Sudac istrage Županijskog suda u Zadru morat će ponovno odlučivati hoće li iz istražnog zatvora pustiti jednog iz grupe maloljetnika koji su 12. lipnja brutalno premlatili 17-godišnjeg zadarskog košarkaša u dvorištu konobe na zadarskom području, piše Zadarski.

Zadranina kojeg je te večeri, navodno na proslavi krizme, napalo više mlađih osoba, ovaj je maloljetnik, zajedno s još jednim, prema izjavama očevidaca, najviše udarao.

U zadarskoj Općoj bolnici dijagnosticiran mu je prijelom jagodične kosti, prijelom kosti gornje čeljusti, prijelom dna očne šupljine, prijelom mandigule, otvorena rana glave, te fraktura lubanje. Zbog težine ozlijeda podvrgnut je operativnom zahvatu s posljedicom otežanog otvaranja usta.

Obojica su uhićena 17. lipnja, od kada se nalaze u istražnom zatvoru u Zadru.

Smatrajući da su mu zadržavanjem u zatvoru povrijeđena prava tražio je od Ustavnog suda RH da ga se pusti na slobodu žaleći se na rješenje Županijskog suda u Zadru od 21. lipnja kojim su im odbijene žalbe, te je potvrđeno rješenje suca istrage Županijskog suda u Zadru o produljenju istražnog zatvora.

Sudac istrage je, naime, utvrdio kako u ovom slučaju postoje osobite okolnosti koje upućuju na opasnost da bi maloljetnici ostankom na slobodi utjecali na svjedoke jer su porekli kazneno djelo koje im se stavlja na teret, a žrtvu kao i ostale svjedoke poznaju, te se očito kreću u istim krugovima. Upravo zbog toga utvrđena je opasnost od ometanja kaznenog postupka osumnjičenika utjecajem na žrtvu i svjedoke koja se ne bi mogla otkloniti nikakvim mjerama opreza.

Odvjetnik maloljetnika je, međutim, naveo kako je on nepotrebno i nezakonito zadržan u statusu istražnog zatvora, te da će svako daljnje zadržavanje provocirati teške i nepopravljive posljedice po njega, kao i za materijalni i zdravstveni status njegove obitelji. Kako je naglasio, jedan od razloga je i taj što je riječ o učeniku drugog razreda Srednje škole, koji će sigurno morati ponavljati razred ukoliko do 30. srpnja ne odradi ukupan broj sati obavezne prakse.

Pozvao se i na to da se prema Zakonu o sudovima za mladež istražni zatvor maloljetniku može odrediti samo kao krajnja mjera, u razmjeru prema težini djela i očekivanoj sankciji, u najkraćem nužnom trajanju i samo ako njegovu svrhu nije moguće postići primjenom mjera opreza, privremenog smještaja ili istražnim zatvorom u domu.

Prema raspoloživim dokazima sudovi su prethodno utvrdili kako egzistira osnovana sumnja da su maloljetnici počinili kazneno djelo iz sadržaja kaznene prijave koju je podnio punomoćnik oštećenog djeteta žrtve, liječničke dokumentacije, zapisnika o očevidu, te neposrednih saznanja djeteta žrtve i svjedoka. Posebno su istaknuli sadržaj službene zabilješke o obavijesnom razgovoru sa žrtvom gdje navodi da ga je kritične prigode napalo više osoba, a da su ga najviše udarali pored ostalih udarali prvookrivljeni I drugookrivljeni.

- Postojanje koluzione opasnosti u početnoj fazi istrage može biti posve očito. Međutim, istražni zatvor po ovoj osnovi ne može trajati nakon što se prikupe odnosno izvedu dokazi zbog čijeg je osiguranja istražni zatvor bio produljen. Nadležni sud dužan je s posebnom pozornošću voditi računa o tome postoje li u konkretnom slučaju i dalje osobite okolnosti koje upućuju na postojanje koluzione opasnosti. Navedena opasnost mora biti konkretne naravi, a sud za to mora dati dostatne, valjane i jasne razloge – naveo je u obrazloženju Ustavni sud TH koji je ukinuo rješenja Općinskog I Županijskog suda o Zadru o zadržavanju maloljetnika u zatvoru.

Ocijenili su da u kontekstu okolnosti razmatranog slučaja zadarski sudovi nisu u dostatnoj mjeri utemeljili prevagu javnog interesa pred jamstvom nepovredivosti slobode pa je maloljetniku povrijeđeno pravo na osobnu slobodu imajući u vidu pripadnost ranjivoj skupini, zbog koje su i propisani posebni uvjeti za određivanje istražnog zatvora na koje sud pazi po službenoj dužnosti.

Sudac istrage Županijskog suda u Zadru morat će ponovno odlučivati hoće li iz istražnog zatvora pustiti jednog iz grupe maloljetnika koji su 12. lipnja brutalno premlatili 17-godišnjeg zadarskog košarkaša u dvorištu konobe na zadarskom području, piše Zadarski.

Zadranina kojeg je te večeri, navodno na proslavi krizme, napalo više mlađih osoba, ovaj je maloljetnik, zajedno s još jednim, prema izjavama očevidaca, najviše udarao.

