Nepravomoćnom presudom Županijskog suda u Dubrovniku, bivši predsjednik Uprave trgovačke tvrtke Razvitak iz Metkovića Tonći Jerković (55) te članovi Uprave Vedran Damić (49) i Željko Leko (52), kao i bivši predsjednik Nadzornog odbora tog poduzeća Ivan Gabrić (75) oslobođeni su optužbe da su počinili kazneno djelo zloporabe položaja i ovlasti na štetu spomenutoga metkovskog poduzeća.

Optužnica Županijskog državnog odvjetništva teretila je bivše članove Uprave Razvitka da su u srpnju 2000. godine, u cilju nezakonitog pribavljanja velike imovinske koristi, donijeli Naputak kojim su blagajni tvrtke naložili isplatu velike razlike u visini osobnih dohodaka.

Optužnica je Gabrića teretila da je kao predsjednik Nadzornog odbora s Jerkovićem, Damićem i Lekom sklopio izmjene i dopune Ugovora o radu i prema njima im omogućio nezakonitu isplatu uvećanih plaća, odnosno razlike između uplaćene i ugovorene plaće.

Naime, članovima Uprave su, zbog financijskih problema Razvitka, u razdoblju od 1996. do ožujka 2000. godine isplaćivane plaće manje nego su im pripadale po ugovoru o radu. Prema optužnici, shodno donesenom naputku, iz blagajne Razvitkove tvrtke kćeri Razvitak održavanje d.o.o., na štetu Razvitka d.d., isplaćene su im razlike do visine ugovornih 5,7 - 6 prosječnih neto osobnih dohodaka Razvitka, te je po toj osnovi Jerkoviću isplaćeno 140.655 kuna, Damiću 135.652, a Leku 133.641 kuna.

U dokaznom su se postupku okrivljenici redom pozivali na zaborav dijela detalja, ali su nakon čitanja prijašnjih izjava potvrdili dane iskaze. No, oslobađajuća je presuda ipak donesena jer je Sudsko vijeće zaključilo kako kazneno djelo nije počinjeno jer je okrivljenima isplaćeno ono što im pripada po ugovorima o radu.

Nepravomoćnom presudom Županijskog suda u Dubrovniku, bivši predsjednik Uprave trgovačke tvrtke Razvitak iz Metkovića Tonći Jerković (55) te članovi Uprave Vedran Damić (49) i Željko Leko (52), kao i bivši predsjednik Nadzornog odbora tog poduzeća Ivan Gabrić (75) oslobođeni su optužbe da su počinili kazneno djelo zloporabe položaja i ovlasti na štetu spomenutoga metkovskog poduzeća.

Optužnica Županijskog državnog odvjetništva teretila je bivše članove Uprave Razvitka da su u srpnju 2000. godine, u cilju nezakonitog pribavljanja velike imovinske koristi, donijeli Naputak kojim su blagajni tvrtke naložili isplatu velike razlike u visini osobnih dohodaka.

Optužnica je Gabrića teretila da je kao predsjednik Nadzornog odbora s Jerkovićem, Damićem i Lekom sklopio izmjene i dopune Ugovora o radu i prema njima im omogućio nezakonitu isplatu uvećanih plaća, odnosno razlike između uplaćene i ugovorene plaće.

Naime, članovima Uprave su, zbog financijskih problema Razvitka, u razdoblju od 1996. do ožujka 2000. godine isplaćivane plaće manje nego su im pripadale po ugovoru o radu. Prema optužnici, shodno donesenom naputku, iz blagajne Razvitkove tvrtke kćeri Razvitak održavanje d.o.o., na štetu Razvitka d.d., isplaćene su im razlike do visine ugovornih 5,7 - 6 prosječnih neto osobnih dohodaka Razvitka, te je po toj osnovi Jerkoviću isplaćeno 140.655 kuna, Damiću 135.652, a Leku 133.641 kuna.

U dokaznom su se postupku okrivljenici redom pozivali na zaborav dijela detalja, ali su nakon čitanja prijašnjih izjava potvrdili dane iskaze. No, oslobađajuća je presuda ipak donesena jer je Sudsko vijeće zaključilo kako kazneno djelo nije počinjeno jer je okrivljenima isplaćeno ono što im pripada po ugovorima o radu.
