Trgovački sud u Zagrebu objavio je zaključak kojim se za 7. prosinca određuje ročište na kojem bi se trebalo raspraviti i odlučiti o uvjetima za otvaranje stečajnog postupka nad teniskim centrom proslavljene hrvatske tenisačice Ive Majoli od koje je predlagatelj stečaja H-ABDUCO d.o.o još u listopadu prošle godine potraživao čak 59 milijuna kuna.
Zaključak Trgovačkog suda uslijedio je nakon prošlogodišnjeg rješenja i zaključka kojima je imenovan stečajni upravitelj teniskog centra Ive Majoli u zagrebačkoj Jurjevskoj ulici i to na temelju prijedloga H-ABDUCO d.o.o za pokretanje stečajnog postupka u kojem se navodi da ima ukupne tražbine u iznosu od preko 59 milijuna kuna, a koje nije u mogućnosti naplatiti budući da je dužnikov račun blokiran.
U tom se prijedlogu navodi da H-ABDUCO nije samo osobni vjerovnik već i razlučni vjerovnik dužnika te da ima legitimaciju podnijeti prijedlog temeljem odredbi Stečajnog zakona jer "postoji vjerojatnost da svoje novčane tražbine neće moći namiriti iz predmeta na koje se odnose njegova razlučna prava".
U prijedlogu se ističe i da je H-ABDUCO, tvrtka kojoj je osnivač HETA Asset Resolution Hrvatska, bivši Hypo leasing Kroatien, s Tenis centrom Ive Majoli zaključio nekoliko ugovora o kreditu i aneksa ugovora te je osigurao novčanih tražbina zasnivanjem založnog prava na nekretninama i na poslovnim udjelima svog dužnika i time stekao status razlučnog vjerovnika.
Na stečajno ročište u prosincu pozvani su Iva Majoli Marić, ali i Stanislav i Drago Majoli koji su navedeni kao direktori tvrtke. Njima je bilo naloženo da sudu predaju dokumente o nekretninama, pokretninama i drugim imovinskim pravima koje čine imovinu njihove tvrke, kao i podatke gdje se nekretnine i pokretnine nalaze te koliko novca imaju na računu.
U dosadašnjem postupku naplate dugova od Teniskog centra Ive Majoli izvršena je procjena vrijednosti nekretina dužnika prema kojoj stanovi Ive Majoli u centru Zagreba od oko 154 i 79 kvadrata vrijede nešto više od 8 milijuna kuna, teniski centar u elitnoj zagrebačkoj četvrti nešto više od 21 milijun kuna, al i da restoran u Novom Vinodolskom vrijedi oko 5, 6 milijuna kuna.
U sudskom rješenju stoji i da je temeljem navedenih procjena nekretnina izvjesno da predlagatelj stečaja tvrtke Ive Majoli, H-ABDUCO, neće moći u cijelosti naplatiti svoja potraživanja od čak 59 milijuna kuna.
Tenis centar Iva Majoli d.o.o tvrtka je koja je prošle godine, prema podacima Fine, prijavila ostvareni gubitak od čak 33,3 milijuna kuna, a s ukupnim gubitkom iz prethodnih godina dug je veći od 47,6 milijuna kuna.

Trgovački sud u Zagrebu objavio je zaključak kojim se za 7. prosinca određuje ročište na kojem bi se trebalo raspraviti i odlučiti o uvjetima za otvaranje stečajnog postupka nad teniskim centrom proslavljene hrvatske tenisačice Ive Majoli od koje je predlagatelj stečaja H-ABDUCO d.o.o još u listopadu prošle godine potraživao čak 59 milijuna kuna.
Zaključak Trgovačkog suda uslijedio je nakon prošlogodišnjeg rješenja i zaključka kojima je imenovan stečajni upravitelj teniskog centra Ive Majoli u zagrebačkoj Jurjevskoj ulici i to na temelju prijedloga H-ABDUCO d.o.o za pokretanje stečajnog postupka u kojem se navodi da ima ukupne tražbine u iznosu od preko 59 milijuna kuna, a koje nije u mogućnosti naplatiti budući da je dužnikov račun blokiran.
U tom se prijedlogu navodi da H-ABDUCO nije samo osobni vjerovnik već i razlučni vjerovnik dužnika te da ima legitimaciju podnijeti prijedlog temeljem odredbi Stečajnog zakona jer "postoji vjerojatnost da svoje novčane tražbine neće moći namiriti iz predmeta na koje se odnose njegova razlučna prava".
U prijedlogu se ističe i da je H-ABDUCO, tvrtka kojoj je osnivač HETA Asset Resolution Hrvatska, bivši Hypo leasing Kroatien, s Tenis centrom Ive Majoli zaključio nekoliko ugovora o kreditu i aneksa ugovora te je osigurao novčanih tražbina zasnivanjem založnog prava na nekretninama i na poslovnim udjelima svog dužnika i time stekao status razlučnog vjerovnika.
Na stečajno ročište u prosincu pozvani su Iva Majoli Marić, ali i Stanislav i Drago Majoli koji su navedeni kao direktori tvrtke. Njima je bilo naloženo da sudu predaju dokumente o nekretninama, pokretninama i drugim imovinskim pravima koje čine imovinu njihove tvrke, kao i podatke gdje se nekretnine i pokretnine nalaze te koliko novca imaju na računu.
U dosadašnjem postupku naplate dugova od Teniskog centra Ive Majoli izvršena je procjena vrijednosti nekretina dužnika prema kojoj stanovi Ive Majoli u centru Zagreba od oko 154 i 79 kvadrata vrijede nešto više od 8 milijuna kuna, teniski centar u elitnoj zagrebačkoj četvrti nešto više od 21 milijun kuna, al i da restoran u Novom Vinodolskom vrijedi oko 5, 6 milijuna kuna.
U sudskom rješenju stoji i da je temeljem navedenih procjena nekretnina izvjesno da predlagatelj stečaja tvrtke Ive Majoli, H-ABDUCO, neće moći u cijelosti naplatiti svoja potraživanja od čak 59 milijuna kuna.
Tenis centar Iva Majoli d.o.o tvrtka je koja je prošle godine, prema podacima Fine, prijavila ostvareni gubitak od čak 33,3 milijuna kuna, a s ukupnim gubitkom iz prethodnih godina dug je veći od 47,6 milijuna kuna.
