvatske, te ovisno o postupanju Sigurnosno-obavještajne agencije daljnju pravnu zaštitu ostvariti po odredbi čl. 22. st. 1. t. 3. ZUS-a”.
To zapravo znači da mu je SOA te podatke bila dužna dati – ističe Bekavčev odvjetnik.
Hvataju rok
– Sada se vi pitate zašto mi i nakon toga podnosimo upravnu tužbu na niži Upravni sud, kada je viši sud već odlučio o o tome. Pa, da nam ne istekne zakonski rok od 30 dana jer se SOA oglušila da Bekavcu da te podatke i nakon što je sud jasno rekao da ona to treba učiniti, a ne nikakav povjerenik za informiranje. Podaci nam se ne daju jer se ustraje na tome da oni mogu ugroziti sigurnosni poredak RH, što nije istina. Ali, vidim da ćemo se morati opet boriti nakon ove presude Upravnog suda u Splitu na koju ću se žaliti – rekao je Nediljko Ivančević.
