Slaven Žužul, vlasnik "Skladgradnje" i čelnik RNK Split, široj javnosti poznatiji po aferi "bojanja tunela" koja je s vremenom postala sinonimom za korupciju u državi - a koja još nije pravosudno niti započela jer se već četiri godine čeka potvrđivanje optužnice - izvukao se u zadnji trenutak od pravomoćne zatvorske kazne u puno "benignijem" predmetu.

Spasio se zahvaljujući apsurdnosti i, ako hoćete, nelogičnosti hrvatskog kaznenog zakonodavstva.

Naime, Žužul je pravomoćnom presudom Općinskog suda u Splitu, odnosno kaznenim nalogom ODO-a Split, još 3. rujna 2018. godine osuđen na novčanu kaznu od 120 dnevnih dohodaka, odnosno 14 tisuća kuna koje je morao platiti u roku od šest mjeseci. Osuđen je, prema optužnici ODO-a, za dva kaznena djela jer radnicima "Skladgradnje" nije od srpnja 2016. do prosinca 2017. godine isplatio plaće niti im je obračunavao poreze, davanja i doprinose.

Dvije godine nakon pravomoćnosti, s obzirom na to da Žužul usprkos svim rokovima nije platio kaznu, Općinski sud u Splitu rješenjem je zamijenio novčanu kaznu za zatvorsku, i to tako da je za jedan dnevni iznos uračunat jedan dan zatvora. Dakle, tom je odlukom Žužulu određeno da mora u zatvor 120 dana.

Šansa za šansom

Naravno, on se osobno na tu odluku žalio, tražeći da se ukine i da se vrati na ponovno odlučivanje zbog apsolutne povrede kaznenog prava i nepotpuno utvrđenog činjeničnog stanja. Vijeće višeg, dakle Županijskog suda u Splitu prije desetak dana odbilo je njegovu žalbu, čime je odluka o zamjeni novčane kazne zatvorskom postala pravomoćna.

U njoj se, među ostalim, ističe i da je pravomoćna presuda poslana Fini radi prisilne naplate, no da su oni izvijestili početkom prosinca 2019. godine da osuđenik nema sredstava na računu, pa je naplatu bilo nemoguće provesti. Kažu i da je Žužul mogao tražiti i produljenje roka plaćanja, a to nije napravio, kao što nije iskoristio niti mogućnost obročnog plaćanja ili makar, za početak, plaćanja jednog dijela duga.

Davalo je hrvatsko pravosuđe Žužulu još šansi. Tako je, nakon dopisa Fine da nema sredstava na računu, sud Žužulu poslao dopis da se izjasni u roku od osam dana pristaje li da se novčana kazna zamijeni radom za opće dobro te je upozoren da će, ako se ne očituje, novčana kazna biti zamijenjena zatvorom.

"Budući da se osuđenik nije očitovao ni u ostavljenom roku niti je to učinio ikada kasnije, premda je bio upozoren na pravne posljedice nepostupanja, prvostupanjski je sud potpuno ispravno i zakonito novčanu kaznu zamijenio kaznom zatvora, zbog čega se osuđenik neosnovano žali", stoji u pravomoćnoj odluci splitskog Županijskog suda.

Dakle, po tom bi proizlazilo da je Žužul "ispucao" sve svoje prilike i da nakon tolike pravne procedure sad napokon nema više mogućnosti izbjegavanja već da mora u zatvor. E, ali onda nastupa zadnji stadij milosrđa našeg zakonodavstva koje daje priliku osuđeniku, po čl. 43 st. 5 KZ-a, da usprkos pravomoćnosti rješenja o zamjeni novčane kazne zatvorskom izbjegne zatvor ako ipak uplati novac. I naravno da je, stjeran pred zid, naš junak odlučio iskoristiti zadnju šansu.

Opasna ćelija

- Evo sad ću uplatiti internet bankarstvom i obavijestiti sud, šaljem i vama potvrdu ako treba. Ma, nitko nije preuzimao poštu tako da nisam znao za ovu odluku. Pa nećete valjda sad raditi cirkus oko toga, nema potrebe - kazao nam je Žužul, koji je od nas saznao za pravomoćnu odluku.

Pitamo ga zašto nije kaznu prije platio, a očito je znao sve što se događa.

- Ja sam, kao i svaki građanin, htio koristiti sve raspoložive pravne lijekove. E sad kad je rješenje pravomoćno, kad je došlo ili plati ili ajde gulit kumpire, nema više mrdanja, sad ću platiti - komentirao nam je Žužul.

U slučaju da ipak ne plati kaznu, ne bi u zatvoru gulio krumpire kako on to misli (jer pravomoćna nije kazna o radu za opće dobro) već bi se četiri mjeseca družio u ćeliji s nekim mnogo "priprostijim" zločincima poput ubojica, silovatelja, dilera i slično.

Slaven Žužul, vlasnik "Skladgradnje" i čelnik RNK Split, široj javnosti poznatiji po aferi "bojanja tunela" koja je s vremenom postala sinonimom za korupciju u državi - a koja još nije pravosudno niti započela jer se već četiri godine čeka potvrđivanje optužnice - izvukao se u zadnji trenutak od pravomoćne zatvorske kazne u puno "benignijem" predmetu.

Spasio se zahvaljujući apsurdnosti i, ako hoćete, nelogičnosti hrvatskog kaznenog zakonodavstva.

