Vrhovni sud odbio je u srijedu žalbu Zdravka Mamića i potvrdio rješenje Županijskog suda u Osijeku da mu se sudi u odsutnosti.
Nakon odbijanja žalbe Mamićevog branitelja, Vrhovni sud je potvrdio prvostupanjsko rješenje osječkog Županijskog suda, čime je postalo pravomoćno rješenje kojim je određeno suđenje optuženiku u odsutnosti, priopćio je najviši sud ne navodeći Mamićev identitet.

Vrhovni sud je podsjetio da Uskok tereti Mamića i njegove suoptuženike da su počinili kaznena djela zlouporabe povjerenja u gospodarskom u sastavu zločinačkog udruženja. Najviši sud je dodao da je protiv Mamića raspisana međunarodna tjeralica i izdan europski uhidbeni nalog te da optuženik nije uhićen niti izručen Hrvatskoj.

Sud je dodao da Mamić, pored hrvatskog državljanstva, ima i državljanstvo Bosne i Hercegovine i da se trenutno nalazi u BiH, koja je utvrdila da nisu ispunjene zakonske pretpostavke za njegovo izručenje.     

Vrhovni sud smatra da je prvostupanjski sud pravilno utvrdio i obrazložio da postoje osobito važni razlozi za suđenje optuženiku u odsutnosti koji se očituju u činjenici da je Mamić optužen za kaznena djela koje je počinila zločinačka organizacija, a kojom je on, prema navodima optužnice, oformio i s njom rukovodio u razdoblju od preko deset godina.

''Prema optužnici oštećen je jedan od najeksponiranijih sportskih klubova u Republici Hrvatskoj, a optuženik je pri tome stekao izrazito veliku protupravnu imovinsku koristi na štetu tog kluba. Neupitna je i zainteresiranost javnosti za ishod tog kaznenog postupka'', ocijenio je Vrhovni sud.

Najviši sud je naglasio da suđenje Mamiću u odsutnosti ne umanjuje njegova prava na obranu, kao i da zakon jamči pravo na obnovu kaznenog postupka svakoj osobi koja je osuđena u odsutnosti, uz ispunjenje zakonskih pretpostavki i kad nastupi mogućnost da joj se ponovno sudi u njezinoj prisutnosti.

Temeljem prve Uskokove optužnice, Mamić je u lipnju 2018. na osječkom sudu nepravomoćno osuđen na šest i pol godina zatvora, zbog izvlačenja oko 116 milijuna kuna iz Dinama, a neposredno uoči izricanja te presude otišao je u Bosnu i Hercegovinu.

U svibnju 2019. optužno vijeće osječkog Županijskog suda potvrdilo je i drugu Uskokovu optužnicu protiv Mamića i još šestorice okrivljenika, koje tužiteljstvo tereti da su, u sklopu zločinačkog udruženja, ovaj klub oštetili za oko 200 milijuna kuna.

Drugom optužnicom, uz Zdravka Mamića, obuhvaćeni su njegov sin Mario, brat Zoran, bivši Dinamov direktor Damir Vrbanović, poduzetnici Sandro Stipančić i Igor Krota te menadžer Nikky Artur Vuksan. Unatoč potvrđivanju ove optužnice, pravosudna tijela BiH zaključila su kako nema pretpostavki za izručenje Zdravka Mamića Hrvatskoj.  

S tim je slučaju u listopadu 2019. spojena i treća potvrđena optužnicu protiv Mamića prema kojoj je kao član izvršnog odbora kluba s računa GNK Dinama u Klagenfurtu od rujna 2002. do ožujka 2007. izvukao 16,7 milijuna kuna.

Vrhovni sud odbio je u srijedu žalbu Zdravka Mamića i potvrdio rješenje Županijskog suda u Osijeku da mu se sudi u odsutnosti.
Nakon odbijanja žalbe Mamićevog branitelja, Vrhovni sud je potvrdio prvostupanjsko rješenje osječkog Županijskog suda, čime je postalo pravomoćno rješenje kojim je određeno suđenje optuženiku u odsutnosti, priopćio je najviši sud ne navodeći Mamićev identitet.

