Hrvatska agencija za nadzor financijskih usluga (Hanfa) provela je nadzor nad devet leasing društava u Hrvatskoj i utvrdila kako su primateljima leasinga neosnovano obračunate veće kamatne stope.

Potaknuta utvrđenim nezakonitostima i nepravilnostima pri izračunu kamatnih stopa utvrđenima u nadzoru provedenom prošle godine nad društvom Raiffeisen leasing, Hanfa je pokrenula izvanredni postupak nadzora nad još devet većih leasing društava, čime je obuhvatila više od 90 posto ukupne imovine leasing tržišta u Hrvatskoj, naveli su u priopćenju za javnost.

Pri tome su za njih osam utvrđene slične nezakonitosti i nepravilnosti i to za: BKS – leasing Croatia, Erste&Steiermaerkische S-Leasing, Impuls Leasing, Mercedes Benz Leasing Hrvatska, HETA Asset Resolution Hrvatska, OTP Leasing, PBZ-LEASING, i UniCredit Leasing Croatia. Prema procjenama Hanfe, nepravilnostima je obuhvaćeno više od 50 tisuća ugovora o leasingu.

Kako pojašnjavaju u Hanfi, spomenuti nadzor odnosio se prvenstveno na izračun kamatnih stopa u razdoblju od 2008. do 2020. godine. Utvrđeno je da su u tom razdoblju leasing društva neopravdano i jednostrano mijenjala kamatnu stopu u aktivnim ugovorima o leasingu (maržu ili ukupnu kamatnu stopu) na štetu primatelja leasinga, a za što nisu imala jasnu pravnu osnovu niti opravdan razlog te o tim izmjenama nisu obavještavala primatelje leasinga na prikladan način. Time je izbjegnut mogući utjecaj primatelja leasinga na izmjenu bitnog elementa ugovora o leasingu.

- To znači da su sva spomenuta leasing društva, temeljem jednostranog određivanja kamatne stope, obračunavala leasing rate/obroke po kamatnim stopama koje su bile veće od početno ugovorenih. Leasing društava su utjecala na visinu kamatne stope na način da su neosnovano mijenjala visinu kamatne stope ili marže jer nisu usklađivala promjenjive kamatne stope s promjenama tržišnih vrijednosti referentnih kamatnih stopa pa su primatelji leasinga tijekom trajanja ugovora platili ukupno veći iznos od onoga kojeg su trebali prema prvotno ugovornim odredbama – navode u Hanfi.

Također je navedeno kako je tijekom ovog nadzora, društvo Unicredit leasing Croatia dostavilo obavijest i dokaze o povratu preplaćenih sredstava (leasing rata/obroka) primateljima leasinga čije su ugovorne odredbe na opisani način izmijenjene, držeći se pritom općeg zastarnog roka. Na isti način temeljem prethodno provedenog nadzora, povrat preplaćenih sredstava primateljima leasinga izvršilo je i društvo Raiffeisen leasing.

Nadalje, Hanfa je u nadzoru utvrdila da su određene ugovorne odredbe koje pojedina leasing društva primjenjuju u svom poslovanju, a koje se odnose na obračun kamatnih stopa/leasing obroka, nejasne i nerazumljive primateljima leasinga zbog čega se proces obračuna, ali i izmjene kamatnih stopa i dalje odvija na nejasan i netransparentan način. Pri tome je, kod ugovora pojedinih leasing društava o financijskom leasingu namijenjenih potrošačima, utvrđeno i da ugovorne odredbe nisu u skladu sa Zakonom o potrošačkom kreditiranju.

Hanfa je leasing društvima kod kojih su utvrđene opisane nezakonitosti i nepravilnosti naložila da s primateljima leasinga počnu sklapati ugovore na jasan i razumljiv način tako da u njima bude jasno određen način obračuna kamatnih stopa i leasing obroka te uvjeti njihove izmjene, te da ugovore usklade sa Zakonom o potrošačkom kreditiranju, u dijelu obračuna kamata.

Na temelju utvrđenih nepravilnosti u dijelu obračuna kamata, leasing društva su dužna Hanfi dostaviti pisano očitovanje o aktivnostima koja su poduzela prema primateljima leasinga čije su ugovorne obveze neosnovano, netransparentno i jednostrano izmijenjene. Također, Hanfa je leasing društvima naložila i objavu cjelokupnog rješenja na naslovnici njihovih internetskih stranica u trajanju od 60 dana, a sve kako bi primatelji leasinga i cjelokupna javnost bili jasno i transparentno informirani.

