Botica će potom, kako su nas izvijestili sa suda, “donijeti odluku o daljnjem postupanju u ovom predmetu”. Istodobno, i Stern je poduzeo pravne korake te podnio kaznene prijave protiv Tibora Mariaka, Borisa Kale i Josipa Ćelića.

Mariak je kao direktor “Flava Linee”, tvrtke u kojoj je Sternov partner s manjinskim udjelom bio Kale, potpisao ugovor po kojemu je kuća prodana Ćeliću, načelniku Policijske uprave karlovačke. To se događalo bez Sternova znanja premda je “Flava Linea” 2001. godine kuću kupila za njegove potrebe, o čemu svjedoči niz dokumenata, jer on po tadašnjim propisima kao strani državljanin nije mogao stjecati nekretnine u Hrvatskoj.

Pišući o ovome slučaju, “Slobodna” je otkrila da je Čolak bez pravnog temelja skinuo Sternovu zabilježbu upisanu u zemljišne knjige, što je načas pomoglo Ćeliću da stekne nesmetano vlasništvo nad kućom. Sudačko povjerenstvo moralo bi utvrditi je li brisanje Sternove zabilježbe plod sudačke greške, uzrokovane preopterećenošću, nemarom ili nečim trećim, ili je, pak, posljedica plana da se austrijskog poduzetnika onemogući u stjecanju vlasništva nad kućom.

Za štetu odgovara država

Na upit kako će Općinski sud sanirati štetu nastalu Čolakovim propustom, Ana Marović, sudska glasnogovornica, odgovorila nam je citiranjem članaka Zakona o sudovima, koji normiraju da “Republika Hrvatska odgovara za štetu koju u obnašanju sudačke dužnosti nanese sudac stranci svojim nezakonitim ili nepravilnim radom”, te da će “Republika Hrvatska zatražiti od suca povrat isplaćene naknade samo kad je sudac štetu učinio namjerno ili iz krajnje nepažnje”.

Sterna čija je kuća u Lokvi Rogoznici pod još uvijek ne baš sasvim jasnim okolnostima promijenila vlasnika.

Botica će potom, kako su nas izvijestili sa suda, “donijeti odluku o daljnjem postupanju u ovom predmetu”. Istodobno, i Stern je poduzeo pravne korake te podnio kaznene prijave protiv Tibora Mariaka, Borisa Kale i Josipa Ćelića.

Mariak je kao direktor “Flava Linee”, tvrtke u kojoj je Sternov partner s manjinskim udjelom bio Kale, potpisao ugovor po kojemu je kuća prodana Ćeliću, načelniku Policijske uprave karlovačke. To se događalo bez Sternova znanja premda je “Flava Linea” 2001. godine kuću kupila za njegove potrebe, o čemu svjedoči niz dokumenata, jer on po tadašnjim propisima kao strani državljanin nije mogao stjecati nekretnine u Hrvatskoj.

Pišući o ovome slučaju, “Slobodna” je otkrila da je Čolak bez pravnog temelja skinuo Sternovu zabilježbu upisanu u zemljišne knjige, što je načas pomoglo Ćeliću da stekne nesmetano vlasništvo nad kućom. Sudačko povjerenstvo moralo bi utvrditi je li brisanje Sternove zabilježbe plod sudačke greške, uzrokovane preopterećenošću, nemarom ili nečim trećim, ili je, pak, posljedica plana da se austrijskog poduzetnika onemogući u stjecanju vlasništva nad kućom.

Za štetu odgovara država

Na upit kako će Općinski sud sanirati štetu nastalu Čolakovim propustom, Ana Marović, sudska glasnogovornica, odgovorila nam je citiranjem članaka Zakona o sudovima, koji normiraju da “Republika Hrvatska odgovara za štetu koju u obnašanju sudačke dužnosti nanese sudac stranci svojim nezakonitim ili nepravilnim radom”, te da će “Republika Hrvatska zatražiti od suca povrat isplaćene naknade samo kad je sudac štetu učinio namjerno ili iz krajnje nepažnje”.