Vrhovni sud je podsjetio da Uskok tereti Mamića i njegove suoptuženike da su počinili kaznena djela zlouporabe povjerenja u gospodarskom u sastavu zločinačkog udruženja. Najviši sud je dodao da je protiv Mamića raspisana međunarodna tjeralica i izdan europski uhidbeni nalog te da optuženik nije uhićen niti izručen Hrvatskoj.

Sud je dodao da Mamić, pored hrvatskog državljanstva, ima i državljanstvo Bosne i Hercegovine i da se trenutno nalazi u BiH, koja je utvrdila da nisu ispunjene zakonske pretpostavke za njegovo izručenje.     

Vrhovni sud smatra da je prvostupanjski sud pravilno utvrdio i obrazložio da postoje osobito važni razlozi za suđenje optuženiku u odsutnosti koji se očituju u činjenici da je Mamić optužen za kaznena djela koje je počinila zločinačka organizacija, a kojom je on, prema navodima optužnice, oformio i s njom rukovodio u razdoblju od preko deset godina.

''Prema optužnici oštećen je jedan od najeksponiranijih sportskih klubova u Republici Hrvatskoj, a optuženik je pri tome stekao izrazito veliku protupravnu imovinsku koristi na štetu tog kluba. Neupitna je i zainteresiranost javnosti za ishod tog kaznenog postupka'', ocijenio je Vrhovni sud.

Najviši sud je naglasio da suđenje Mamiću u odsutnosti ne umanjuje njegova prava na obranu, kao i da zakon jamči pravo na obnovu kaznenog postupka svakoj osobi koja je osuđena u odsutnosti, uz ispunjenje zakonskih pretpostavki i kad nastupi mogućnost da joj se ponovno sudi u njezinoj prisutnosti.

Temeljem prve Uskokove optužnice, Mamić je u lipnju 2018. na osječkom sudu nepravomoćno osuđen na šest i pol godina zatvora, zbog izvlačenja oko 116 milijuna kuna iz Dinama, a neposredno uoči izricanja te presude otišao je u Bosnu i Hercegovinu.

U svibnju 2019. optužno vijeće osječkog Županijskog suda potvrdilo je i drugu Uskokovu optužnicu protiv Mamića i još šestorice okrivljenika, koje tužiteljstvo tereti da su, u sklopu zločinačkog udruženja, ovaj klub oštetili za oko 200 milijuna kuna.

Drugom optužnicom, uz Zdravka Mamića, obuhvaćeni su njegov sin Mario, brat Zoran, bivši Dinamov direktor Damir Vrbanović, poduzetnici Sandro Stipančić i Igor Krota te menadžer Nikky Artur Vuksan. Unatoč potvrđivanju ove optužnice, pravosudna tijela BiH zaključila su kako nema pretpostavki za izručenje Zdravka Mamića Hrvatskoj.  

S tim je slučaju u listopadu 2019. spojena i treća potvrđena optužnicu protiv Mamića prema kojoj je kao član izvršnog odbora kluba s računa GNK Dinama u Klagenfurtu od rujna 2002. do ožujka 2007. izvukao 16,7 milijuna kuna.

Vrhovni sud odbio žalbu Zdravka Mamića, odbjeglom gazdi Dinama sudit će se u odsutnosti zbog izvlačenja novca iz Maksimira

Vrhovni sud odbio je u srijedu žalbu Zdravka Mamića i potvrdio rješenje Županijskog suda u Osijeku da mu se sudi u odsutnosti.
Nakon odbijanja žalbe Mamićevog branitelja, Vrhovni sud je potvrdio prvostupanjsko rješenje osječkog Županijskog suda, čime je postalo pravomoćno rješenje kojim je određeno suđenje optuženiku u odsutnosti, priopćio je najviši sud ne navodeći Mamićev identitet.

Vrhovni sud je podsjetio da Uskok tereti Mamića i njegove suoptuženike da su počinili kaznena djela zlouporabe povjerenja u gospodarskom u sastavu zločinačkog udruženja. Najviši sud je dodao da je protiv Mamića raspisana međunarodna tjeralica i izdan europski uhidbeni nalog te da optuženik nije uhićen niti izručen Hrvatskoj.