U zadarskoj Općoj bolnici dijagnosticiran mu je prijelom jagodične kosti, prijelom kosti gornje čeljusti, prijelom dna očne šupljine, prijelom mandigule, otvorena rana glave, te fraktura lubanje. Zbog težine ozlijeda podvrgnut je operativnom zahvatu s posljedicom otežanog otvaranja usta.

Obojica su uhićena 17. lipnja, od kada se nalaze u istražnom zatvoru u Zadru.

Smatrajući da su mu zadržavanjem u zatvoru povrijeđena prava tražio je od Ustavnog suda RH da ga se pusti na slobodu žaleći se na rješenje Županijskog suda u Zadru od 21. lipnja kojim su im odbijene žalbe, te je potvrđeno rješenje suca istrage Županijskog suda u Zadru o produljenju istražnog zatvora.

Sudac istrage je, naime, utvrdio kako u ovom slučaju postoje osobite okolnosti koje upućuju na opasnost da bi maloljetnici ostankom na slobodi utjecali na svjedoke jer su porekli kazneno djelo koje im se stavlja na teret, a žrtvu kao i ostale svjedoke poznaju, te se očito kreću u istim krugovima. Upravo zbog toga utvrđena je opasnost od ometanja kaznenog postupka osumnjičenika utjecajem na žrtvu i svjedoke koja se ne bi mogla otkloniti nikakvim mjerama opreza.

Odvjetnik maloljetnika je, međutim, naveo kako je on nepotrebno i nezakonito zadržan u statusu istražnog zatvora, te da će svako daljnje zadržavanje provocirati teške i nepopravljive posljedice po njega, kao i za materijalni i zdravstveni status njegove obitelji. Kako je naglasio, jedan od razloga je i taj što je riječ o učeniku drugog razreda Srednje škole, koji će sigurno morati ponavljati razred ukoliko do 30. srpnja ne odradi ukupan broj sati obavezne prakse.

Pozvao se i na to da se prema Zakonu o sudovima za mladež istražni zatvor maloljetniku može odrediti samo kao krajnja mjera, u razmjeru prema težini djela i očekivanoj sankciji, u najkraćem nužnom trajanju i samo ako njegovu svrhu nije moguće postići primjenom mjera opreza, privremenog smještaja ili istražnim zatvorom u domu.

Prema raspoloživim dokazima sudovi su prethodno utvrdili kako egzistira osnovana sumnja da su maloljetnici počinili kazneno djelo iz sadržaja kaznene prijave koju je podnio punomoćnik oštećenog djeteta žrtve, liječničke dokumentacije, zapisnika o očevidu, te neposrednih saznanja djeteta žrtve i svjedoka. Posebno su istaknuli sadržaj službene zabilješke o obavijesnom razgovoru sa žrtvom gdje navodi da ga je kritične prigode napalo više osoba, a da su ga najviše udarali pored ostalih udarali prvookrivljeni I drugookrivljeni.

- Postojanje koluzione opasnosti u početnoj fazi istrage može biti posve očito. Međutim, istražni zatvor po ovoj osnovi ne može trajati nakon što se prikupe odnosno izvedu dokazi zbog čijeg je osiguranja istražni zatvor bio produljen. Nadležni sud dužan je s posebnom pozornošću voditi računa o tome postoje li u konkretnom slučaju i dalje osobite okolnosti koje upućuju na postojanje koluzione opasnosti. Navedena opasnost mora biti konkretne naravi, a sud za to mora dati dostatne, valjane i jasne razloge – naveo je u obrazloženju Ustavni sud TH koji je ukinuo rješenja Općinskog I Županijskog suda o Zadru o zadržavanju maloljetnika u zatvoru.

Ocijenili su da u kontekstu okolnosti razmatranog slučaja zadarski sudovi nisu u dostatnoj mjeri utemeljili prevagu javnog interesa pred jamstvom nepovredivosti slobode pa je maloljetniku povrijeđeno pravo na osobnu slobodu imajući u vidu pripadnost ranjivoj skupini, zbog koje su i propisani posebni uvjeti za određivanje istražnog zatvora na koje sud pazi po službenoj dužnosti.

Sudac istrage Županijskog suda u Zadru morat će ponovno odlučivati hoće li iz istražnog zatvora pustiti jednog iz grupe maloljetnika koji su 12. lipnja brutalno premlatili 17-godišnjeg zadarskog košarkaša u dvorištu konobe na zadarskom području, piše Zadarski.

Zadranina kojeg je te večeri, navodno na proslavi krizme, napalo više mlađih osoba, ovaj je maloljetnik, zajedno s još jednim, prema izjavama očevidaca, najviše udarao.

U zadarskoj Općoj bolnici dijagnosticiran mu je prijelom jagodične kosti, prijelom kosti gornje čeljusti, prijelom dna očne šupljine, prijelom mandigule, otvorena rana glave, te fraktura lubanje. Zbog težine ozlijeda podvrgnut je operativnom zahvatu s posljedicom otežanog otvaranja usta.

Obojica su uhićena 17. lipnja, od kada se nalaze u istraž...
