stdClass Object ( [id] => 256419 [title] => Previd Državnog odvjetništva: Nisu oštetili ‘Pomgrad’ za 480 tisuća kuna [alias] => previd-drzavnog-odvjetnistva-nisu-ostetili-pomgrad-za-480-tisuca-kuna [catid] => 243 [published] => 1 [introtext] => [fulltext] => Županijski sud u Splitu ovih je dana pravomoćno oslobodio Krešimira Dulčića, bivšeg direktora tvrtke “Pomgrad” iz Splita, Antu Radovnikovića, bivšeg šefa marketinga u “Pomgradu”, i Gordana Pintara, vlasnika i direktora tvrtke MPB iz Splita, optužbe da su “Pomgrad” oštetili za oko 480.000 kuna.

Optužba se odnosi na posao iz prosinca 1997. godine, kada je ugovorena prodaja betonare od strane MPB-a “Pomgradu”. Posao je i realiziran, i to na način da je “Pomgrad” betoranu platio kompenzacijom, tucanikom iz kamenoloma Klis-Kosa. Problem je bio u cijenama. Prema optužnici, MPB je betonaru uvezao iz Slovenije, a bila je riječ o pogonu iz 1983. godine, koju su platili 40.000 tadašnjih njemačkih maraka. “Pomgrad” je za taj pogon potom platio 790.000 kuna.

Državno odvjetništvo teretilo ih je da su MPB-u probavili znatnu nepripadajuću imovinsku korist, i to grubim kršenjem zakona ili pravila poslovanja. No, u optužnici nisu naveli koje su točno propise, odnosno pravila poslovanja, okrivljeni prekršili. Općinski sud, koji je presudu donio u srpnju ove godine, kaže kako sud ne smije ulaziti u takve izmjene optužnice sam. Zbog nedostatka u optužnici, uopće se nije ni ulazilo u utvrđivanje činjenica vezano uz događaj koji se okrivljenima stavljao na teret.

Očito je da je na Državnom odvjetništvu nakon ove presude došlo do “barufe” jer se iz presude Županijskog suda vidi da je spis s Općinskoga prešao na Županijsko državno odvjetništvo, a žalbu je na sudskom vijeću zastupao zamjenik županijskog državnog odvjetnika. Naveli su u žalbi koju točno odredbu Zakona o trgovačkim društvima obuhvaća optužnica, ali nije pomoglo jer se sama optužnica nakon zaključenja rasprave na Općinskom sudu ne može mijenjati.

Županijski sud je tako potvrdio prvostupanjsku presudu.

“Upravo navedene odredbe ZTD-a trebao je državni odvjetnik ugraditi u činjenični opis djela”, navodi Županijski sud, zaključujući kako se po podnesenoj optužnici uopće nema o čemu razgovarati. Valja napomenuti i da su okrivljenici pritom izrazili žaljenje što je kazneni postupak toliko dugo trajao, kao i zato što se nije ulazilo u činjenično stanje, jer bi tako dokazali da s kaznenim djelom nemaju nikakve veze.

Optužba se odnosi na posao iz prosinca 1997. godine, kada je ugovorena prodaja betonare od strane MPB-a “Pomgradu”. Posao je i realiziran, i to na način da je “Pomgrad” betoranu platio kompenzacijom, tucanikom iz kamenoloma Klis-Kosa. Problem je bio u cijenama. Prema optužnici, MPB je betonaru uvezao iz Slovenije, a bila je riječ o pogonu iz 1983. godine, koju su platili 40.000 tadašnjih njemačkih maraka. “Pomgrad” je za taj pogon potom platio 790.000 kuna.

Državno odvjetništvo teretilo ih je da su MPB-u probavili znatnu nepripadajuću imovinsku korist, i to grubim kršenjem zakona ili pravila poslovanja. No, u optužnici nisu naveli koje su točno propise, odnosno pravila poslovanja, okrivljeni prekršili. Općinski sud, koji je presudu donio u srpnju ove godine, kaže kako sud ne smije ulaziti u takve izmjene optužnice sam. Zbog nedostatka u optužnici, uopće se nije ni ulazilo u utvrđivanje činjenica vezano uz događaj koji se okrivljenima stavljao na teret.

Očito je da je na Državnom odvjetništvu nakon ove presude došlo do “barufe” jer se iz presude Županijskog suda vidi da je spis s Općinskoga prešao na Županijsko državno odvjetništvo, a žalbu je na sudskom vijeću zastupao zamjenik županijskog državnog odvjetnika. Naveli su u žalbi koju točno odredbu Zakona o trgovačkim društvima obuhvaća optužnica, ali nije pomoglo jer se sama optužnica nakon zaključenja rasprave na Općinskom sudu ne može mijenjati.

Županijski sud je tako potvrdio prvostupanjsku presudu.

“Upravo navedene odredbe ZTD-a trebao je državni odvjetnik ugraditi u činjenični opis djela”, navodi Županijski sud, zaključujući kako se po podnesenoj optužnici uopće nema o čemu razgovarati. Valja napomenuti i da su okrivljenici pritom izrazili žaljenje što je kazneni postupak toliko dugo trajao, kao i zato što se nije ulazilo u činjenično stanje, jer bi tako dokazali da s kaznenim djelom nemaju nikakve veze.
