Zdravko i Višnja Pevec moraju platiti 364 tisuće kuna sudskih troškova nakon što su na Općinskom sudu u Zadru izgubili sudski postupak kojim su od njihovog nasljednika "Pevexa" tražili predaju u posjed dijela nekretnine u Zadru iz koje su 1990. godine počeli širiti svoju mrežu.

Osim dijela nekretnine na zadarskoj Magistrali iz koje su krenuli u osvajanje hrvatskoga tržišta, Pevecovi su u sudskom postupku od "Pevexa" tražili i isplatu mjesečne najamnine u iznosu od 14 tisuća eura od 15. siječnja 2012. godine do danas.

Zadarski sud je, međutim, odbio oba tužbena zahtjeva koja su Višnja i Zdravko Pevec još 2013. godine pokrenuli protiv društva "Pevec", pravnog prethodnika "Pevexa", te im k tome dosudio i plaćanje sudskih troškova jer nisu dostavili potvrdu o imovnom stanju.

– Prema odredbi čl. 14. st. 2. ZSP, stranka je dužna uz prijedlog za oslobođenje od plaćanja pristojbe priložiti potvrdu o imovnom stanju koju izdaje Porezna uprava Ministarstva financija. Dakle, u trenutku kada stranka postavlja zahtjev za oslobođenje od plaćanja sudske pristojbe mora dostaviti i navedenu potvrdu. Međutim, ovi tužitelji nisu postupili na taj način niti su do zaključenja glavne rasprave potvrdu dostavili – navodi se u presudi Općinskog suda u Zadru.

Oba tužbena zahtjeva Pevecovih sud je odbio nakon što je ugovore o najmu i darovanju dijela stambenog prostora u istoj zgradi njihovim sinovima Danijelu i Davorinu sud proglasio ništetnim. Prema povijesnom izvatku utvrđeno je, međutim, da Višnja i Zdravko Pevec nikada nisu bili vlasnici nekretnine jer se nisu knjižili da bi stekli vlasništvo na temelju ugovora o darovanju koji je osim toga ništetan i ne proizvodi valjane pravne učinke.

"Pevex" je u odgovoru na tužbu naveo kako prema navodnom ugovoru proizlazi da je Višnja Pevec dala u najam društvu "Pevec" d.o.o. i nekretnine svojeg supruga i direktora društva Zdravka Peveca koji je, pak, predmetni ugovor potpisao u svojstvu direktora društva, a što je suprotno odredbama Zakona o zakupu poslovnih prostorija jer ona nije mogla ugovoriti zakup za trećeg.

Konačno, smatraju da je ugovor krivotvoren jer je Višnja Pevec dala u najam svoje i suprugove nekretnine kada još nije bila upisana kao vlasnik s obzirom na to da su parnicu na utvrđenje prava vlasništva okončali tek krajem 2011. godine.

Zbog negativnog PR-a "Pevec" je u veljači ove godine promijenio ime u "Pevex". Tri godine ranije Višnja i Zdravko Pevec odbili su ponudu od sedam milijuna kuna kako bi povukli sve tužbe zbog korištenja imena, stiliziranog pijetla i slogana "Kupujte s osmijehom!" Visoki trgovački sud RH u rujnu je, međutim, odbio njihove tužbe i presudio da bračni par nema pravo na ime, logo i slogan tvrtke koju su osnovali, te "Pevecu" moraju nadoknaditi oko 700.000 kuna troškova postupka.

Prošle je godine, pak, Zdravko Pevec osuđen zbog utaje poreza kojim je državni proračun oštetio za gotovo 27 milijuna, dok je Višnja Pevec oslobođena optužbi.

Zdravko i Višnja Pevec moraju platiti 364 tisuće kuna sudskih troškova nakon što su na Općinskom sudu u Zadru izgubili sudski postupak kojim su od njihovog nasljednika "Pevexa" tražili predaju u posjed dijela nekretnine u Zadru iz koje su 1990. godine počeli širiti svoju mrežu.

Osim dijela nekretnine na zadarskoj Magistrali iz koje su krenuli u osvajanje hrvatskoga tržišta, Pevecovi su u sudskom postupku od "Pevexa" tražili i isplatu mjesečne najamnine u iznosu od 14 tisuća eura od 15. siječnja 2012. godine do danas.

