Iako je prošlo točno 15 godina od strašnog zločina, obiteljske tragedije u Vučevici, slučaj još nije završen - danas je pred Općinskim sudom u Splitu donesena presuda u postupku radi naknade štete prema kojoj pravomoćno osuđeni ubojica treba platiti obitelji 135 tisuća eura!

Sve se događalo prvog dana 2009. godine u Vučevici, zaseok Boljati, ispred obiteljske kuće Ante Boljata, danas 78-godišnjaka. Prema pravomoćnoj presudi, Ante Boljat je u alkoholoziranom stanju ušao u raspravu i naguravanje sa zetom Ivicom Dugandžićem koji je tada imao 33 godina, čak ga je udario šakom u glavu, a nakon toga je otišao u sobu po M-48.

Vratio se brzo te s udaljenosti od dva metra ispalio jedan hitac u zeta – metak ga je pogodio u grudni koš, ali to nije bilo dovoljno za Boljata, prišao je već nemoćnom muškarcu koji je ležao na tlu te mu prislonio cijev oružja uz glavu i potom ispalio još jedan hitac.

Opis ozljeda iz sudske presude je dovoljno grozomoran - prostrijelna rana glave s prijelomom kostiju svoda baze lubanje i oštećenjem mozgovine; prostrijelna rana desne strane prsnog koša s oštećenjem desne porebrice, desnog režnja jetre i desnog bubrega te prijelomom prsne kralježnice i sedmog rebra desno – no strašan dojam cijelom zločinu dodaje činjenica da se sve odvijalo pred majkom ubijenog.

Ana Dugandžić ne samo da je pokušavala pomoći sinu, nego je dobila nekoliko udaraca nogom od Ante Boljata, a zadobila je i ozljede od ispaljenog metka jer su je krhotine pogodile u abdomen i natkoljenicu. No, ozljede je od barutnih čestica zadobila i Marijana Dugandžić koja je također pokušavala pomoći suprugu Ivici, a istovremeno je i kćer ubojice, kojoj su dijagnosticirane ‘točkasti defekti kože, crvenilo i otok desne jagodice lica te podljev kože čela‘.

U kaznenom dijelu postupka sve je okončano vrlo brzo, gotovo nevjerojatno brzo za naše pravosuđe. Do kraja godine je pred splitskim Županijskim sudom osuđen na 12 i pol godina zatvora (dobio je 12 godina za ubojstvo, a za lakše ranjavanje krhotinama streljiva Ane Dugandžić i Marijane Dugandžić dobio je deset mjeseci), da bi već u svibnju 2010. godine Vrhovni sud pravomoćno potvrdio presudu, ali su povisili kaznu na 15 godina iza rešetaka. Iako se u tom trenutku to činilo kao doživotna kazna zatvora za Antu Boljata, sve je odslužio te je došao na objavu ove presude za naknadu štete.

Boljat, kojem su tada izmjerili 1,91 promila alkohola, branio se kako je ‘njegova kći krvnički mučena od strane muža i svekrve što je njega kao oca jako boljelo‘. Tog dana su mu ‘zet i njegova majka doveli kćer, vratiti je kao isluženi otirač, tada je udario, a mene uhvatio na vrat i gurao na užareni štednjak...‘, dio je obrane Ante Boljata, koja mu međutim nije pomogla niti pri određivanju kazne, a nije ni u ovom postupku za naknadu štete.

Obitelji ubijenog Ivice Dugandžića – majka, otac i sestra – tako su pored neimovinske štete za duševne boli radi smrti sina, odnosno brata, te ostale imovinske štete, naglasili taj element navodnog zlostavljanja Marijane Dugandžić.

Prema tužbenom zahtjevu, upravo je to što su Ante Boljat, njegova kćer Marijana Dugandžić koja je bila u braku s ubijenim, te njen brat, nakon zločina govorili kako su Marijanu zlostavljali, fizički i psihički, što su ‘izmišljotine koje su tužitelji čuli u teškim trenucima prilikom čega da im je bilo povrijeđeno pravo osobnosti i to na dostojanstvo, ugled, čast i ime, a zbog svega su uslijedile posljedice na duševno zdravlje tužitelja...‘

Sud je djelomično prihvatio tužbeni zahtjev te je na presuda obrazložena na 23 stranice sudskog spisa. Najbitnije je kako je splitski sud prihvatio navode Vrhovnog suda kako nije bilo ni govora o nekakvom ubojstvu na mah, nego je Ante Boljat svjesno i s izravnom namjerom ispalio hice. Također, prigovori o događajima u obitelji Dugandžić – da je Marijana godinama trpjela navodno zlostavljanje i maltretiranje te da je bila financijski iskorištavana – sud ne samo da nije prihvatio nego je ocijenio ‘neosnovanim, čak i neprimjerenim kad se ima u vidu bezobzirna egzekucija mlade osobe pred očima njegove majke‘...

Ani Dugandžić je Ante Boljat dužan na ime nematerijalne štete isplatiti 80.695 eura za zateznom kamatom od dana presude, sestri ubijenog na ime nematerijalne štete isplatiti 30.526 tisuća eura, zatim na ime imovinske štete iznos od dvije i pol tisuće eura, pa onda na ime imovinske štete izgradnje grobnice za jednu osobu s nadgrobnim spomenikom 8.187 eura te konačno nešto manje od 15 tisuća eura na ime troškova postupka.

