Županijski sudu u Splitu potvrdio je 24. ožujka 2021. pravomoćnost presude kojom su dosuđeni preplaćeni iznosi anuiteta zbog ništetne kamate i ništetne valute CHF za konvertirani kredit, izvijestili su iz Udruge Franak.

- Sutkinja Vesna Kuzmičić, a po nacrtu sudske odluke više sudske savjetnice Katarine Bižaca, potvrdila je 24. ožujka 2021. pravomoćnost presude sisačke sutkinje Sande Navare Sladović, kojom su dosuđeni preplaćeni iznosi anuiteta zbog ništetne kamate i ništetne valute CHF za konvertirani kredit. Tužitelja Darka Benčaka iz Novog Sela u Sisku zastupali su odvjetnici Danko Kovač i Ivan Borić iz Siska – objavili su iz Udruge Franak.

Riječ je o kreditu iz 2005. od 23.350 CHF odnosno 112.000 kuna, koji je otplaćivan na rok od 15 godina. Ukupno će, naveli su, Erste banka vratiti 18.000 kuna preplaćenih anuiteta, što će zajedno sa zateznim kamatama biti oko 36.000 kuna te će platiti još 8.000 kuna sudskih troškova.

- Moramo naglasiti da je ukupni iznos preplate nešto manji od uobičajenih iznosa prije svega zbog toga što se tu radi o kreditu koji je podignut 2005. godine, pa je tečaj CHF padao sve do 2009. godine, a osim toga kamatna stopa je samo neznatno rasla pa je ukupni preplaćeni iznos kamata manji od 1.000 kuna. Sa CHF kreditima najgore su prošli ljudi koji su te kredite ugovarali 2007. i 2008., a u tim godinama je najviše kredita i podignuto – ističu u Udruzi Franak.

Kako su pojasnili, najvažnija obrazloženja pravomoćne presude sutkinje Vesne Kuzmičić i sutkinje Sande Navaro Sladović su sljedeća:

1. Sklapanje aneksa kojim je provedena konverzija nije prepreka za obeštećenje na koje tužitelj ima pravo na temelju kolektivne presude u slučaju franak.

2. Ništetnost nastaje od početka pravnog posla, i ne nestaje naknadnim uklanjanjem ništetnih odredaba, osim kada se radi o odredbama manjeg značaja, što u konkretnom predmetu nije slučaj, jer su ništetni bitni sastojci ugovora, glavni predmet (valuta) i cijena (kamata).

3. Prema presudi Suda EU C-118/17 zamjena ugovornih odredaba novim odredbama ne može imati učinak smanjene zajamčene zaštite potrošača iz Direktive 93/13.

4. Konverzija ne isključuje provođenje kontrole poštenosti odnosno ništetnosti ugovornih odredaba te je unatoč konverziji potrebno utvrditi je li konkretnom konverzijom u cijelosti ispravljena neravnoteža u pravima i obvezama na štetu potrošača uslijed ništetnosti kamatne stope i valutne klauzule.

5. Budući da je financijskim vještačenjem utvrđeno kako je preplata na temelju ništetnosti znatno veća nego preplata iz konverzije, i budući da je preostala glavnica nakon konverzije veća nego preostala glavnica s izuzećem ništetnih odredaba, očigledno je da konverzijom nisu vraćene nepripadne koristi koje je banka stekla.

- Naglašavamo da se radi o pravomoćnoj presudi na temelju koje će banka biti ovršena, ako ne bude htjela postupiti u skladu s presudom te u roku od 15 dana uplatiti dosuđeni novac. Čestitamo sucima, odvjetnicima i tužitelju na presudi! Očekujemo da će na Sudu EU biti potvrđeno već ove godine da su takve presude za konvertirane kredite potpuno u skladu s pravom EU - poručuju iz Udruge Franak pozivajući sve potrošače s nekonvertiranim kreditima da im se jave radi savjetovanja o tužbama na e-mail: franak.tuzbe@gmail.com.

Županijski sudu u Splitu potvrdio je 24. ožujka 2021. pravomoćnost presude kojom su dosuđeni preplaćeni iznosi anuiteta zbog ništetne kamate i ništetne valute CHF za konvertirani kredit, izvijestili su iz Udruge Franak.