Zadarski sud je, međutim, odbio oba tužbena zahtjeva koja su Višnja i Zdravko Pevec još 2013. godine pokrenuli protiv društva "Pevec", pravnog prethodnika "Pevexa", te im k tome dosudio i plaćanje sudskih troškova jer nisu dostavili potvrdu o imovnom stanju.

– Prema odredbi čl. 14. st. 2. ZSP, stranka je dužna uz prijedlog za oslobođenje od plaćanja pristojbe priložiti potvrdu o imovnom stanju koju izdaje Porezna uprava Ministarstva financija. Dakle, u trenutku kada stranka postavlja zahtjev za oslobođenje od plaćanja sudske pristojbe mora dostaviti i navedenu potvrdu. Međutim, ovi tužitelji nisu postupili na taj način niti su do zaključenja glavne rasprave potvrdu dostavili – navodi se u presudi Općinskog suda u Zadru.

Oba tužbena zahtjeva Pevecovih sud je odbio nakon što je ugovore o najmu i darovanju dijela stambenog prostora u istoj zgradi njihovim sinovima Danijelu i Davorinu sud proglasio ništetnim. Prema povijesnom izvatku utvrđeno je, međutim, da Višnja i Zdravko Pevec nikada nisu bili vlasnici nekretnine jer se nisu knjižili da bi stekli vlasništvo na temelju ugovora o darovanju koji je osim toga ništetan i ne proizvodi valjane pravne učinke.

"Pevex" je u odgovoru na tužbu naveo kako prema navodnom ugovoru proizlazi da je Višnja Pevec dala u najam društvu "Pevec" d.o.o. i nekretnine svojeg supruga i direktora društva Zdravka Peveca koji je, pak, predmetni ugovor potpisao u svojstvu direktora društva, a što je suprotno odredbama Zakona o zakupu poslovnih prostorija jer ona nije mogla ugovoriti zakup za trećeg.

Konačno, smatraju da je ugovor krivotvoren jer je Višnja Pevec dala u najam svoje i suprugove nekretnine kada još nije bila upisana kao vlasnik s obzirom na to da su parnicu na utvrđenje prava vlasništva okončali tek krajem 2011. godine.

Zbog negativnog PR-a "Pevec" je u veljači ove godine promijenio ime u "Pevex". Tri godine ranije Višnja i Zdravko Pevec odbili su ponudu od sedam milijuna kuna kako bi povukli sve tužbe zbog korištenja imena, stiliziranog pijetla i slogana "Kupujte s osmijehom!" Visoki trgovački sud RH u rujnu je, međutim, odbio njihove tužbe i presudio da bračni par nema pravo na ime, logo i slogan tvrtke koju su osnovali, te "Pevecu" moraju nadoknaditi oko 700.000 kuna troškova postupka.

Prošle je godine, pak, Zdravko Pevec osuđen zbog utaje poreza kojim je državni proračun oštetio za gotovo 27 milijuna, dok je Višnja Pevec oslobođena optužbi.

Zdravko i Višnja Pevec moraju platiti 364 tisuće kuna zbog izgubljenog spora pred zadarskim sudom, ostali su i bez vrijednih nekretnina

Zdravko i Višnja Pevec moraju platiti 364 tisuće kuna sudskih troškova nakon što su na Općinskom sudu u Zadru izgubili sudski postupak kojim su od njihovog nasljednika "Pevexa" tražili predaju u posjed dijela nekretnine u Zadru iz koje su 1990. godine počeli širiti svoju mrežu.

Osim dijela nekretnine na zadarskoj Magistrali iz koje su krenuli u osvajanje hrvatskoga tržišta, Pevecovi su u sudskom postupku od "Pevexa" tražili i isplatu mjesečne najamnine u iznosu od 14 tisuća eura od 15. siječnja 2012. godine do danas.

Zadarski sud je, međutim, odbio oba tužbena zahtjeva koja su Višnja i Zdravko Pevec još 2013. godine pokrenuli protiv društva "Pevec", pravnog prethodnika "Pevexa", te im k tome dosudio i plaćanje sudskih troškova jer nisu dostavili potvrdu o imovnom stanju....
