Evo što pravni stručnjaci kažu kako se RNK Split može boriti protiv odluke HNS-a:

- Ako financijski kriterij nije bio ispunjen, pitanje je li žalbeno tijelo za licenciranje HNS-a moglo donijeti drugačiju odluku. No, RNK Split Vijeću sportske arbitraže HOO-a može podnijeti zahtjev za izvanredno preispitivanje odluke komisije za licenciranje HNS.

To može učiniti u roku 60 dana od trenutka kad su iscrpljena druga redovna i izvanredna sredstva pravne zaštite u okvirima nacionalnog sportskog saveza. Upravo je to ovdje slučaj, jer na odluku kojom se odbija žalba tražitelja licence RNK Split, nije dopuštena žalba pred tijelima HNS-a. No, klub mora dokazati da financijski kriterij nije bio upitan. Veliko je pitanjem može li u tome uspjeti.

Napominju da se odluka HNS-a do prije više godina mogla napadati pred arbitražom HNS-a, ali je to izmijenjeno. No, to znači onda je ona upravni akt i da se može pobijati pred upravnim sudom, no i za to treba imati osnove. Da bi se upravni postupak ubrzao, treba je slijediti prijedlog za određivanje privremene mjere gdje bi klub pokušao dokazati da bi mu ostankom te odluke na snazi nastupila nenadoknadiva šteta.

KREĆE ROKTa privremena mjera bi eventualno glasila da se zabranjuje provođenje odluke da se RNK Splitu odbija licenca dok se ne okonča upravni postupak, no onda ostaje prazan prostor u kojem RNK i dalje nema licencu za sezonu 2017./2018., pa je pitanje bi li uopće mogli nastupiti u prvoj ili drugoj ligi - upozoravaju stručnjaci.

Kažu da zbog toga klub sve pravne poteze treba napraviti jako brzo, no da bi sve imalo smisla brzo moraju reagirati i arbitraža HOO-a i Upravni sud.

Evo što pravni stručnjaci kažu kako se RNK Split može boriti protiv odluke HNS-a:

- Ako financijski kriterij nije bio ispunjen, pitanje je li žalbeno tijelo za licenciranje HNS-a moglo donijeti drugačiju odluku. No, RNK Split Vijeću sportske arbitraže HOO-a može podnijeti zahtjev za izvanredno preispitivanje odluke komisije za licenciranje HNS.

To može učiniti u roku 60 dana od trenutka kad su iscrpljena druga redovna i izvanredna sredstva pravne zaštite u okvirima nacionalnog sportskog saveza. Upravo je to ovdje slučaj, jer na odluku kojom se odbija žalba tražitelja licence RNK Split, nije dopuštena žalba pred tijelima HNS-a. No, klub mora dokazati da financijski kriterij nije bio upitan. Veliko je pitanjem može li u tome uspjeti.

Napominju da se odluka HNS-a do prije više godina mogla napadati pred arbitražom HNS-a, ali je to izmijenjeno. No, to znači onda je ona upravni akt i da se može pobijati pred upravnim sudom, no i za to treba imati osnove. Da bi se upravni postupak ubrzao, treba je slijediti prijedlog za određivanje privremene mjere gdje bi klub pokušao dokazati da bi mu ostankom te odluke na snazi nastupila nenadoknadiva šteta.

KREĆE ROKTa privremena mjera bi eventualno glasila da se zabranjuje provođenje odluke da se RNK Splitu odbija licenca dok se ne okonča upravni postupak, no onda ostaje prazan prostor u kojem RNK i dalje nema licencu za sezonu 2017./2018., pa je pitanje bi li uopće mogli nastupiti u prvoj ili drugoj ligi - upozoravaju stručnjaci.

Kažu da zbog toga klub sve pravne poteze treba napraviti jako brzo, no da bi sve imalo smisla brzo moraju reagirati i arbitraža HOO-a i Upravni sud.
