Konačnu odluku donio je Vrhovni sud tri godine nakon što je ovaj bivši galovački načelnik nakon maratonskog sudskog postupka na Županijskom sudu u Zadru nepravomoćno oslobođen optužbi za nezakonito korištenje općinskog novca.

Izmijenjenom optužnicom teretilo ga se da je tijekom 2002. godine, s namjerom da se nepripadno materijalno okoristi, nakon podizanja gotovine sa žiroračuna Općine Galovac, u više navrata nalagao i obavljao isplate gotovine bez valjane osnove, te fizičkim osobama za obavljene povremene poslove nije obračunavao porez na dohodak za najmanje 30 tisuća kuna.

– Časno sam oslobođen kao građanin. Vrhovni sud donio je takvu odluku i tko to može uopće komentirati? Mogu samo reći da sam tamo bio i da je sve bilo pravedno. Presudu su donijeli ljudi odjeveni u kute – kazao je Šare, koji je 2011. godine oslobođen na prvostupanjskom sudu. Raspravno vijeće tada je zaključilo da optužba nije dokazala da je optuženik Slavko Šare počinio kaznena djela za koja ga se teretilo izmijenjenom optužnicom.

– Brojni svjedoci i suoptuženici potvrdili su da su kao fizičke osobe isplaćeni za određene radove za Općinu Galovac, što znači da su isplate provođene na temelju pravne osnove za obavljeni rad – kazala je tada predsjednica Sudskog vijeća Enka Moković u obrazloženju presude.

Na tu se presudu žalio županijski državni odvjetnik, smatrajući kako je prvostupanjski sud počinio bitnu povredu odredaba kaznenog postupka.

Vrhovni sud je, međutim, tu žalbu odbio navodeći kako nije počinjena ni jedna bitna povreda. Kako navodi Vrhovni sud, kaznena djela koja su se Šari stavljala na teret počinjena su tijekom 2002. godine, pa je za njih nastupila apsolutna zastara.

Konačnu odluku donio je Vrhovni sud tri godine nakon što je ovaj bivši galovački načelnik nakon maratonskog sudskog postupka na Županijskom sudu u Zadru nepravomoćno oslobođen optužbi za nezakonito korištenje općinskog novca.

Izmijenjenom optužnicom teretilo ga se da je tijekom 2002. godine, s namjerom da se nepripadno materijalno okoristi, nakon podizanja gotovine sa žiroračuna Općine Galovac, u više navrata nalagao i obavljao isplate gotovine bez valjane osnove, te fizičkim osobama za obavljene povremene poslove nije obračunavao porez na dohodak za najmanje 30 tisuća kuna.

– Časno sam oslobođen kao građanin. Vrhovni sud donio je takvu odluku i tko to može uopće komentirati? Mogu samo reći da sam tamo bio i da je sve bilo pravedno. Presudu su donijeli ljudi odjeveni u kute – kazao je Šare, koji je 2011. godine oslobođen na prvostupanjskom sudu. Raspravno vijeće tada je zaključilo da optužba nije dokazala da je optuženik Slavko Šare počinio kaznena djela za koja ga se teretilo izmijenjenom optužnicom.

– Brojni svjedoci i suoptuženici potvrdili su da su kao fizičke osobe isplaćeni za određene radove za Općinu Galovac, što znači da su isplate provođene na temelju pravne osnove za obavljeni rad – kazala je tada predsjednica Sudskog vijeća Enka Moković u obrazloženju presude.

Na tu se presudu žalio županijski državni odvjetnik, smatrajući kako je prvostupanjski sud počinio bitnu povredu odredaba kaznenog postupka.

Vrhovni sud je, međutim, tu žalbu odbio navodeći kako nije počinjena ni jedna bitna povreda. Kako navodi Vrhovni sud, kaznena djela koja su se Šari stavljala na teret počinjena su tijekom 2002. godine, pa je za njih nastupila apsolutna zastara.

Bivši načelnik općine Galovac Slavko Šare pravomoćno je oslobođen krivnje za zlouporabu položaja i ovlasti, krivotvorenje službenih isprava i povredu obaveze vođenja općinskih poslovnih knjiga.