- Sutkinja Vesna Kuzmičić, a po nacrtu sudske odluke više sudske savjetnice Katarine Bižaca, potvrdila je 24. ožujka 2021. pravomoćnost presude sisačke sutkinje Sande Navare Sladović, kojom su dosuđeni preplaćeni iznosi anuiteta zbog ništetne kamate i ništetne valute CHF za konvertirani kredit. Tužitelja Darka Benčaka iz Novog Sela u Sisku zastupali su odvjetnici Danko Kovač i Ivan Borić iz Siska – objavili su iz Udruge Franak.

Riječ je o kreditu iz 2005. od 23.350 CHF odnosno 112.000 kuna, koji je otplaćivan na rok od 15 godina. Ukupno će, naveli su, Erste banka vratiti 18.000 kuna preplaćenih anuiteta, što će zajedno sa zateznim kamatama biti oko 36.000 kuna te će platiti još 8.000 kuna sudskih troškova.

- Moramo naglasiti da je ukupni iznos preplate nešto manji od uobičajenih iznosa prije svega zbog toga što se tu radi o kreditu koji je podignut 2005. godine, pa je tečaj CHF padao sve do 2009. godine, a osim toga kamatna stopa je samo neznatno rasla pa je ukupni preplaćeni iznos kamata manji od 1.000 kuna. Sa CHF kreditima najgore su prošli ljudi koji su te kredite ugovarali 2007. i 2008., a u tim godinama je najviše kredita i podignuto – ističu u Udruzi Franak.

Kako su pojasnili, najvažnija obrazloženja pravomoćne presude sutkinje Vesne Kuzmičić i sutkinje Sande Navaro Sladović su sljedeća:

1. Sklapanje aneksa kojim je provedena konverzija nije prepreka za obeštećenje na koje tužitelj ima pravo na temelju kolektivne presude u slučaju franak.

2. Ništetnost nastaje od početka pravnog posla, i ne nestaje naknadnim uklanjanjem ništetnih odredaba, osim kada se radi o odredbama manjeg značaja, što u konkretnom predmetu nije slučaj, jer su ništetni bitni sastojci ugovora, glavni predmet (valuta) i cijena (kamata).

3. Prema presudi Suda EU C-118/17 zamjena ugovornih odredaba novim odredbama ne može imati učinak smanjene zajamčene zaštite potrošača iz Direktive 93/13.

4. Konverzija ne isključuje provođenje kontrole poštenosti odnosno ništetnosti ugovornih odredaba te je unatoč konverziji potrebno utvrditi je li konkretnom konverzijom u cijelosti ispravljena neravnoteža u pravima i obvezama na štetu potrošača uslijed ništetnosti kamatne stope i valutne klauzule.

5. Budući da je financijskim vještačenjem utvrđeno kako je preplata na temelju ništetnosti znatno veća nego preplata iz konverzije, i budući da je preostala glavnica nakon konverzije veća nego preostala glavnica s izuzećem ništetnih odredaba, očigledno je da konverzijom nisu vraćene nepripadne koristi koje je banka stekla.

- Naglašavamo da se radi o pravomoćnoj presudi na temelju koje će banka biti ovršena, ako ne bude htjela postupiti u skladu s presudom te u roku od 15 dana uplatiti dosuđeni novac. Čestitamo sucima, odvjetnicima i tužitelju na presudi! Očekujemo da će na Sudu EU biti potvrđeno već ove godine da su takve presude za konvertirane kredite potpuno u skladu s pravom EU - poručuju iz Udruge Franak pozivajući sve potrošače s nekonvertiranim kreditima da im se jave radi savjetovanja o tužbama na e-mail: franak.tuzbe@gmail.com.

Županijski sudu u Splitu potvrdio je 24. ožujka 2021. pravomoćnost presude kojom su dosuđeni preplaćeni iznosi anuiteta zbog ništetne kamate i ništetne valute CHF za konvertirani kredit, izvijestili su iz Udruge Franak.

- Sutkinja Vesna Kuzmičić, a po nacrtu sudske odluke više sudske savjetnice Katarine Bižaca, potvrdila je 24. ožujka 2021. pravomoćnost presude sisačke sutkinje Sande Navare Sladović, kojom su dosuđeni preplaćeni iznosi anuiteta zbog ništetne kamate i ništetne valute CHF za konvertirani kredit. Tužitelja Darka Benčaka iz Novog Sela u Sisku zastupali su odvjetnici Danko Kovač i Ivan Borić iz Siska – objavili su iz Udruge Franak.

Riječ je o kreditu iz 2005. od 23.350 CHF odnosno 112.000 kuna, koji je otplaćivan na rok od 15 godina. Ukupno će, naveli ...