Naime, Žužul je pravomoćnom presudom Općinskog suda u Splitu, odnosno kaznenim nalogom ODO-a Split, još 3. rujna 2018. godine osuđen na novčanu kaznu od 120 dnevnih dohodaka, odnosno 14 tisuća kuna koje je morao platiti u roku od šest mjeseci. Osuđen je, prema optužnici ODO-a, za dva kaznena djela jer radnicima "Skladgradnje" nije od srpnja 2016. do prosinca 2017. godine isplatio plaće niti im je obračunavao poreze, davanja i doprinose.

Dvije godine nakon pravomoćnosti, s obzirom na to da Žužul usprkos svim rokovima nije platio kaznu, Općinski sud u Splitu rješenjem je zamijenio novčanu kaznu za zatvorsku, i to tako da je za jedan dnevni iznos uračunat jedan dan zatvora. Dakle, tom je odlukom Žužulu određeno da mora u zatvor 120 dana.

Šansa za šansom

Naravno, on se osobno na tu odluku žalio, tražeći da se ukine i da se vrati na ponovno odlučivanje zbog apsolutne povrede kaznenog prava i nepotpuno utvrđenog činjeničnog stanja. Vijeće višeg, dakle Županijskog suda u Splitu prije desetak dana odbilo je njegovu žalbu, čime je odluka o zamjeni novčane kazne zatvorskom postala pravomoćna.

U njoj se, među ostalim, ističe i da je pravomoćna presuda poslana Fini radi prisilne naplate, no da su oni izvijestili početkom prosinca 2019. godine da osuđenik nema sredstava na računu, pa je naplatu bilo nemoguće provesti. Kažu i da je Žužul mogao tražiti i produljenje roka plaćanja, a to nije napravio, kao što nije iskoristio niti mogućnost obročnog plaćanja ili makar, za početak, plaćanja jednog dijela duga.

Davalo je hrvatsko pravosuđe Žužulu još šansi. Tako je, nakon dopisa Fine da nema sredstava na računu, sud Žužulu poslao dopis da se izjasni u roku od osam dana pristaje li da se novčana kazna zamijeni radom za opće dobro te je upozoren da će, ako se ne očituje, novčana kazna biti zamijenjena zatvorom.

"Budući da se osuđenik nije očitovao ni u ostavljenom roku niti je to učinio ikada kasnije, premda je bio upozoren na pravne posljedice nepostupanja, prvostupanjski je sud potpuno ispravno i zakonito novčanu kaznu zamijenio kaznom zatvora, zbog čega se osuđenik neosnovano žali", stoji u pravomoćnoj odluci splitskog Županijskog suda.

Dakle, po tom bi proizlazilo da je Žužul "ispucao" sve svoje prilike i da nakon tolike pravne procedure sad napokon nema više mogućnosti izbjegavanja već da mora u zatvor. E, ali onda nastupa zadnji stadij milosrđa našeg zakonodavstva koje daje priliku osuđeniku, po čl. 43 st. 5 KZ-a, da usprkos pravomoćnosti rješenja o zamjeni novčane kazne zatvorskom izbjegne zatvor ako ipak uplati novac. I naravno da je, stjeran pred zid, naš junak odlučio iskoristiti zadnju šansu.

Opasna ćelija

- Evo sad ću uplatiti internet bankarstvom i obavijestiti sud, šaljem i vama potvrdu ako treba. Ma, nitko nije preuzimao poštu tako da nisam znao za ovu odluku. Pa nećete valjda sad raditi cirkus oko toga, nema potrebe - kazao nam je Žužul, koji je od nas saznao za pravomoćnu odluku.

Pitamo ga zašto nije kaznu prije platio, a očito je znao sve što se događa.

- Ja sam, kao i svaki građanin, htio koristiti sve raspoložive pravne lijekove. E sad kad je rješenje pravomoćno, kad je došlo ili plati ili ajde gulit kumpire, nema više mrdanja, sad ću platiti - komentirao nam je Žužul.

U slučaju da ipak ne plati kaznu, ne bi u zatvoru gulio krumpire kako on to misli (jer pravomoćna nije kazna o radu za opće dobro) već bi se četiri mjeseca družio u ćeliji s nekim mnogo "priprostijim" zločincima poput ubojica, silovatelja, dilera i slično.

Slaven Žužul, vlasnik "Skladgradnje" i čelnik RNK Split, široj javnosti poznatiji po aferi "bojanja tunela" koja je s vremenom postala sinonimom za korupciju u državi - a koja još nije pravosudno niti započela jer se već četiri godine čeka potvrđivanje optužnice - izvukao se u zadnji trenutak od pravomoćne zatvorske kazne u puno "benignijem" predmetu.

Spasio se zahvaljujući apsurdnosti i, ako hoćete, nelogičnosti hrvatskog kaznenog zakonodavstva.

Naime, Žužul je pravomoćnom presudom Općinskog suda u Splitu, odnosno kaznenim nalogom ODO-a Split, još 3. rujna 2018. godine osuđen na novčanu kaznu od 120 dnevnih dohodaka, odnosno 14 tisuća kuna koje je morao platiti u roku od šest mjeseci. Osuđen je, prema optužnici ODO-a, za dva kaznena djela jer radnicima "Skladgradnje" nije...