Iako je prošlo točno 15 godina od strašnog zločina, obiteljske tragedije u Vučevici, slučaj još nije završen - danas je pred Općinskim sudom u Splitu donesena presuda u postupku radi naknade štete prema kojoj pravomoćno osuđeni ubojica treba platiti obitelji 135 tisuća eura!

Sve se događalo prvog dana 2009. godine u Vučevici, zaseok Boljati, ispred obiteljske kuće Ante Boljata, danas 78-godišnjaka. Prema pravomoćnoj presudi, Ante Boljat je u alkoholoziranom stanju ušao u raspravu i naguravanje sa zetom Ivicom Dugandžićem koji je tada imao 33 godina, čak ga je udario šakom u glavu, a nakon toga je otišao u sobu po M-48.

Vratio se brzo te s udaljenosti od dva metra ispalio jedan hitac u zeta – metak ga je pogodio u grudni koš, ali to nije bilo dovoljno za Boljata, prišao je već nemoćnom muškarcu koji je ležao na tlu te mu prislonio cijev oružja uz glavu i potom ispalio još jedan hitac.

Opis ozljeda iz sudske presude je dovoljno grozomoran - prostrijelna rana glave s prijelomom kostiju svoda baze lubanje i oštećenjem mozgovine; prostrijelna rana desne strane prsnog koša s oštećenjem desne porebrice, desnog režnja jetre i desnog bubrega te prijelomom prsne kralježnice i sedmog rebra desno – no strašan dojam cijelom zločinu dodaje činjenica da se sve odvijalo pred majkom ubijenog.

Ana Dugandžić ne samo da je pokušavala pomoći sinu, nego je dobila nekoliko udaraca nogom od Ante Boljata, a zadobila je i ozljede od ispaljenog metka jer su je krhotine pogodile u abdomen i natkoljenicu. No, ozljede je od barutnih čestica zadobila i Marijana Dugandžić koja je također pokušavala pomoći suprugu Ivici, a istovremeno je i kćer ubojice, kojoj su dijagnosticirane ‘točkasti defekti kože, crvenilo i otok desne jagodice lica te podljev kože čela‘.

U kaznenom dijelu postupka sve je okončano vrlo brzo, gotovo nevjerojatno brzo za naše pravosuđe. Do kraja godine je pred splitskim Županijskim sudom osuđen na 12 i pol godina zatvora (dobio je 12 godina za ubojstvo, a za lakše ranjavanje krhotinama streljiva Ane Dugandžić i Marijane Dugandžić dobio je deset mjeseci), da bi već u svibnju 2010. godine Vrhovni sud pravomoćno potvrdio presudu, ali su povisili kaznu na 15 godina iza rešetaka. Iako se u tom trenutku to činilo kao doživotna kazna zatvora za Antu Boljata, sve je odslužio te je došao na objavu ove presude za naknadu štete.

Boljat, kojem su tada izmjerili 1,91 promila alkohola, branio se kako je ‘njegova kći krvnički mučena od strane muža i svekrve što je njega kao oca jako boljelo‘. Tog dana su mu ‘zet i njegova majka doveli kćer, vratiti je kao isluženi otirač, tada je udario, a mene uhvatio na vrat i gurao na užareni štednjak...‘, dio je obrane Ante Boljata, koja mu međutim nije pomogla niti pri određivanju kazne, a nije ni u ovom postupku za naknadu štete.

Obitelji ubijenog Ivice Dugandžića – majka, otac i sestra – tako su pored neimovinske štete za duševne boli radi smrti sina, odnosno brata, te ostale imovinske štete, naglasili taj element navodnog zlostavljanja Marijane Dugandžić.

Prema tužbenom zahtjevu, upravo je to što su Ante Boljat, njegova kćer Marijana Dugandžić koja je bila u braku s ubijenim, te njen brat, nakon zločina govorili kako su Marijanu zlostavljali, fizički i psihički, što su ‘izmišljotine koje su tužitelji čuli u teškim trenucima prilikom čega da im je bilo povrijeđeno pravo osobnosti i to na dostojanstvo, ugled, čast i ime, a zbog svega su uslijedile posljedice na duševno zdravlje tužitelja...‘

Sud je djelomično prihvatio tužbeni zahtjev te je na presuda obrazložena na 23 stranice sudskog spisa. Najbitnije je kako je splitski sud prihvatio navode Vrhovnog suda kako nije bilo ni govora o nekakvom ubojstvu na mah, nego je Ante Boljat svjesno i s izravnom namjerom ispalio hice. Također, prigovori o događajima u obitelji Dugandžić – da je Marijana godinama trpjela navodno zlostavljanje i maltretiranje te da je bila financijski iskorištavana – sud ne samo da nije prihvatio nego je ocijenio ‘neosnovanim, čak i neprimjerenim kad se ima u vidu bezobzirna egzekucija mlade osobe pred očima njegove majke‘...

Ani Dugandžić je Ante Boljat dužan na ime nematerijalne štete isplatiti 80.695 eura za zateznom kamatom od dana presude, sestri ubijenog na ime nematerijalne štete isplatiti 30.526 tisuća eura, zatim na ime imovinske štete iznos od dvije i pol tisuće eura, pa onda na ime imovinske štete izgradnje grobnice za jednu osobu s nadgrobnim spomenikom 8.187 eura te konačno nešto manje od 15 tisuća eura na ime troškova postupka.