Hrvatska agencija za nadzor financijskih usluga (Hanfa) provela je nadzor nad devet leasing društava u Hrvatskoj i utvrdila kako su primateljima leasinga neosnovano obračunate veće kamatne stope.

Potaknuta utvrđenim nezakonitostima i nepravilnostima pri izračunu kamatnih stopa utvrđenima u nadzoru provedenom prošle godine nad društvom Raiffeisen leasing, Hanfa je pokrenula izvanredni postupak nadzora nad još devet većih leasing društava, čime je obuhvatila više od 90 posto ukupne imovine leasing tržišta u Hrvatskoj, naveli su u priopćenju za javnost.

Pri tome su za njih osam utvrđene slične nezakonitosti i nepravilnosti i to za: BKS – leasing Croatia, Erste&Steiermaerkische S-Leasing, Impuls Leasing, Mercedes Benz Leasing Hrvatska, HETA Asset Resolution Hrvatska, OTP Leasing, PBZ-LEASING, i UniCredit Leasing Croatia. Prema procjenama Hanfe, nepravilnostima je obuhvaćeno više od 50 tisuća ugovora o leasingu.

Kako pojašnjavaju u Hanfi, spomenuti nadzor odnosio se prvenstveno na izračun kamatnih stopa u razdoblju od 2008. do 2020. godine. Utvrđeno je da su u tom razdoblju leasing društva neopravdano i jednostrano mijenjala kamatnu stopu u aktivnim ugovorima o leasingu (maržu ili ukupnu kamatnu stopu) na štetu primatelja leasinga, a za što nisu imala jasnu pravnu osnovu niti opravdan razlog te o tim izmjenama nisu obavještavala primatelje leasinga na prikladan način. Time je izbjegnut mogući utjecaj primatelja leasinga na izmjenu bitnog elementa ugovora o leasingu.

- To znači da su sva spomenuta leasing društva, temeljem jednostranog određivanja kamatne stope, obračunavala leasing rate/obroke po kamatnim stopama koje su bile veće od početno ugovorenih. Leasing društava su utjecala na visinu kamatne stope na način da su neosnovano mijenjala visinu kamatne stope ili marže jer nisu usklađivala promjenjive kamatne stope s promjenama tržišnih vrijednosti referentnih kamatnih stopa pa su primatelji leasinga tijekom trajanja ugovora platili ukupno veći iznos od onoga kojeg su trebali prema prvotno ugovornim odredbama – navode u Hanfi.

Također je navedeno kako je tijekom ovog nadzora, društvo Unicredit leasing Croatia dostavilo obavijest i dokaze o povratu preplaćenih sredstava (leasing rata/obroka) primateljima leasinga čije su ugovorne odredbe na opisani način izmijenjene, držeći se pritom općeg zastarnog roka. Na isti način temeljem prethodno provedenog nadzora, povrat preplaćenih sredstava primateljima leasinga izvršilo je i društvo Raiffeisen leasing.

Nadalje, Hanfa je u nadzoru utvrdila da su određene ugovorne odredbe koje pojedina leasing društva primjenjuju u svom poslovanju, a koje se odnose na obračun kamatnih stopa/leasing obroka, nejasne i nerazumljive primateljima leasinga zbog čega se proces obračuna, ali i izmjene kamatnih stopa i dalje odvija na nejasan i netransparentan način. Pri tome je, kod ugovora pojedinih leasing društava o financijskom leasingu namijenjenih potrošačima, utvrđeno i da ugovorne odredbe nisu u skladu sa Zakonom o potrošačkom kreditiranju.

Hanfa je leasing društvima kod kojih su utvrđene opisane nezakonitosti i nepravilnosti naložila da s primateljima leasinga počnu sklapati ugovore na jasan i razumljiv način tako da u njima bude jasno određen način obračuna kamatnih stopa i leasing obroka te uvjeti njihove izmjene, te da ugovore usklade sa Zakonom o potrošačkom kreditiranju, u dijelu obračuna kamata.

Na temelju utvrđenih nepravilnosti u dijelu obračuna kamata, leasing društva su dužna Hanfi dostaviti pisano očitovanje o aktivnostima koja su poduzela prema primateljima leasinga čije su ugovorne obveze neosnovano, netransparentno i jednostrano izmijenjene. Također, Hanfa je leasing društvima naložila i objavu cjelokupnog rješenja na naslovnici njihovih internetskih stranica u trajanju od 60 dana, a sve kako bi primatelji leasinga i cjelokupna javnost bili jasno i transparentno informirani.
