Vrhovni sud ukinuo je presudu i naložio novo suđenje umirovljenom generalu jugoslavenske vojske Borislavu Đukiću, ranije osuđenom na deset godina zatvora zbog optužbi da je zapovjedio miniranje brane Peruća u siječnju 1993.

Nepravomoćnu presudu za ratni zločin protiv civilnog stanovništva u prosincu 2020. donio je splitski Županijski sud na kojem će se voditi i ponovljeni postupak.

Vrhovni sud presudu je ukinuo prihvativši Đukićevu žalbu, navodeći da su u prvostupanjskoj presudi izneseni proturječni i nerazumljivi razlozi o odlučnim okolnostima pa se presuda ne može ispitati.

Povrijeđeno pravo na pravično suđenje

"Nije odlučeno o zakonitosti ispitivanja jednog svjedoka, što je bilo potrebno jer postoji sumnja da je iskaz tog svjedoka u istrazi iznuđen primjenom sile od strane policije. Te je sumnje prvostupanjski sud dužan provjeriti i ocijeniti jesu li istinite i jesu li utjecale na vjerodostojnost iskaza", naveo je Vrhovni sud.

Osim toga, razlozi o odbijanju dokaznih prijedloga obrane o alibiju i ostalim tvrdnjama obrane nisu dovoljno i pravilno obrazloženi. Time je optuženiku teško povrijeđeno pravo na pravično suđenje, objavio je Vrhovni sud.

Najviši sud je zaključio i da je pravo na pravično suđenje povrijeđeno paušalnim i proizvoljnim tumačenjima prvostupanjskog suda o nevjerodostojnosti iskaza niza ispitanih svjedoka koje je predložila obrana.

Na novom suđenju ocijenit će se svi raniji dokazi

"Budući da je time počinjena bitna povreda odredaba kaznenog postupka prvostupanjska je presuda prema zakonu morala biti ukinuta", zaključio je Vrhovni sud.

Splitski Županijski sud su obvezali da u ponovljenom postupku iznova ocijene sve ranije izvedene dokaze, a po potrebi i nove, popravi pogreške na koje je upozoren te donese novu "na zakonu zasnovanu odluku, koju će valjano obrazložiti".

Đukića tužiteljstvo tereti da je 1993. kao zapovjednik organizirao rušenje brane i hidroelektrane u Perući kako bi potopio civilne i gospodarske objekte. U temelje brane i pod most bilo je postavljeno 20 do 30 tona eksploziva, a Đukić je optužen da je zapovjedio aktiviranje eksploziva i rušenje brane.

Prema optužnici time je izazvana snažna eksplozija uslijed koje je došlo do urušavanja i oštećenja brane po cijeloj duljini i širini, a stručnjaci elektroprivrede spriječili su potpuno rušenje brane i stvaranje tzv. vodenog vala koji bi ugrozio više od 50.000 stanovnika nizvodno od brane, podsjeća Vrhovni sud.

Vrhovni sud ukinuo je presudu i naložio novo suđenje umirovljenom generalu jugoslavenske vojske Borislavu Đukiću, ranije osuđenom na deset godina zatvora zbog optužbi da je zapovjedio miniranje brane Peruća u siječnju 1993.

Nepravomoćnu presudu za ratni zločin protiv civilnog stanovništva u prosincu 2020. donio je splitski Županijski sud na kojem će se voditi i ponovljeni postupak.

Vrhovni sud presudu je ukinuo prihvativši Đukićevu žalbu, navodeći da su u prvostupanjskoj presudi izneseni proturječni i nerazumljivi razlozi o odlučnim okolnostima pa se presuda ne može ispitati.

Povrijeđeno pravo na pravično suđenje

"Nije odlučeno o zakonitosti ispitivanja jednog svjedoka, što je bilo potrebno jer postoji sumnja da je iskaz tog svjedoka u istrazi iznuđen primjenom sile od strane policije. Te je sumnje prvostupanjski sud dužan provjeriti i ocijeniti jesu li istinite i jesu li utjecale na vjerodostojnost iskaza", naveo je Vrhovni sud.

Osim toga, razlozi o odbijanju dokaznih prijedloga obrane o alibiju i ostalim tvrdnjama obrane nisu dovoljno i pravilno obrazloženi. Time je optuženiku teško povrijeđeno pravo na pravično suđenje, objavio je Vrhovni sud.

Najviši sud je zaključio i da je pravo na pravično suđenje povrijeđeno paušalnim i proizvoljnim tumačenjima prvostupanjskog suda o nevjerodostojnosti iskaza niza ispitanih svjedoka koje je predložila obrana.

Na novom suđenju ocijenit će se svi raniji dokazi

"Budući da je time počinjena bitna povreda odredaba kaznenog postupka prvostupanjska je presuda prema zakonu morala biti ukinuta", zaključio je Vrhovni sud.

Splitski Županijski sud su obvezali da u ponovljenom postupku iznova ocijene sve ranije izvedene dokaze, a po potrebi i nove, popravi pogreške na koje je upozoren te donese novu "na zakonu zasnovanu odluku, koju će valjano obrazložiti".

Đukića tužiteljstvo tereti da je 1993. kao zapovjednik organizirao rušenje brane i hidroelektrane u Perući kako bi potopio civilne i gospodarske objekte. U temelje brane i pod most bilo je postavljeno 20 do 30 tona eksploziva, a Đukić je optužen da je zapovjedio aktiviranje eksploziva i rušenje brane.

Prema optužnici time je izazvana snažna eksplozija uslijed koje je došlo do urušavanja i oštećenja brane po cijeloj duljini i širini, a stručnjaci elektroprivrede spriječili su potpuno rušenje brane i stvaranje tzv. vodenog vala koji bi ugrozio više od 50.000 stanovnika nizvodno od brane, podsjeća Vrhovni sud.

Vrhovni sud ukinuo je presudu i naložio novo suđenje umirovljenom generalu jugoslavenske vojske Borislavu Đukiću, ranije osuđenom na deset godina zatvora zbog optužbi da je zapovjedio miniranje brane Peruća u siječnju 1993.

Nepravomoćnu presudu za ratni zločin protiv civilnog stanovništva u prosincu 2020. donio je splitski Županijski sud na kojem će se voditi i ponovljeni postupak.

Vrhovni sud presudu je ukinuo prihvativši Đukićevu žalbu, navodeći da su u prvostupanjskoj presudi izneseni proturječni i nerazumljivi razlozi o odlučnim okolnostima pa se presuda ne može ispitati.
