Trgovački sud u Zadru odbacio je prijedlog Financijske agencije za otvaranjem stečajnog postupka nad Nogometnim klubom Zadar jer je Agencija žalbu podnijela nakon isteka propisanog roka.
Rješenje o odbačaju donijela je sutkinja Ana Markač 29. siječnja ove godine odlučujući o žalbi Financijske agencije (FINA) u stečajnom postupku nad imovinom stečajnog dužnika NK Zadar. Sud je utvrdio da je FINA žalbu na rješenje Trgovačkog suda poslala 30. prosinca 2015. godini, iako joj je kao predlagatelju rješenje bilo poslano 7. prosinca 2015. godine.
"Žalba je u sud zaprimljena 30. prosinca 2015. primjenom odredne čl.12. st.5. Stečajnog zakona dostava je dakle obavljena dana 7. prosinca 2015., a primjenom odredbe čl.12. st.2. istoga Zakona 15. prosinca 2015., te je u svakom slučaju rok za podnošenje žalbe protekao prije 30. prosinca 2015." stoji u rješenju stečajne sutkinje.
Odbijenicom žalbe FINA-e NK Zadar je zapravo izbjegao odlazak u stečaj i mogućeg gašenje kluba u današnjem obliku kao sportskog dioničkog društva zbog čistog formalnog propusta FINA-e. Protiv ovog rješenja FINA može podnijeti žalbu Visokom trgovačkom sudu RH, što znači da stečaj NK Zadru još uvijek visi nad glavom.

Trgovački sud u Zadru odbacio je prijedlog Financijske agencije za otvaranjem stečajnog postupka nad Nogometnim klubom Zadar jer je Agencija žalbu podnijela nakon isteka propisanog roka.
Rješenje o odbačaju donijela je sutkinja Ana Markač 29. siječnja ove godine odlučujući o žalbi Financijske agencije (FINA) u stečajnom postupku nad imovinom stečajnog dužnika NK Zadar. Sud je utvrdio da je FINA žalbu na rješenje Trgovačkog suda poslala 30. prosinca 2015. godini, iako joj je kao predlagatelju rješenje bilo poslano 7. prosinca 2015. godine.
"Žalba je u sud zaprimljena 30. prosinca 2015. primjenom odredne čl.12. st.5. Stečajnog zakona dostava je dakle obavljena dana 7. prosinca 2015., a primjenom odredbe čl.12. st.2. istoga Zakona 15. prosinca 2015., te je u svakom slučaju rok za podnošenje žalbe protekao prije 30. prosinca 2015." stoji u rješenju stečajne sutkinje.
Odbijenicom žalbe FINA-e NK Zadar je zapravo izbjegao odlazak u stečaj i mogućeg gašenje kluba u današnjem obliku kao sportskog dioničkog društva zbog čistog formalnog propusta FINA-e. Protiv ovog rješenja FINA može podnijeti žalbu Visokom trgovačkom sudu RH, što znači da stečaj NK Zadru još uvijek visi nad glavom.
